The lawful use of land existing at the time of the passage of this Ordinance, although such use does not conform to the provisions hereof, may be continued, subject to the following conditions hereinafter set forth. Ordinance No 306

A. If any non-conforming use is abandoned, or is discontinued for a period of 12 months or more, subsequent use of said land shall be in conformity with the provisions of this Ordinance unless a variance is granted. B. Any non-conforming use of a building shall not be changed to any other non-conforming use. C. No existing building designed, arranged or intended for or devoted to use not permitted under the regulations of this Ordinance for the District in which such building or premises is located shall be enlarged, extended, reconstructed or structurally altered, unless such use is changed to a use permitted under the regulations specified by this Ordinance for such District in which said building is located; provided, however, that maintenance shall be permitted and such building may be kept in good repair or structurally altered if necessary for public safety. D. If at any time any building in existence or maintained at the time of the adoption of this Ordinance which does not conform to the regulations for the District in which it is located shall be destroyed by fire, explosion, Act of God, or act of a public enemy, unless and until a special use permit is issued by the City Council allowing the non-conforming use to continue in accordance with any conditions determined appropriate by the City Council, to the extent of more than three-fourths the value thereof, then and without further action by the City, or any agency thereof, the said building and the land on which said building was located or maintained shall from and after the date of such destruction be subject to all regulations of the District in which such land and/or buildings are located.
For the purpose of this Ordinance, the value of any building shall be estimated as the cost of the replacement of the building in kind, as determined by the Building Inspector. E. The foregoing provision shall also apply to non-conforming uses in Districts hereafter changed or established.
