10.50.010 - Applicability.

The recruitment, pickup, dispatching and disembarkment of farm labor within the city shall be governed by the provisions of this chapter.

10.50.020 - Definitions.

For the purposes of this chapter:

A. "Disembarkment" means the location where farm laborers are returned within the city after the performance of their employment duties.

B. "Field laborer" means agriculture employees as defined in California Labor Code Section 1140.4.

C. "Providing transportation to agricultural work sites" includes any means of transportation whether or not properly licensed for such purpose, done by or under the direction of an agricultural employer or farm labor contractor.

D. "Recruitment, pickup and dispatching of farm labor" means recruiting persons for employment in farm labor, providing transportation to agricultural work sites and dispatching persons to employment in agriculture services.

10.50.030 - Time restrictions.

The recruitment, pickup and dispatching of farm labor shall be prohibited before the hour of three a.m. within the city from November 1st through March 31st of each year.

10.50.040 - Location restrictions.

The recruitment, pickup, dispatching and disembarkment of farm labor is prohibited in all residential zones within the city. Further the recruitment, pickup, dispatching and disembarkment of farm labor is permitted in all industrial and manufacturing zones within the city and certain designated areas within the commercial zones of the city as outlined in the map attached to the ordinance codified in this chapter and on file in the office of the city clerk, which is incorporated by reference. Such designated areas may be changed by resolution of the city council.

10.50.050 - Location requirements.

All locations used for the recruitment, pickup, dispatching and disembarkment of farm labor shall provide adequate sanitary facilities, trash receptacles and parking facilities. The adequacy of the sanitary facilities, trash receptacles and parking facilities shall be established by resolution of the city council upon recommendation of city staff.

10.50.060 - Compliance with chapter—Certifications required.

All property owners and/or lessees or their authorized designee which may include any grower, custom harvester or labor contractor, whose property is being utilized for farm labor recruitment, pickup, dispatchment and disembarkment and who intend to comply with all provisions of this chapter must file with the city planning department certifications signed under penalty of perjury that the property is being utilized for farm labor recruitment, pickup, dispatching and disembarkment that they intend to comply with all provisions of this chapter.

10.50.070 - Violation—Penalty.

A violation of this chapter shall be deemed an infraction and is punishable by a fine of one hundred twenty-five dollars. The second violation of this chapter within a year is punishable by a fine of two hundred fifty dollars. A third and subsequent violation of this chapter within a year shall be punishable by a fine of five hundred dollars. Each day is a separate violation.
