Light pollution reduction and bird‑friendly building design
You must design outdoor lighting to meet California Energy Code lighting‑zone and BUG limits (see **§ 5.106.8**), treat most of building elevations with bird‑safe glazing or barriers (90% to 40 ft; 60% above 40 ft per **§ A5.107**) and program visible lights off from **2 am to dawn**; if no local tree ordinance exists, follow the shade tree rules in **§ 5.106.12** as referenced by **§ A5.106.11.3**.

What the code requires — plain English with the controlling §
- § 5.106.8 requires outdoor lighting to be designed to reduce light pollution by meeting the California Energy Code’s lighting‑zone rules, controlling Backlight (B), Uplight (U) and Glare (G) (BUG) ratings, and meeting the maximum BUG ratings shown in Table 5.106.8 (or a more stringent local ordinance).

Requirements in detail
Light pollution reduction — key points from § 5.106.8
- Meet the California Energy Code minimums for Lighting Zones 0–4 and use the IES TM‑15 definitions for Backlight (B); use the Energy Code tables for Uplight and Glare.
- Luminaires must not exceed the allowable BUG ratings in Table 5.106.8 (see code).
- Luminaires within 2MH of a property line must be oriented so the nearest property line is behind the fixture and must meet the Backlight rating in Table 5.106.8 based on lighting zone and distance.
- If a property line exists within the luminaire’s forward hemisphere within 2MH, use the more stringent Glare rating.
- Exceptions include emergency lighting, fixtures qualifying under specific Energy Code exceptions, building facades that meet Table 140.7‑B of the Energy Code, custom lighting approved by the enforcing agency, and luminaires with less than 6,200 initial luminaire lumens.
Bird‑friendly building design — key points from § A5.107

Exceptions & special cases
- Historic buildings: glazing alterations in historic buildings are excepted under § A5.107 (California Historical Building Code exception).
- Lighting exceptions under § 5.106.8: luminaires defined as exceptions in Energy Code Sections 130.2(b) and 140.7; emergency lighting; building facades complying with Table 140.7‑B of the Energy Code; local custom approvals; luminaires < 6,200 initial lumens.

Common mistakes
- Orienting fixtures incorrectly: placing luminaires so a property line is in front of the fixture instead of behind it when within 2MH. This violates § 5.106.8.1.
- Assuming any film or frit is acceptable: markers must meet the 2 × 2 Rule sizes/spacing or be testing‑documented technologies per § A5.107.1; also ensure Low‑E coatings are behind the markers.
- Forgetting the 2 am–dawn programming: rooftop and interior glazing‑visible lights must be controlled and programmed per § A5.107.3. cite
- Treating decorative or custom lighting as exempt without local enforcing‑agency approval; custom features require explicit local approval (Section 101.8).
- Relying on partial elevation treatment: the code specifies coverage percentages (90% and 60%) by elevation band—document and show how you meet these bands.
Worked example — concrete scenario with numbers
Scenario: A new 4‑story office building with a street frontage elevation that rises to 60 feet above grade. The owner is replacing all glazing (>50% so A5.107 applies) and is installing exterior site lighting.
Elevation treatment:
- From grade to 40 ft (lower band): you must apply bird‑friendly measures to 90% of that elevation area. For example, if the elevation area up to 40 ft is 2,000 sq ft, then 1,800 sq ft of that band must have bird‑friendly glazing or visible barriers. § A5.107.1
- From 40 ft to the top at 60 ft (upper band): apply bird‑friendly measures to 60% of that band. If that upper band area is 1,000 sq ft, you must treat 600 sq ft. § A5.107.1
Glazing markers:
- Use fritted glass with dots ≥ 1/4" diameter spaced no more than 2" apart both ways (the 2 × 2 Rule), or equivalent film/lamination documented to reduce strikes. § A5.107.1
Rooftop and lobby lighting:
- Install time‑switch controls (or occupancy sensors) and program them to turn building‑visible lights off from 2 am to dawn. Document the schedule in the O&M manual per A5.107.3.1. § A5.107.3
Site luminaire orientation:
- Suppose a parking lot pole is mounted at 15 ft (MH = 15 ft). Then 2MH = 30 ft. If the nearest property line is 25 ft from the pole, the fixture is within 2MH and must be oriented so the nearest property line is behind the fixture and the pole must meet the Backlight rating required in Table 5.106.8 for your Lighting Zone. If you cannot find the numeric B value here, consult Table 5.106.8 in the code / Chapter 8 compliance forms. § 5.106.8.1

SECTION A5.107—BIRD-FRIENDLY BUILDING DESIGN
A5.107 Bird-friendly building design. A newly constructed building, or an alteration of an existing building that includes the addition or replacement of 50 percent or more of the exterior glazing, shall comply with the bird-friendly building design elements and features in Sections A5.107.1 through A5.107.3 of the California Energy Code and the fire hazard severity zone regulations in Chapter 7A of the California Building Code.
Exception: Alteration to the glazing in historical buildings per the California Historical Building Code .
A5.107.1 Required elevation treatment. Building elevation treatment shall incorporate bird-friendly mitigation strategies. No less than 90 percent of a building elevation, measured from grade to a height of 40 feet (12 m) above grade, or from grade to the height of an adjacent mature tree canopy (whichever is greater), shall incorporate bird-friendly mitigation strategies. No less than 60 percent of building elevation, 40 feet (12 m) above grade to the top of the building elevation, shall incorporate bird-friendly mitigation strategies.
Strategies to minimize the risk of birds colliding with buildings: 1. Glazing
Glazing with visual markers shall include, but is not limited to, the following: a. Etched or fritted glass with patterns of elements on the exterior having minimum dimensions of [1] / 4 ” (.64 cm) diameter for dots or [1] / 8 ” (.32 cm) width for stripes in a density of 2 inches (5.1 cm) maximum horizontally and vertically (the “2 × 2 Rule”). Note: If the visual markers are on glass surface 2, they can be effective if visible behind an exterior surface with reflectivity of 15 percent or less. b. Interior or exterior glazing film with 2 × 2 visual markers. c. Laminated glass with 2 × 2 visual markers, patterned ultraviolet (UV) coating or use of contrasting patterned UV-absorbing and UV-reflecting films. Note: Low-e coatings shall be behind the visual markers. d. Glass block or channel glass. e. A5.106.11.2.3 Solar reflectance index alternative. Solar Reflectance Index (SRI) equal to or greater than the values specified in Table A5.106.11.2.2 for Tier 1 and Table A5.106.11.2.3 for Tier 2 may be used as an alternative to compliance with the aged solar reflectance values and thermal emittance.
SRI values used to comply with this section shall be calculated using the Solar Reflectance Index (SRI) Calculation Worksheet (SRI-WS) developed by the California Energy Commission or in compliance with ASTM E1980-11 as specified in the California Energy Code, Section 110.8(i)3. Solar reflectance values used in the SRI-WS shall be based on the aged reflectance value of the roofing product or the equation in section A5.106.11.2.1 if the CRRC certified aged solar reflectance are not available. Certified Thermal emittance used in the SRI-WS may be either the initial value or the aged value listed by the CRRC.
Solar reflectance and thermal emittance may also be certified by other supervisory entities approved by the Commission pursuant to Title 24, Part 1, California Administrative Code.

Strategies to minimize the risk of birds colliding with buildings: 1. Glazing
Glazing with visual markers shall include, but is not limited to, the following: a. Etched or fritted glass with patterns of elements on the exterior having minimum dimensions of [1] / 4 ” (.64 cm) diameter for dots or [1] / 8 ” (.32 cm) width for stripes in a density of 2 inches (5.1 cm) maximum horizontally and vertically (the “2 × 2 Rule”). Note: If the visual markers are on glass surface 2, they can be effective if visible behind an exterior surface with reflectivity of 15 percent or less. b. Interior or exterior glazing film with 2 × 2 visual markers. c. Laminated glass with 2 × 2 visual markers, patterned ultraviolet (UV) coating or use of contrasting patterned UV-absorbing and UV-reflecting films. Note: Low-e coatings shall be behind the visual markers. d. Glass block or channel glass. e. Developed glazing technologies documented to reduce bird strikes, as tested by an independent third party and approved by the authority having jurisdiction; or 2. Slats, Screens, Netting, Louvers
Glazing protected by exterior features that create a visible barrier in front of the glazing, may include, but not be limited to:
a. Horizontal or vertical slats of [1] / 8 ” (.32 cm) minimum face width with minimum 2” (5.1 cm) spacing that obscure 85 percent or more of glass when viewed from all feasible angles. b. Grilles, screens or [1] / 8 ” (.32 cm) dia. welded wire mesh with openings no more than 2” (5.1 cm) maximum horizontally and vertically installed parallel to and no more than 3 [1] / 4 ft (1 m) from the first surface of glass (glass surface 1). c. Netting with 1” (2.5 cm) maximum openings, installed taut at least 6” (15 cm) away from the first surface of glass; or d. Sunshades or louvers 9” (22.5 cm) deep vertically spaced a maximum 9” (22.5 cm) or 6” (15 cm) deep horizontally at maximum 6” (15 cm) spacing and parallel or angled to the glass surfaces.
A5.107.2 Special conditions. The following special conditions shall comply with the provisions in Section A5.107.1 (as appropriate):
- Glass facades adjacent to vegetated roof.
- Glass railings and guardrails.
- Transparent corners that extend 5.5 feet (1.68 m) on either side of a building.
- Glass passageways less than 5.5 feet (1.68 m) wide.
- Auxiliary glass building such as a glass pavilion or atrium exposed to the sky.
- Auxiliary glass building such as a glass pavilion or atrium exposed to a courtyard with a water feature or plants.
- Stained glass windows insulated on the exterior with clear glazing.
A5.107.3 Nighttime conditions. Nighttime lighting at the top of the building, and in the interiors of all areas visible through exterior glazing, including lobby and atrium, shall be controlled with time-switch control devices or occupancy sensors complying with the current California Energy Code. The control device shall be programmed so the lights are extinguished from 2 am to dawn.
Exception: Emergency lighting, lighting required for nighttime security and aeronautical beacon lighting required by the Federal Aviation Administration.

5.106.8 Light pollution reduction. [N] Outdoor lighting systems shall be designed and installed to comply with the following:
- The minimum requirements in the California Energy Code for Lighting Zones 0-4 as defined in Chapter 10, Section 10-114 of the California Administrative Code ; and
- Backlight (B) ratings as defined in IES TM-15-11 (shown in Table A-1 in Chapter 8);
- Uplight and Glare ratings as defined in California Energy Code (shown in Tables 130.2-A and 130.2-B in Chapter 8) and
- Allowable BUG ratings not exceeding those shown in Table 5.106.8 [N], or
Comply with a local ordinance lawfully enacted pursuant to Section 101.7, whichever is more stringent.
Exceptions:
- Luminaires that qualify as exceptions in Sections 130.2(b) and 140.7 of the California Energy Code.
- Emergency lighting.
- Building facade meeting the requirements in Table 140.7-B of the California Energy Code, Part 6.
- Custom lighting features as allowed by the local enforcing agency, as permitted by Section 101.8 Alternate materials, designs and methods of construction.
- Luminaires with less than 6,200 initial luminaire lumens.
5.106.8.1 Facing – Backlight. Luminaires within 2MH of a property line shall be oriented so that the nearest property line is behind the fixture, and shall comply with the backlight rating specified in Table 5.106.8 based on the lighting zone and distance to the nearest point of that property line.
Exception: Corners. If two property lines (or two segments of the same property line) have equidistant points to the luminaire, then the luminaire may be oriented so that the intersection of the two lines (the corner) is directly behind the luminaire. The luminaire shall still use the distance to the nearest point(s) on the property lines to determine the required backlight rating.
5.106.8.2 Facing – Glare. For luminaires covered by 5.106.8.1, if a property line also exists within or extends into the front hemisphere within 2MH of the luminaire then the luminaire shall comply with the more stringent glare rating specified in Table 5.106.8 based on the lighting zone and distance to the nearest point on the nearest property line within the front hemisphere.

Frequently asked questions
What if my local ordinance is stricter than the state tables?
Follow the stricter local ordinance. § 5.106.8 explicitly defers to more stringent local rules.
Does A5.107 apply to small glazing replacements?
A5.107 applies when a new building is constructed or an alteration includes addition or replacement of 50 percent or more of exterior glazing. Smaller repairs/replacements generally do not trigger A5.107.
Are security and emergency lights required to be turned off at night?
No — emergency lighting, lighting required for nighttime security, and FAA aeronautical beacon lighting are exceptions to the 2 am–dawn shutoff in § A5.107.3.
Can bird‑friendly markers go on the interior surface of the glass?
Yes — interior films or coatings that meet the 2 × 2 Rule or equivalent documented performance are acceptable; the code notes interior or exterior film options and the Low‑E placement requirement.
Where do I find the numeric BUG and backlight limits I must meet?
The numeric limits are in Table 5.106.8 and referenced California Energy Code tables (see § 5.106.8). Consult Chapter 8 compliance tables and the Energy Code tables to prepare submittal values.
