Editor's note— Section 1 of Ord. No. 1669 N.C.(2d), adopted October 23, 2012, amended Chapter 8.04 in its entirety to read as herein set out. Former Chapter 8.04 pertained to the same subject matter, consisted of §§ 8.04.010—8.04.130, and derived from Ord. 32 N.C.(2d), 1971.

8.04.010 - State definitions adopted—Definitions generally.

A. Whenever any words or phrases used in this title are not defined herein but are now defined in the Vehicle Code of the state of California, such definitions are incorporated herein and shall be deemed to apply to such words and phrases used herein as though set forth herein in full.

B. The words and phrases set out in this chapter shall have the meanings respectively ascribed to them in this chapter.

8.04.020 - Central traffic district.

"Central traffic district" means all streets and portions of streets within the area described in Resolution No. 58-266 N.C., amendments thereto, and designated as the central traffic district.

8.04.030 - Holidays.

"Holidays" mean and include the following days: January 1st, the third Monday in January (Martin Luther King, Jr. Day), the third Monday in February (President's Day), the last Monday in May (Memorial Day), July 4th, the first Monday in September (Labor Day), the second Monday in October (Columbus Day), November 11th (Veteran's Day), Thanksgiving Day, the day after Thanksgiving Day, December 25th, and any other day designated by the city council. If any of the foregoing days falls on a Sunday, the Monday following is a holiday.

8.04.040 - Reserved.

8.04.050 - Loading zone.

"Loading zone" means a space adjacent to a curb, reserved for the exclusive use of vehicles during the loading or unloading of passengers or materials.

8.04.060 - Official time standard.

Whenever hours are specified herein they mean standard or daylight savings time, whichever may be in use in the city of Vallejo.

8.04.070 - Parking lot.

"Parking lot" means all off-street parking lots or parking structures owned and/or operated by the city of Vallejo.

8.04.080 - Parking meter district.

"Parking meter district" means all streets and portions of streets within the area described as the parking meter district in Resolution No. 58-266 N.C. and amendments thereto, and designated as parking meter district.

8.04.090 - Parking meter.

"Parking meter" means any receptacle, instrument, device, indicator, machine, pay-and-display stations and/or a city-approved software application including those that process pay-by-phone payments from a mobile phone or any other type of technology that accepts payment for the use of any parking space within a parking meter zone maintained by the city of Vallejo.

8.04.100 - Parking meter zone.

"Parking meter zones" are those streets or portions of streets within the parking meter district within which the parking of motor vehicles shall be controlled, regulated, and inspected with the aid of parking meters, pay-and-display stations and/or a city-approved software application that processes pay-by-phone payments from a mobile phone. The city traffic engineer shall cause parking meters and pay-and-display stations to be installed and maintained in all parking meter zones.

8.04.110 - Parking permit.

"Parking permit" means a document, card, sticker or hangtag showing city authorization to park a vehicle within a designated time limited parking area, paid program parking area, parking meter zone, or parking facility maintained by the city of Vallejo as indicated by signs and or markings.

8.04.120 - Parkway.

"Parkway" means that portion of the street right-of-way other than the roadway, curb, gutter and sidewalks.

8.04.130 - Pay machine.

"Pay machine" means any receptacle, instrument, device, indicator or machine which upon the deposit therein of coin of the United States or other form of payment as may be required by this title shows, indicates, registers, displays or permits legal parking in a paid program parking area, parking meter zone, or other parking facility maintained by the city of Vallejo as indicated by signs and or markings wherein or adjacent to which such receptacle, instrument, device, indicator or machine is situated. A pay machine as defined herein may or may not be a self-contained timing device; it may be manually adjusted, automatically or manually controlled, or otherwise operated either externally or internally, so as to show, indicate, register, display or permit legal parking upon the deposit of coin of the United States or other form of payment as required by this title.

8.04.135 - Residential limited parking.

"Residential limited parking area" means an area within a specific geographic residential area of the city designated by city ordinance or resolution upon a finding that there is a high demand for on-street parking and low availability in a residential area.

8.04.140 - Paid program parking area.

"Paid program parking area" means those off street parking facilities, including parking lots and parking structures designated by ordinance or resolution that are regulated by the city pursuant to California Vehicle Code 22519. Parking within the paid program parking area is allowed subject to the payment of a fee as determined by city resolution or ordinance.

8.04.150 - Private parking lot.

"Private parking lot" means all off-street parking lots or parking structures that are not owned, operated, and/or maintained by the city of Vallejo.

8.04.160 - Police officer.

"Police officer" means every officer of the police department of this city, or any officer authorized to direct or regulate traffic or to make arrests for violations of traffic regulations.

8.04.170 - Stand.

"Stand" means to stop and occupy a space with a motionless vehicle, regardless of the occupancy of the vehicle, except to avoid conflict with other traffic, or in obeyance of a traffic regulation.

8.04.175 - Time limited parking area.

"Time limited parking area" means those streets and off street parking facilities, including parking lots designated by ordinance or resolution, that are regulated by the city pursuant to California Vehicle Code 22507, where the public may park for free, subject to a time limit established pursuant to VMC 8.08.060, as indicated by signs or markings.

8.04.180 - Traffic regulations.

"Traffic regulations" mean California statutes, city of Vallejo ordinances and resolutions and the evident intent of any official traffic control device pertaining to traffic in the city of Vallejo.
