Article VII — Subdivision Regulations

All provisions of the Subdivision Map Act of the state of California and Title 16 of this code (Subdivisions) shall apply to property which has been designated by the council as a project site for

experimental residential housing except to the extent that such provisions are waived, varied or modified by the provisions of this article or the procedures prescribed herein. (Prior code § 52.07.701)

The planning director is designated as the "advisory agency," as such term is used in the Subdivision Map Act, in connection with proposed divisions of land by a federal agency or its contractors on property which has been designated as a project site for experimental residential housing. The director shall make investigations and reports on the design and improvement of proposed divisions of land within such project site. (Prior code § 52.07.702)

Appeals from actions of the planning director in respect to the design and improvement of proposed divisions of land within a project site designated for experimental housing shall be taken directly to the city council and no other board or commission of the city shall act as an "appeal board" (as such term is used in the Subdivision Map Act) in respect to such matters. The tentative map subdivision or a parcel map of land within an area designated as a project site for experimental residential housing shall be submitted by the federal agency or its contractors to the planning director for his or her review and recommendations. (Prior code § 52.07.704)

Upon request of the federal agency or its contractors, the planning director shall have the authority to grant variances to all local regulations contained within Title 16 of this code which relate to the design and improvement of subdivisions or divisions of land on property which has been designated as a project site for experimental residential housing. Such variances shall be subject to confirmation of the council by its approval of the tentative map or its approval of the parcel map in accordance with the applicable procedures of the Subdivision Map Act. The filing of a parcel map is not required for property which has been designated as a project site for experimental residential housing and which is divided into four or less parcels. Such divisions of land shall be approved in advance by resolution adopted by the city council. Each such resolution shall contain a finding that the proposed division of land complies with the requirements as to area, improvement and design, flood and water and drainage control, appropriate improvement, public roads, secondary disposal facilities, water supply availability, environmental protection, and other requirements of the Subdivision Map Act, and Title 16 of this code.
