No swimming pool or similar pool shall be located within a distance less than or equal to the depth of the deepest excavation for such pool from any property line, building or structure (one to one slope). When required by the director, plans and design calculations for a pool, prepared by a licensed civil engineer, shall be submitted at the time an application for a permit is filed. A pool may be located at a closed distance to a property line, building or structure, than as specified above if the plans or design calculations include a proper surcharge loading for possible or actual imposed building loads. (Prior code § 9.16.517) 15.64.040 Relocation of existing utility service. Permittee shall be responsible for all relocation of existing water, sewer, electric or gas lines necessitated by installation of a pool. All such work shall be included in the application for a permit to install the pool. (Prior code § 9.16.518)
15.64.050 Protection of adjacent buildings.¶
Concrete walkways or aprons, when provided around swimming or similar pools shall not be placed closer than three feet from any property line, building or structure. There shall be an additional three feet of area extending beyond the concrete walkways or aprons which shall be properly landscaped and graded to prevent any water from the walkways or apron from flowing to any adjacent property line, building or structure. If the installation cannot provide the required three feet of landscaped area, then a proper and adequate collector and drainage system shall be installed to carry such water to an approved sump connected to the storm sewer or to a landscaped area providing three square feet of area for each lineal foot of walkway or apron drained. Gravel-filled ditches shall not be placed interface of pool deck and adjacent walkway. Such collection and drainage system shall be placed below the walkway or apron level adjacent to the property line, building or structure, and shall be properly covered to prevent debris from accumulating in such system and preventing it from functioning properly. (Prior code § 9.16.519)
15.64.060 Hazards. No pool installation shall be made that will create a hazardous condition on the outside of the pool adjacent to existing construction or adjacent property lines. Such conditions considered to be hazardous shall include, but are not limited to, open ditches, pool walkways, apron or deck edge not level with existing concrete walks or patio decks, except that where steps, stairs or ramps are provided, because of a planned difference in elevation between will be permitted, pool walkways or apron not extended to meet existing concrete slabs used as walkways or for access to a building, or any other physical hazard that could affect normal use of the property. (Prior code § 9.16.520) 15.64.070 Fences.
All swimming pools or similar pools shall be completely enclosed by a fence to prevent access to the pool from other than from within the building. Such fence shall be a minimum of five feet in height, except that existing fences, installed under previous codes that are a minimum of four feet six inches in height may remain. Fences shall be constructed so as not to provide openings or projections or other facilities that would make such fence conducive to climbing by a child. If vertical members are supported by top and bottom rails connected to posts, the space between such vertical members shall not exceed five inches.
Access to the pool from outside the fence shall be by way of a gate. Such gate shall be equipped with a self-latching device which is not accessible from the outside of the fence and which will keep the gate closed and latched at all times. (Prior code § 9.16.521)
