Article I — In General

15.120.010 Legislative intent.¶
The purpose and intent of this chapter is to provide a procedure by which the city may summarily zone or rezone property or summarily grant variances from the building, housing, zoning and other codes, ordinances and regulations of the city in connection with the development, construction, and sale of prototype or experimental housing by the federal agency or its contractors on sites situated within the limits of the city. The procedures established herein shall be liberally construed to effectuate the above-described purpose and intent. (Prior code § 52.01.101)
15.120.020 Legislative authority.¶
This chapter is adopted by the city as a charter city pursuant to its own power and authority as a chartered city and the provisions of the Planning and Zoning Law, as set forth in Government Code Section 65000 et seq., shall not be deemed to be applicable to the adoption of this chapter or any act taken by the city or its officers or employees under the provisions of this chapter. (Prior code § 52.01.102)
15.120.030 Conflicting procedures.¶
Any provision of the Sacramento City Code or the ordinances of the city, insofar as it should conflict with the provisions of this chapter or with any part thereof shall be superseded by the contents of this chapter. (Prior code § 52.01.103)
15.120.040 General definitions.¶
As used in this chapter only, the following terms shall have the definitions shown:
"Contractor of a federal agency" means any person, association or corporation which has entered into a contract or agreement with a federal agency in connection with the planning, design, development, management or disposition of experimental or prototype housing at a project site within the city which has been designated for residential experimental housing in accordance with this chapter.
"Federal agency" means a department or agency of the federal government.
"Variance" as used in connection with the provisions of Articles IV and V of this chapter means and includes both variances from the regulations of the Planning and Development Code and conditional use permits which vary the regulations of such ordinances.
