Article II — Application of Chapter

The provisions of this chapter shall not apply to any property in the city unless such property has been selected and designated by the council as a project site for experimental residential housing. (Prior code § 52.02.201)

No property within the city shall be selected or designated as a project site residential experimental housing unless all of the following conditions are applicable to such property:

A. Residential and related uses are being constructed on the site by a federal agency or its contractors in connection with a project involving the development and construction of prototype or experimental residential housing and related uses.

B. The city has by ordinance or agreement assumed the obligation to grant such variances from the building, housing, zoning and other ordinances of the city and to make such changes in zoning of such site as are necessary to permit the construction, alteration, occupancy and disposal for intended use of the prototype or experimental housing and related uses.

C. The federal agency has agreed to assume the responsibility for review of all plans relating to the development and construction of the prototype or experimental housing and has further agreed to act in a general supervisory role in connection with the development and implementation of the project.
