Chapter 4.88 — ACQUISITION OF REAL PROPERTY FOR THE NEIGHBORHOOD STABILIZATION

4.88.010 - Findings.¶
The board of supervisors finds that the intent of the neighborhood stabilization program ("program") is to mitigate the impacts of increasing foreclosures within the county. The program requires the expenditure of funds on foreclosed and abandoned real properties within eighteen (18) months of receipt of grant funds. This short time period and the nature of purchasing foreclosed and abandoned real properties necessitate an expedited procedure to approve and accept the acquisition of real property.

4.88.020 - Purpose.¶
The purpose of this chapter is to authorize the assistant county executive officer/EDA to perform any and all acts necessary to approve and accept for the county the acquisition of any interest in real property and to establish the procedures for the exercise of this authority.

4.88.030 - Authority.¶
This chapter is adopted pursuant to Government Code Section 25350.60 which provides that a county may authorize a county officer it deems appropriate to perform any or all acts necessary to approve and accept
for the county the acquisition of any interest in real property.

4.88.040 - Delegated authority.¶
The assistant county executive officer/EDA ("officer") is hereby authorized to approve and accept for the county the acquisition of any interest in real property providing all the following criteria are met:
A.
The real property interest is being acquired for the neighborhood stabilization program.
B.
The value of any real property interest acquired does not exceed three hundred thousand dollars ($300,000.00).
C.
The acquisition documents have been approved by county counsel.
D.
The officer has posted, or caused to be posted, in a public place for five working days prior to approving the acquisition a notice of intention that he/she intends to execute acquisition documents.
E.
The acquisition documents have been made available for public review for five working days prior to approving the acquisition.

4.88.050 - Reporting requirement.¶
The officer or his/her designee shall submit a report every six months to the board of supervisors describing the real property interests acquired under this authority.

4.88.060 - Termination.¶
The authority granted by this chapter to the officer shall terminate five years from February 5, 2009.
