10.52.010 Definitions.¶
For the purposes of this chapter, the following words and phrases shall have the meanings respectively ascribed to them by this section: A. "Bicycle" means any device upon which a person may ride, which is propelled by human power through a system of belts, chains or gears and which has wheels at least twenty inches in diameter and a frame size of at least fourteen inches. B. "Chief of police" means the chief of police of the city. C. "Police department" means the police department of the city. (Ord. 249 § 1, 1975)
10.52.020 License—Required.¶
It is unlawful for any person to operate or use a bicycle propelled wholly or in part by muscular power upon any streets, alleys or public highways of the city without first obtaining from the police department a license therefor as provided in this chapter and as required by state law pertaining thereto. (Ord. 249 § 2, 1975)
10.52.030 Licensing agent.¶
The chief of police shall have the authority to designate and appoint qualified agents for the issuance of bicycle licenses and the registering of bicycles pursuant to the provisions of this chapter. (Ord. 249 § 25, 1975)
10.52.040 Rental bicycles-License —¶
Requirements. Every person engaged in the business of a bicycle rental agency shall not rent or offer any bicycle for rent unless the bicycle is licensed and a license plate is attached thereto as provided in this chapter and such bicycle is equipped with all accessories and equipment as required for the operation of bicycles in the state as set forth in the Vehicle Code of the state. 10.52.050 License — Application and¶
issuance. The police department is authorized to issue bicycle licenses of the type as authorized by state law pertaining thereto, which licenses, when issued shall entitle the licenses to operate such bicycles for which the licenses have been issued upon all the streets, alleys, public highways, or upon any path set aside for the use of bicycles in the city (Ord. 249 § 4, 1975)

10.52.060 License—Inspection.¶
The police department shall inspect each bicycle prior to the issuance of a license and shall require adequate brakes and tires as prerequisites for the issuance of the license. The police department may by written or oral text, examine any or all applicants for satisfactory knowledge of bicycle safety laws, and may withhold the issuance of a license from any applicant failing to pass such test. 10.52.070 License—Denial.¶
The police department may refuse to issue a license to any applicant who does not have reasonable knowledge of the provisions of this chapter and Sections 21200 through 21207 of the Vehicle Code of the state, or who is unable to exercise reasonable control in operating a bicycle. (Ord. 249 § 6, 1975)
10.52.080 License—Fee.¶
The license fee to be paid for each bicycle shall be one dollar per year, and shall be paid at the time of issuance of the original license or any renewal thereof If the purchaser or transferee of the bicycle which has previously been licensed fails to register such a transfer within ten days of the date of the purchase or transfer, he shall then be required to take out a new license and pay a license fee of one dollar per year therefor. If a license is transferred when the ownership of a bicycle is transferred, application for transfer shall be made to the police department, and a fee of one dollar shall be paid for the registration of such transfer. All license fees and transfer fees collected under this chapter shall be paid into the general fund of the city. (Ord. 249 § 7, 1975)
10.52.090 License—Form—Records.¶
The city shall provide a license in the form as approved and distributed by the state, which shall be properly attached to the bicycle frame. The police department shall maintain a record of each bicycle registered which shall include the license number, the serial number of the bicycle, the make, type and model of the bicycle, and the name and address of the licensee which shall be maintained during the period of the validity of the license. 10.52.100 License — Revocation —¶
Reissuance. The police department shall have the power to revoke any license issued under this chapter for violation of any provision of this chapter, or the Vehicle Code of the state. No license shall be issued to any person suffering a revocation within thirty days after such revocation. (Ord. 249 § 8, 1975)
10.52.110 License—Duplicate.¶
It shall be the duty of every license holder to immediately notify the police department of the loss, destruction or mutilation of any license plate, seal, registration card or receipt. The police department may thereupon issue duplicates thereof at a cost of fifty cents. It shall be the duty of every license holder to return his license plate, seal, registration card or receipt when the bicycle for which they were issued is destroyed or damaged beyond repair. 10.52.120 Secondhand dealers — Daily¶
report. All persons engaged in the business of buying secondhand bicycles within the city are required to make a daily report to the police
181 Bicycles (5/86) department, giving name and address of the person from whom each bicycle is purchased, the description of each bicycle purchased, the frame number thereof and the number of the license plate found thereon, if any. (Ord. 249 § 12, 1975)
10.52.130 Dealers—Monthly report.¶
Every person engaged in the business of selling new or secondhand bicycles shall make a monthly report to the police department, or all sales by such person of new or secondhand bicycles during the preceding month, giving a list of all sales made by such dealer which list shall include the name and address of each person to whom a bicycle is sold, the kind of bicycle sold, together with a description and the frame number thereof, and the number of the metallic license plate attached thereto, if any (Ord. 249 § 13, 1975)
10.52.140 Report of sales or transfers of¶
ownership. It shall be the duty of every person, except persons in the business of buying or selling bicycles, who sell or transfers ownership of any bicycle, to report such sale or transfer by returning to the police department the registration card or receipt issued to such person as licensee thereof, together with the name and address of the person to whom such bicycle was sold or transferred, and such report shall be made within ten days following the date of the sale or transfer. It shall be the duty of the purchaser or transferee of such bicycle to apply for a transfer or registration within ten days following the date of the transfer or sale. (Ord. 249 § 14, 1975)
10.52.150 Prohibited on sidewalk in¶
certain areas. A. No person shall ride a bicycle upon a sidewalk within the following designated business district: On either side of Main Street east of Acacia Street and west of Industrial Avenue or on either side, of Stockton Street north of Second Street and south of the Southern Pacific right-of-way. B. The chief of police in addition is authorized to erect signs on any sidewalk or roadway prohibiting the riding of bicycles thereon by any person and when such signs are in place no person shall disobey the same. C. No person nine or more years of age shall ride a bicycle upon any sidewalk in the city. D. Whenever any person is riding a bicycle upon a sidewalk, such person shall yield the right-of-way to any pedestrian and shall give an audible signal before overtaking and passing such pedestrian. 10.52.160 Parking restrictions.¶
No person shall park any bicycle against any windows or parking signs or in the main traveled portion of the sidewalks, nor in such manner to constitute a hazard to pedestrians, traffic or property. If there are no bicycle racks or other facilities used to park bicycles in the vicinity, bicycles may be parked on the sidewalk in an upright position parallel to the curb in such a manner as to afford the least obstruction to pedestrian traffic. 10.52.170 Violation Penalty.¶
Every person, firm or corporation violating any of the provisions of this chapter
182 Bicycles (5/86) shall be deemed guilty of an infraction, and upon conviction thereof shall be punishable by a fine of not more than five dollars. In addition to the penalty set forth in this section, the police department may impound and retain possession of any unlicensed bicycle until the license provided for in this chapter has been obtained, and may impound and retain possession of, for not more than thirty days, any bicycle operated in violation of any of the provisions of this chapter.
