2-2.201 - Title of provisions.

This article shall be known and may be cited as the "Finance Law of the City of Maywood".

2-2.202 - Office created.

There is hereby created and established the office of Director of Finance.

2-2.203 - Powers and duties.

The Director of Finance shall perform all duties required of his office by State laws, this article, other laws of the City, and such other duties not in conflict therewith as may be required by the Council. In addition, the Director of Finance shall have the following powers and duties:

(a) Administration of financial affairs. Have charge of the administration of the financial affairs of the City;

(b) Budget. Compile the budget expense and income estimates for the Council;

(c) Accounting system. Supervise and be responsible for the maintenance of a general accounting system for the City government and of each of the offices, departments, and agencies;

(d) Disbursements. Supervise and be responsible for the disbursement of all moneys and have control of all expenditures; audit all purchase orders before issuance; and audit and approve before payment by the Council and Treasurer all bills, invoices, payrolls, demands, and other charges against the City government;

(e) Financial reports. Submit to the Council a monthly statement of all receipts and disbursements in sufficient detail to show the exact financial condition of the City and, as of the end of each fiscal year, submit a complete financial statement and report. The audit report of the City shall satisfy the requirement as to the financial statement;

(f) Property inventory. Supervise the keeping of current inventories of all property of the City by all City departments, offices, and agencies;

(g) Other delegated duties. Perform all the financial and accounting duties heretofore imposed upon the City Clerk, and the City Clerk shall be and he hereby is relieved of all such duties imposed upon the City Clerk by Chapter 4 of Part 2 of Division 3 of Title 4 and by Sections 40802 through 40805, inclusive, of the Government Code of the State;

(h) Collections. Demand and receive all moneys and fees owing to the City whenever any person is indebted to the City in any manner when the means of collection of such debt is not otherwise provided for by law. When any shall not be collectible by other methods, he shall report the same to the City Attorney for prosecution;

(i) Billing. Supervise the collection and billing of all City fees and charges and all other miscellaneous income receipts to the City;

(j) Business licenses. Prepare the City business licenses and supervise the issuance of business licenses and the collection of fees therefor; and

(k) Other functions. Perform such other functions as the Council may from time to time specify or such other functions as may be prescribed from time to time by action of the Council.

2-2.204 - Duties transferred from the City Clerk.

The duties imposed upon the City Clerk by Chapter 2 of Part 3 of Division 3 of Title 4 of the Government Code of the State are hereby transferred to the Director of Finance in accordance with Sections 37209 and 40805.5 of said Government Code. In addition, the finance and accounting duties imposed upon the City Clerk by Sections 40802 through 40805 of said Government Code are hereby transferred to the Director of Finance. The Director of Finance shall have those duties which were the duties of the City Clerk that are transferred to the Director of Finance by this article.

2-2.204.5 - Deputy city clerk.

"The City Council may appoint a City employee to act as Deputy City Clerk, as needed in the unavailability of the Elected City Clerk, as determined by the Chief Administrative Officer; who under such circumstances may perform functions and execute documents as if he or she were the Elected City Clerk.

2-2.205 - Compensation.

The Director of Finance shall receive as compensation such salary as the Council shall from time to time fix by resolution.

2-2.206 - Bond of public office.

The Director of Finance, upon entry to his duties of office, shall execute a bond to the City conditioned upon the faithful performance of his duties and in conformity with bonds of public officers, in accordance with the provisions of the Government Code of the State relating thereto, the amount of such bond to be determined by the Council.

2-2.207 - Duties of the City Treasurer excluded.

The provisions of this article shall not be construed to require the Director of Finance to perform any of the duties given by law to the City Treasurer.
