2-6.101 - Establishment and composition of commission.

(a) There is created a Community and Police Relations Commission ("Commission") consisting of five (5) members. The Commissioners shall be appointed by the Mayor with the approval of the Council.

(b) Of the members of the Community and Police Relations Commission first appointed, three (3) shall be appointed for a term ending December 31, 2007, and two (2) shall be appointed for a term ending December 31, 2008. Their respective successors shall be appointed for terms of two (2) years. Each term shall expire on December 31 at the end of the term of appointment; provided, however, each member shall continue to serve thereafter until his or her respective successor is appointed and qualifies, if vacancies shall occur, otherwise than by expiration of term, they shall be filled by appointment for the unexpired portion of the term, in accordance with the Maddy Act, California Government Code 54970. Commissioners may be removed at any time by the vote of a majority of the members of the Council.

2-6.102 - Compensation.

Each member of the Community and Police Relations Commission shall be compensated at such rate as the Council from time to time may fix by resolution. Initial compensation shall be Fifty and No/100ths ($50.00) Dollars per month.

2-6.103 - Meetings.

(a) The Commission shall meet as follows:

(1) The first Tuesday of each month unless the first Tuesday is a holiday. In case of holiday, the meeting shall be held on the next day which is not a holiday.

(2) If there is no item for consideration on the agenda, the Commission Secretary, with the concurrence of the Chief Administrative Officer, may cancel the meeting.

(3) The Commission may also meet at the specific request of the City Council.

(b) If without cause, a member of the Community and Police Relations Commission shall be absent from three (3) successive regular meetings of the Commission, other than by permission of the Commission expressed in its official minutes, the office of such member shall be deemed to be vacant and the term of such member ipso facto terminated, and the Commission shall immediately inform the Council of such termination.

(c) An absence due to illness or an unavoidable absence from the City shall be deemed absence for cause if written notice thereof is sent to the Community and Police Relations Commission on or before the day of any regular meeting of the Commission.

2-6.104 - Additional personnel.

To assist the Commission in the performance of its duties, the Council may provide the Commission with paid part-time personnel. Should the services of any regular City employee be needed, request therefor may be made by the Commission to the Chief Administrative Officer, and he is authorized to assign such personnel, if available.

2-6.105 - Organization.

The Commission shall elect its chairman from among its appointed members for a term expiring the next succeeding December 31st, and, subject to other provisions of law, may create and fill such other offices as it may determine. Nevertheless, the Chairman shall serve until his/her successor is elected. The Commission shall adopt rules for the transaction of business and shall keep a record of its resolutions, transactions, findings, and determinations, which record shall be a public record.

2-6.106 - Liaison representation.

(a) The Mayor shall designate a member of the Council to meet with the Commission but such Council member shall not be a member of the Commission.

(b) The Chief of Police, or in his absence a member of his administrative staff, shall meet with the Commission but shall not be a member of the Commission.

2-6.107 - Powers and duties of the Commission.

The Commission shall have the following powers and duties:

(a) To initiate studies and surveys in the general field of police science and law enforcement and report its findings and recommendations to the Council;

(b) To conduct hearings, investigations, or both, at the request of the Council, for the purpose of ascertaining whether additional legislation is needed for the health, safety, peace and welfare of the inhabitants of the City and to make findings and recommendations to the Council;

(c) To act in an advisory capacity to the Council on policy matters pertaining to the Police Department of the City;

(d) To receive complaints, except those relating to traffic engineering or individual officers, pertaining to the Police Department and law enforcement in general;

(e) To examine books, papers, records and accounts in the Police Department, other than confidential matters under investigation.

2-6.108 - False statements.

Any false statement willfully made under oath in any paper filed with the Commission, or in any testimony given in any proceedings before the Commission, or in any investigation conducted by or under the jurisdiction of the Commission, shall be punishable as provided by the Penal Code of the State of California.
