6.28.010 - Minor in public place after curfew unlawful—Exceptions.

It is unlawful for any minor, defined by this section as a person under the age of sixteen years, to loiter, idle, stroll or play in any public street, public square, park, or any public place between the hours of twelve midnight and one-half hour before sunrise of the following day; provided, however, that the provisions of this section do not apply to a minor accompanied by his or her parent, guardian or other adult person having the care and custody of the minor, or where the minor is upon an emergency errand or legitimate business directed by his or her parent, guardian or other adult person having the care and custody of the minor; nor where such minor is directly proceeding to or from any place of business employment, amusement, worship or other legitimate activity.

6.28.020 - Minors, after curfew, forbidden to drive vehicles.

It is unlawful for any person under the age of sixteen years to ride in or on a motor vehicle, about the public streets, alleys, avenues, parks, public squares or any other public places between the hours of twelve midnight and one-half hour before sunrise of the following day when not accompanied by his or her parent or legal guardian having custody and control of such person, or other adult person having the care and custody of such person; provided, however, that the provisions of this section do not apply to any such person who is operating or tiding in a motor vehicle engaged in gainful employment, or upon an emergency errand, or on legitimate business directed by his or her parent, guardian or other adult directly proceeding to or from any place of business employment, amusement, worship or other legitimate activity.

6.28.030 - Penalties for violation by minor.

Any minor under the age of sixteen years who violates any of the provisions of this chapter is guilty of an infraction and is subject to the provisions of Chapter 2, Division 2 of the Welfare and Institutions Code of the state of California.

6.28.040 - Permitting minors in certain public places.

It is unlawful within the county for any proprietor, keeper, clerk or any other person having charge or control of any cafe, tavern, restaurant, bar, eating place or public dancehall to permit any person under the age of eighteen years to remain in said public place enumerated in this section between the hours of eleven p.m. and daylight immediately following; provided, that the provisions of this section do not apply to a minor or minors accompanied by his or her parent, guardian, or other adult person having the care and custody of the minor.

6.28.050 - Riding in or operating motor vehicles—Exceptions.

It is unlawful for any person under the age of eighteen years to operate a motor vehicle or ride in or on a motor vehicle about the public streets, alleys, avenues, parks, public squares, or any other public places between the hour of eleven p.m. and the time of sunrise of the following day when not accompanied by his or her parent or legal guardian having legal custody and control of such person, or other adult person having the care and custody of such person; provided, however, that the provisions of this section do not apply to any such person who shall be operating or riding in a motor vehicle engaged in gainful employment, or upon an emergency errand, or on legitimate business directed by his or her parent, guardian, or other adult person having the care and custody of such person. The sheriff of the county is empowered and authorized to impound any motor vehicle which is being operated or used in violation of this chapter.

6.28.060 - Penalty for violation by minor.

Any minor who violates any of the provisions of this chapter is guilty of a misdemeanor and subject to the provisions of Chapter 2, Division 2 of the Welfare and Institutions Code of the state of California.

6.28.070 - Penalty for violations by adult.

Any person, other than a minor who violates any of the provisions of this chapter is guilty of a misdemeanor, which violation shall be punishable by a fine of not more than five hundred dollars or by imprisonment in the county jail for not more than six months, or by both such fine and imprisonment.

6.28.080 - Severability.

If any provision of this chapter, or the application thereof to any person or circumstance is held to be unconstitutional, the remainder of this chapter and the application of such provisions to other persons and circumstances shall not be affected thereby. The board of supervisors hereby declares that it would have passed this chapter and each section, subsection, sentence, clause or phrase thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases be declared unconstitutional.
