Kern County Municipal Code Art. III Parking Limitations

Pursuant to the provisions of Section 22507 of the Vehicle Code, and in addition to the no-parking or limited parking zones established pursuant to Section 10.16.010 of this chapter, there are established the following no-parking and limited parking zones for the unincorporated areas of the county at the locations described in this article.

In the absence of the posting of a stricter limitation, it shall be unlawful for any vehicle, as defined in the Vehicle Code of the State of California, to remain parked or standing upon any public street or alley within the unincorporated area of the county, with the exception of state highways, for a period of seventy-two (72) or more consecutive hours. If a vehicle is posted with notice of a potential violation of this section, the vehicle must be moved a distance of at least one mile to show that the vehicle is not abandoned and fully operable. In the alternative, the vehicle may be moved on to private property, but it may not return to the area where it was noticed for a period of at least seventy-two (72) hours.

The sheriff of the county may remove any vehicle which has been found to be in violation of Section 10.16.061. Prior to the removal, the vehicle must be posted with a notice of potential violation for a period of at least forty-eight (48) hours. In investigating whether a violation of this section has occurred, the totality of the circumstances shall be considered including, but not limited to, tire markings, eyewitness accounts, dirt and debris, photographic evidence, and odometer readings, if applicable. If removal occurs the vehicle shall be taken to the nearest garage or other place of safety, and the keeper of such garage or other place of safety shall have a lien thereon for his compensation for towage and for caring for and keeping safe such vehicle, and he may satisfy such lien upon compliance with and under the conditions stated in section 22850 et seq. of the Vehicle Code. The lienholder shall surrender the vehicle to the owner upon tender of the storage and other fees provided for in the Vehicle Code and Sections 3067—3075 of the Civil Code where applicable.

Whenever the sheriff directs the removal and storage of a vehicle in accordance with Section 10.16.061, the sheriff shall provide the vehicle's registered and legal owners of record, or their agents, with the opportunity for a post-storage hearing to determine the validity of the removal and storage.

A. A notice of such storage shall be mailed or personally delivered to the registered and legal owners within forty-eight (48) hours, excluding weekends and holidays, and shall include the following information:

1. The name, address, and telephone number of the sheriff;

2. The storage location and a description of the vehicle, which shall include, if available, the name or make, the manufacturer, the license plate number, and the mileage;

3. The authority and purpose for the removal of the vehicle;

4. The notification shall also specify that the owners, or their agents, are entitled to a post-storage hearing so long as they make a request for the hearing in person, in writing, or by telephone within ten (10) days of the date appearing on the notice. Any hearing shall be conducted within forty-eight (48) hours of the request, excluding weekends and holidays, unless the owners or their agents ask for an extension of the hearing time.

B. If a hearing is requested, the Sheriff shall have the burden of proof and the Sheriff shall within twenty-four (24) hours of the request provide the owners, or their agents, with identities of any witnesses and copies of any evidence and or reports that the sheriff shall present at the hearing to justify the storage.

C. The sheriff may authorize his own officer or employee to conduct the hearing, so long as the officer is not the same person who directed the storage of the vehicle.

D. Failure of either the registered or legal owners, or their agents, to request or to attend a scheduled hearing shall satisfy the post-storage validity hearing requirement of this section.

E. The sheriff shall be responsible for the costs incurred for towing and storage of the vehicle if the sheriff is unable to demonstrate in the hearing that the storage was done without legal authority and reasonable grounds.

F. The provisions of this section shall not apply to the removal of vehicles impounded pursuant to the provisions of Sections 22660—22668 inclusive, Section 22655, Section 22658, or Section 22710 of the Vehicle Code.

A. Whenever the sheriff removes a California registered vehicle from a public street, alley, or highway as authorized in Section 10.16.062 and the sheriff does not know and is unable to ascertain the name of the owners or for any other reason is unable to give the notice to the owner as provided by Section 22852 of the Vehicle Code, the sheriff shall immediately notify the Department of Justice Stolen Vehicle System of its removal. The notice shall include a complete description of the vehicle, the date, time, and place from which removed, the amount of mileage on the vehicle at the time of removal, the grounds for such removal, and the name of the garage or place where the vehicle is stored. A copy of the notice shall also be provided to the proprietor of any public garage or other place of safety in which the vehicle is stored.

B. Whenever the sheriff removes a vehicle which is not registered in California from a public street, alley, or highway as authorized in Section 10.16.062 and the sheriff does not know and is unable to ascertain the name of the owners or for any other reason is unable to give the notice to the owners as provided by Section 22852 of the Vehicle Code, the sheriff shall immediately notify the Department of Justice Stolen Vehicle System of its removal. The notice shall include a complete description of the vehicle, the date, time, and place from which removed, the amount of mileage on the vehicle at the time of removal, the grounds for such removal, and the name of the garage or place where the vehicle is stored. A copy of the notice shall also be provided to the proprietor of any public garage or other place of safety in which the vehicle is stored. If the vehicle is not returned to the owners within a period of one hundred twenty (120) hours, the sheriff shall immediately mail a written report of the removal to the department of justice at Sacramento and shall file a copy of such notice with the proprietor of any garage or other place of safekeeping in which the vehicle has been stored. The report shall be made on a form furnished by the department of justice.

The following parking limitations are established near the city of Bakersfield:

1. One (1) hour parking zone on the east side of Virginia Street, between a point where said east side of Virginia Street intersects with the south side of Flower Street and a point eighty (80) feet south thereof along Virginia Street, except the northerly twenty-seven (27) feet thereof.

2. One (1) hour parking zone on the south side of Flower Street between a point where said south side of Flower Street intersects with the east side of Virginia Street and a point one hundred (100) feet east thereof along Flower Street, except the westerly twenty-seven (27) feet thereof.

3. No-parking zone on either the east or the west side of South P Street, between Belle Terrace and Casa Loma Drive, at any time during the period from one (1:00) a.m. of the opening day of the annual Kern County Fair and twelve (12:00) p.m. on the closing day of said fair; provided, however, that taxis and public passenger buses may park in designated loading and unloading areas when taking on or discharging passengers.

4. Parking on the east side of Mount Vernon Avenue from Pacific Drive to Quincy Drive and on the west side of Mount Vernon Avenue from Quincy Drive to Flower Street is limited to one (1) hour between the hours of nine (9:00) a.m. and four (4:00) p.m., except on Sunday.

5. One (1) hour parking zone on the south side of Flower Street between a point where said south side of Flower Street intersects with the east side of West Drive and a point one hundred seventy-three (173) feet east thereof along Flower Street, except the westerly one hundred twenty-eight (128) feet thereof.

6. One (1) hour parking zone on the south side of Flower Street between a point where said south side of Flower Street intersects with the east side of Orange Drive and a point one hundred fifty-four (154) feet east thereof along Flower Street, except the westerly one hundred twenty-five (125) feet thereof.

7. One (1) hour parking zone on the south side of Flower Street between a point where said south side of Flower Street intersects with the east side of Palm Drive and a point sixty-three (63) feet east thereof along Flower Street, except the westerly twenty-seven (27) feet thereof.

8. No-parking zone on the south side of the frontage road north of Alfred Harrell Highway in Section 10, T29S, R28E, MDB&M, between a point where said south side of the frontage road intersects with the north side of Alfred Harrell Highway and a point two thousand fifty (2,050) feet east thereof, along the frontage road.

9. No-parking zone in that certain alley between Shasta and Yosemite Drives extending from El Tejon Avenue to the north for three hundred sixty-five (365) feet, more particularly located in Block No. 2 of the Homecrest Subdivision as per map of said subdivision recorded March 16, 1926, in Book 3, Page 153 of Maps in the office of the county recorder of the county.

10. No-parking zone on the west side of Fairfax Road, where said west side of the Fairfax Road intersects the south side of Center Street, thence one hundred two (102) feet south thereof, along Fairfax Road.

11. No-parking zone on the south side of Niles Point, where said south side of Niles Point intersects the south side of Niles Street, thence one hundred eighty (180) feet west thereof, along Niles Point.

12. No-parking zone on the west side of Union Avenue where said west side of Union Avenue intersects the north side of White Lane, thence one hundred eighty-four (184) feet north thereof, along Union Avenue.

13. No-parking zone on the southwest side of Frontage Road located north of Golden State Avenue (State Highway 204) and northwest of F Street thence nine hundred (900) feet to the northwest thereof, along the Frontage Road.

14. No-parking zone on the north side of Columbus Street where said north side of Columbus Street intersects the west side of River Boulevard, thence three hundred seventy (370) feet east thereof along Columbus Street.

15. No-parking zone on the east side of Hughes Lane from the south gutter line of Taft Highway to one hundred thirty-five (135) feet south of Holladay Avenue.

16. No-parking zone beginning at a point sixty-six (66) feet north of east-west section line along Roberts Lane, thence northerly along the east side of Airport Drive, a distance of one hundred eight (108) feet.

17. No-parking zone on Brundage Lane from the east gutter line of Wible Road, thence easterly along the south side of Brundage Lane to the west gutter line of Olive Street.

18. Fifteen (15) minute parking zone for passenger loading and unloading only, on the north side of Niles Street beginning at a point one hundred seventy (170) feet east of the Niles Street curb return at the intersection of Orange Drive then easterly a distance of thirty-six (36) feet.

19. No-parking zone beginning at the north curb return on the northwest corner of North Chester Avenue intersection with Douglas Street, thence northerly along the west curblines a distance of fifty (50) feet.

20. No-parking zone on the north side of Sundale Avenue beginning at a point one hundred thirty-four (134) feet west of the westerly curbline of Thunderbird Avenue extended thence westerly a distance of sixty (60) feet.

21. No-parking zone on the west side of Wible Road where said west side of Wible Road intersects the extended centerline of Terrace Way, thence three thousand three hundred thirty (3,330) feet south thereof along Wible Road.

22. No-parking zone on the east side of Wible Road where said east side of Wible Road intersects the south side of Terrace Way, thence four hundred forty-two (442) feet south thereof along Wible Road.

24. No-parking zone along the west side of Mt. Vernon Avenue at Flower Street beginning at the Mt. Vernon Avenue curb return in the northwest quadrant of the intersection, thence northerly, a distance of ninety (90) feet.

25. No-parking zone along the north side of Flower Street at Mt. Vernon Avenue beginning at the Flower Street curb return in the northwest quadrant of the intersection, thence westerly a distance of sixty-five (65) feet.

26. No-parking zone along the north side of Flower Street, beginning at a point eighty (80) feet east of the extension of the east gutter of West Drive, thence easterly a distance of seventy (70) feet.

27. No-parking zone along the north side of Flower Street at Virginia Street beginning at the Flower Street curb return in the northeast quadrant, thence easterly a distance of sixty (60) feet.

28. No-parking zone along the north side of Texas Street between Union Avenue and Liggett Street.

29. No-parking zone on the south side of Pico Avenue beginning at the southwest curb return at its intersection of Oswell Street thence westerly a distance of one hundred thirty-five (135) feet.

30. No-parking zone on the north side Pico Avenue beginning at the northwest curb return at its intersection with Oswell Street thence westerly a distance of one hundred eighty-eight (188) feet.

31. No-parking zone on the south side of Foothill Road beginning at a point five hundred sixty (560) feet east of the east gutter line of Park Drive, thence easterly to Morning Drive.

32. No-parking zone on the east side of Park Drive between Pioneer Drive and Foothill Road.

33. No-parking zone on both the east and west sides of Haley Street between Cunha Street and Water Street.

34. No-parking zones during the period between September 15th and October 15th, inclusive, of each and every year commencing with September 15, 1988, at the following locations:

a. No-parking zone on the south side of Amador Avenue beginning at the west curbline of Dawn Street, thence easterly to the west curbline of South Union Avenue,

b. No-parking zone on the north side of Ming Avenue beginning at the northwest curb return on South Union Avenue, thence westerly for a distance of two thousand one hundred forty (2,140) feet,

c. No-parking zone on the west side of South Union Avenue beginning at the northwest curb return of Ming Avenue, thence northerly to the south flowline of Amador Avenue,

35. No-parking zone beginning at a point located three hundred five (305) feet south of the southeast curb return of Oak Street at the intersection of Verde Street, thence southerly along the east curbline of Oak Street, a distance of eighteen (18) feet.

36. No-parking zone on the east side of Mt. Vernon Avenue between Kentucky Street and Lake Street.

37. No person may stand or park a vehicle for the purpose of offering or displaying for sale, rent or lease or displaying a sign or markings indicating that the vehicle is for sale, rent or lease, within the following unincorporated areas of the county:
