10.44.010 - Purpose.¶
It is the purpose of this chapter to use the power conferred upon local agencies by Section 21100(k) of the California Vehicle Code to regulate cruising.

10.44.020 - Posting of no cruising zones.¶
A. The provisions of this chapter may be enforced on any public street or highway which has been posted as a no cruising zone.
B. No cruising zone signs shall be posted at the beginning and end of any public street which is a no cruising zone, and all major intersections within the no cruising zone. The sign shall reference California Vehicle Code Section 2110(k) and this chapter and shall conform to the uniform standards for signing set forth in Sections 21400 et seq. of the Vehicle Code.

10.44.030 - Cruising prohibited.¶
A. Cruising is prohibited on the county roads within the Kern River County Park which are identified by no cruising signs which comply with Section 10.44.020 of this chapter.
B. No person shall be guilty of cruising unless that person:
Has been issued written notice by any peace officer that further driving past the traffic control point in traffic which is congested, at or near such traffic control point, as determined by the highest ranking peace officer on duty within the affected area, shall be a violation of this chapter, and has been observed driving past the control point on a subsequent occasion within the time period set forth in Section 10.44.040 of this chapter.
The written notice shall be in bold and legible type upon a card not smaller than four (4) inches by six (6) inches and shall be handed to the person being warned. The card shall state the prohibition set forth in this section and the definition of cruising as set forth in this chapter and California Vehicle Code Section 21100(k).
C. Violation of this section is an infraction. Any person who violates this section is also subject to an administrative penalty under Chapter 8.54 of this Code.

10.44.040 - Penalty.¶
Any person who, after having received a written notice as described in Section 10.44.030(B), subsequently drives past the same control point within a three (3) hour period shall be guilty of a violation of this chapter. The minimum fine for a first conviction shall be one hundred dollars ($100.00); the minimum fine for a second conviction within one (1) year shall be two hundred dollars ($200.00); and the minimum fine for a third or subsequent conviction within one (1) year shall be two hundred fifty dollars ($250.00).

10.44.050 - Exemptions.¶
This chapter shall not apply to the following vehicles:
Emergency vehicles;
Administrative vehicles; and
Other business vehicles being driven for business purposes.
