10.50.010 - Authority.

This chapter is enacted pursuant to Section 40200 et seq. of the California Vehicle Code. Section 40203.5(a) states:

"The schedule of parking penalties for parking violations, late payment penalties, administrative fees, and other related charges for parking violations shall be established by the governing body of the jurisdiction where the notice of violation is issued." Such penalties are established pursuant to the following schedule which may be amended by resolution of the board of supervisors of the county of Kern.

10.50.020 - Schedule of parking penalties.

Parking penalties for violations referred to herein do not include late payment penalties, administrative fees, or other related charges. The County of Kern adopts the following schedule of parking penalties, which shall be controlling over any prior parking penalty in this Code:

* Five dollars ($5.00) additional penalty is imposed on all parking violations pursuant to Government Code Section 76000(b).

** Ten percent (10%) additional penalty assessed on specified handicapped parking penalties pursuant to Penal Code Section 1465.6.

*** Proof of correction or compliance: If proof is not presented, the indicated penalty is required. When the citation indicates that it is issued in accordance with Vehicle Code Section 40610(b) and proof of correction is submitted within the time limitation specified in the citation, the violation shall be dismissed upon payment of a ten dollar ($10.00) fee, as provided in Vehicle Code Section 405222.

**** The two specified portions of Cuddy Valley Road are as follows: (1) along the north side of Cuddy Valley Road beginning four thousand eight hundred twenty-five (4,825) feet west of the centerline of Lockwood Valley Road, thence westerly for a distance of one thousand (1,000) feet and (2) along the north side of Cuddy Valley Road beginning seven thousand four hundred (7,400) feet west of the centerline of Lockwood Valley Road, thence westerly for a distance of seven hundred fifty (750) feet.

10.50.030 - Late fees—Returned check fees.

A. The fine for any returned check written to pay any penalty provided for in this chapter shall be twelve dollars ($12.00), which fine shall be added to any amount owed.

B. Failure to pay any penalty by the date specified in the citation will result in a notice of delinquency. A twenty-five dollar ($25.00) fine shall be added to any penalty payment received after the date for payment specified on any notice of delinquency.

10.50.040 - Operative date of chapter.

Chapter 10.50 of the Kern County Ordinance Code shall be operative July 1, 1993.
