§ 2.16.010 PUBLIC LIBRARY ESTABLISHED.

The Council does establish, and provide for, the regulation and maintenance of a public library in the city and adopts therefor the provisions of an act of the state legislature entitled the Municipal Libraries Act, being Cal. Education Code §§ 18900 et seq., and the acts amendatory thereof.

§ 2.16.020 LIBRARY BOARD; APPOINTMENT; TERM.

The public library shall be managed by a Board of Library Trustees, consisting of five members, who shall be appointed by direct appointment by the City Council. The Board of Library Trustees shall severally hold office for three years, serving without compensation. Men and women shall be equally eligible to such appointment, and vacancies that may occur in said Board shall be filled by appointment as provided to fill out the unexpired term. Appointments shall occur according to the city’s recruitment and appointment schedule for new commission/committee members. Term limits shall be two full consecutive three-year terms.

§ 2.16.030 LIBRARY BOARD; MEETINGS.

The Board of Library Trustees shall meet at least once a month, at such times and places as they may fix by resolution. Special meetings may be called at any time by three Trustees at least 24 hours before the time specified for the proposed meeting. A majority of the Board shall constitute a quorum for the transaction of business. It shall appoint one member thereof President, who shall serve for one year and until his or her successor is appointed. It shall cause a proper record of all its proceedings to be kept.

§ 2.16.040 LIBRARY BOARD; ATTORNEY.

The City Attorney shall be attorney for the Library Board. When required, he or she shall attend their meetings and shall perform such other services for the Board as may be necessary.

§ 2.16.050 LIBRARY BOARD; POWERS.

The Board of Trustees shall have the general control of the Library, its property and funds; hire a qualified Library Director for the Library and select his or her compensation; pass the necessary rules and regulations for the government of the library affairs; and perform such other acts and have such other powers as are or may be given by the ordinances of the city and the general laws of the state.

§ 2.16.060 LIBRARY BOARD; ANNUAL REPORT.

The Board of Library Trustees shall, on or before the last day of August of each year, make a report to the Council, giving the condition of the Library on the June 30 preceding, together with a statement of their proceedings for the year then ended, and must, immediately upon publication of such report, forward a copy thereof, for filing to the State Library at Sacramento.

§ 2.16.070 RESERVED.

§ 2.16.080 LIBRARY FUND.

The revenue derived from the tax, together with all moneys acquired for the purposes of the library by gift, devise, bequest or otherwise shall be apportioned to a fund to be designated the “Library Fund” and shall be applied only to the purposes herein authorized. Payments from the Fund shall be made in the same manner as provided for the payment of other demands against the city; provided that all demands on such Fund shall be first presented to the Board of Library Trustees and approved by it, before being ordered paid by the Council.

§ 2.16.090 FREE PUBLIC LIBRARY.

The library shall be and forever remain free to the inhabitants and nonresident tax payers of the city, subject to the rules and regulations of the Board of Library Trustees, provided that the Board may contract for the lending of books therefrom to other persons, under such regulations as by law permitted.

§ 2.16.100 CITY TO RETAIN TITLE TO LIBRARY PROPERTY.

The title to all property acquired for the library shall be and remain in the city, when not inconsistent with the terms of its acquisition.
