§ 2.04.010 PLACE OF MEETINGS.

The meetings of the City Council shall be held in the Council Chambers of the City Hall, located at the northwest corner of Commonwealth and Highland Avenues in the city.

§ 2.04.020 TIME OF MEETINGS.

The Council shall hold regular meetings at least once in each month at such times as it shall from time-to-time fix by resolution.

§ 2.04.030 SALARY.

Each member of the Council shall be paid a salary of $650 per month for serving on the Council until the beginning of a new term of office by any incumbent or newly elected member of the Council following the 2006 municipal election. Commencing at the beginning of any such new term of office, each of the five members of the Council shall be paid a salary of $750 per month for serving on the Council.

§ 2.04.040 RULES OF PROCEDURE.

(A) That certain document entitled “Robert’s Rules of Order,” Newly Revised Edition, one copy of which is on file in the office of the City Clerk, is adopted by reference, in accordance with Cal. Gov’t Code § 50022.2, as a part of this chapter and shall govern the actions and proceedings of the City Council in all of its legislative, administrative and other functions.

(B) Additional rules not in conflict with or a duplicate of the general laws of the state may be adopted by resolution.

(C) A tie vote of the Council on any matter under consideration constitutes denial of the request.

§ 2.04.050 TERM LIMITS.

(A) Any person who shall have served three successive four-year terms as a member of the City Council shall be ineligible to serve again in the office until an intervening period of four years has elapsed.

(B) The term limits imposed by this section shall apply prospectively only to those terms of office that commence after November 2, 2010, the date this section was adopted by the voters.

§ 2.04.060 BY-DISTRICT ELECTION OF COUNCIL MEMBERS.

(A) Officers. The elective officers of the city shall constitute a Council consisting of five members elected by district at the times and in the manner provided in this chapter, in a sequence to be determined by ordinance or resolution, each of whom shall serve for a term of four years and until their respective successors qualify.

(B) Council districts. The city is hereby divided into five Council districts. The five districts shall be as described in § 2.04.070. Candidates for Council seats shall be nominated and elected by such district and shall be residents of such district.

(C) Changes in boundaries of Council Districts. The boundaries of said Council Districts, but not the number thereof, may be changed by ordinance adopted by the Council by a three-fifths vote of all its members; provided, that districts established by the Council shall be as nearly equal in population and as geographically compact as practical. Boundaries shall be evaluated within at least one year subsequent to the availability of the information from each decennial United States census or on another basis adopted by three-fifths vote of the total membership of the Council, and as provided in Cal. Elections Code §§ 21601 et seq. However, the Council shall not change the boundaries of districts more than once in any two-year period and no such change shall be made within the period of 180 days preceding a general municipal election. The preceding limitations shall not apply to changes made necessary by changes to the city boundaries. After the Council has exercised its power to change the boundaries of districts, these changes shall immediately be reflected in the district boundaries specified by ordinance adopted by the Council.

(D) Residency in districts. Each member of the Council must also be a resident of the Council district from which the member is nominated at the time the member is nominated and elected. In the event any member of the Council shall cease to be a resident of the district from which the member (or, in the case of an appointee, a predecessor) was nominated, the office shall immediately become vacant and shall be filled in the same manner as herein provided for other vacancies and as provided in § 2.02.020. If a member of the Council ceases to be a resident of the district from which the member (or, in the case of an appointee, a predecessor) was nominated solely because of a change in the boundaries of any district as in this code provided, the member shall not lose office during that term by reason of such change.

(E) Current office holders. The five members of the City Council in office at the time this section takes effect shall continue in office until their terms expire.

§ 2.04.070 DISTRICT BOUNDARIES.

(A) The Council member districts of the city shall have the following legal boundaries.

(1) First District. The region bounded and described as follows: Beginning at the point of intersection of N. Euclid St. and City Boundary, and proceeding southerly along N. (B) These district boundaries are depicted on a boundary map attached to the ordinance codified herein as Exhibit A. These boundaries will remain in effect until amended by ordinance as provided in § 2.04.060.

(C) Nothing herein shall affect the terms of office of the five members of the City Council in office at the time this section takes effect, who shall continue in office until their terms expire.
