10.36.010 - Definitions.

For the purpose of this chapter, the following words and phrases shall have the meanings respectively ascribed to them by this section:

A. "Parking meter" means any mechanical device which, when the mechanism thereof is set in motion, indicates unexpired parking time for the vehicle parked adjacent thereto.

B. "Parking meter space" means a parking space of sufficient size to permit the parking of one vehicle only adjacent to a parking meter within a parking meter zone.

10.36.020 - Designation of parking meter zones.

All streets or portions of streets within the city which are now zoned for business or industry under Title 17 of this code and any other streets, portions of streets or city-owned or leased land as are designated from time to time by the city council as parking meter zones, are declared to be parking meter zones. All streets within one block of any street zoned for business are also declared to be parking meter zones in the event parking meters are established, as provided in this chapter, along the curb adjacent to any parking spaces in such zones.

10.36.030 - Location and parking time—Council authority.

The city council may, by resolution, specify the streets or portions of streets within parking meter zones wherein parking meters shall be installed, together with the maximum parking time limit thereon. The city manager is authorized and directed to install or direct the installation of parking meters in such parking meter zones as so directed by city council for the purpose, and in such numbers and at such places as may be necessary for the regulation, control and inspection of the parking of vehicles therein, including the reservation of loading zones for commercial vehicles.

10.36.040 - Duty of city manager to install—Required design.

The city manager shall cause to be installed adjacent to each designated parking meter space such parking meter as shall have been approved by the city council. Each such meter shall be so designed that the deposit of a coin will set the mechanism of the meter in motion, so that the meter will show the unexpired parking time applicable to the parking meter space adjacent to the meter, and such meter when the parking time has expired shall so indicate by a visible sign.

10.36.050 - Depositing coins—Generally.

No person shall park any vehicle in any parking space, except as otherwise provided by this chapter without immediately depositing in the parking meter adjacent to such space such lawful coins of the United States as are required by such meter and as designated by directions on the meter; and when required by the directions on the meter, setting in operation the timing mechanism thereof in accordance with such directions, unless such parking meter indicates at the time such vehicle is parked that an unexpired portion remains of the period for which a coin has been previously deposited.

10.36.060 - Depositing coins—Rate.

The rates adjustments for parking meters shall be set by resolution of the city council.

10.36.070 - Depositing coins—Slugs prohibited.

No person shall deposit or cause to be deposited in any parking meter any slug device or metallic substitute for any lawful coin of the United States.

10.36.080 - Injuring or defacing.

No unauthorized person shall operate, nor any person deface, injure, tamper with or wilfully break, destroy or impair the usefulness of any parking meter installed pursuant to this chapter, or hitch any animals thereto, or lean any bicycle against any parking meter.

10.36.090 - Parking overtime in metered spaces.

No person shall cause, allow, permit or suffer any vehicle registered in his name or operated or controlled by him to be upon any street within a parking meter zone in any space adjacent to which a parking meter is installed, for more than the maximum parking time limit fixed and established by resolution of the city council and indicated in the parking meter space, or any time during which the meter is showing a signal indicating such space is illegally in use, other than such time as it is necessary to operate the meter to show legal parking, between the hours of eight a.m. and six p.m. on any days; except, that such parking limitations shall not be operative on any Sunday or holiday.

Each hour of continued parking during which the meter is showing a signal indicating that such space is illegally in use shall constitute a separate offense and shall be punishable as such.

10.36.100 - Mechanical failure of meter.

Any person unintentionally violating any provision of this chapter by reason of a mechanical failure of a parking meter not caused by such person, may be acquitted of such violation upon establishing such facts by a preponderance of the evidence.

10.36.110 - Enforcement.

A. It shall be the duty of the police department to enforce the provisions of this chapter.

B. It shall be the duty of each police officer to keep an account of and report the number of each parking meter which indicates that the vehicle occupying the parking space adjacent to such parking meter is or has been parked in violation of the provisions of this chapter, the date and hour of such violation, the make and license number of such vehicle, and any other facts, a knowledge of which is necessary to a thorough understanding of the circumstances attending such violations.

C. He shall issue and attach, in writing, a citation for illegal parking in the same form and subject to the same procedure provided by this code and other ordinances of the city and the laws of the state applicable to traffic regulations within the city.

10.36.120 - Collection of money from meters.

It shall be the duty of the city council to designate some person to make regular collections of the money deposited in parking meters and to deliver such money to the city treasurer. It shall be the duty of the city treasurer to count the money and place the same in the general fund. Such person making such collections shall be bonded in the sum of one thousand dollars to insure the faithful performance of his duties.

10.36.130 - Disposition of money collected from meters.

The amount of the coins required to be deposited in parking meters as provided in this chapter is levied and assessed as a fee to provide for the proper regulation, control and inspection of traffic upon the public streets, and to cover the cost of supervising, regulating, and inspecting the parking of vehicles in the parking meter zones provided for this chapter, the cost of placing and maintaining the lines or markings designating parking spaces in parking meter zones and the cost of the rent, purchase, supervision, protection, inspection, installation, operation, maintenance, control and use of the parking meters installed under the provisions of this chapter.
