10.26.010 - Purpose.

This chapter is enacted to exercise the local options authorized by California Vehicle Code Section 35401.5(d).

10.26.020 - Designation of routes.

A. Upon receipt of a written application by a terminal operator or upon his own initiative, the director of public works is authorized to designate a route between an interstate highway and a terminal as an interstate truck terminal route.

B. For the purpose of this chapter, "interstate highway" means a portion of the national system of interstate and defense highways, or of any federal-aid primary highway qualified by the United States Secretary of Transportation for such use, including, but not limited to, Interstate 1-280, State Routes 1, 35 and 82.

C. "Terminal" means a facility at which freight is consolidated to be shipped and where full load consignments may be off-loaded, or at which combinations of vehicles consisting of a truck tractor and semitrailer, or of a truck tractor, semitrailer, and trailer, are regularly maintained, stored or manufactured.

10.26.030 - Written application—Contents.

If a route is requested by a written application, the application shall include:

A. Name, address and business title of the applicant;

B. Location of the terminal by street address or other appropriate description;

C. Preferred route, listing street names and intersections;

D. Alternate route, if appropriate;

E. Statement that terminal provides facility for consolidation of freight to be shipped, or loading and off-loading of full load consignments, or maintenance, service or manufacture of interstate trucks;

F. Statement that terminal parking and terminal entries are adequate for interstate trucks; and

G. Statement of other considerations that applicant believes needs resolution, such as potential problems of street width or intersection arrangements.

10.26.040 - Application and route review.

A. The director of public works shall review written applications to determine if a route may be designated which meets local concerns, including adequacy of road geometrics and public safety.

B. Whenever the director of public works determines that a proposed route is satisfactory, the route designation shall be forwarded to the city council. The city council shall adopt the designation by resolution, or deny the same.

C. If the route proposed in an application is determined by the director of public works to be unsatisfactory, a written notice of denial shall be sent by the director of public works to the applicant. The notice shall identify the reason(s) for denial and possible means, if any, whereby the objectionable features can be remedied.

10.26.050 - Revocation.

If the director of public works determines that a previously designated route is unsatisfactory, either due to error in the original designation or to changes in conditions, he shall send a written notice of revocation to the applicant. The notice shall identify the reason(s) for revocation, and possible means, if any, whereby the objectionable features can be remedied.

10.26.060 - Appeal.

In the event of the denial or revocation of a route designation by the director of public works, the applicant or aggrieved terminal operator may appeal to the city council for reconsideration. The city council reserves the right to reverse a decision of the director of public works and to approve the designation of a route as an interstate truck terminal route.

10.26.070 - Costs.

A. The city council may establish fees by resolution in connection with any application by an applicant or terminal operator for a route designation.

B. The director of public works shall consider on a case-by-case basis any proposal by an applicant to contribute funds to bring an unsatisfactory route up to acceptable standards by means of repair or construction.
