    SECTION 302—MIXED OCCUPANCY BUILDINGS

    302.1 Mixed occupancy buildings. In mixed occupancy buildings, each portion of a building shall comply with the specific green building measures applicable to each specific occupancy.

    EFFECTIVE USE OF THIS CODE

    The format of this code is common to other parts of the California Building Standards Code and contains building standards applicable to occupancies which fall under the authority of different state agencies. Occupancies and applications under the authority of a specific state agency are identified in Chapter 1, Sections 103 through 106. Sections of this code which are applicable and adopted by each state agency are identified in the Matrix Adoption Tables located at the beginning of each chapter. The following outline is provided as a guide to establish which provisions are applicable to a specific occupancy.

    1. Establish the type of occupancy.

    2. Verify which state agency has authority for the established occupancy by reviewing the authorities list in Sections 103 through

    3. Once the appropriate agency has been identified, find the chapter which covers the established occupancy.

    4. The Matrix Adoption Tables at the beginning of Chapters 4 and 5 identify the required green building measures necessary to meet the minimum requirements of this code for the established occupancy.

    5. Voluntary tier measures are contained in Appendix Chapters A4 and A5. A Checklist containing each green building measure, both required and voluntary is provided at the end of each appendix chapter. Each measure listed in the application checklist has a section number which correlates to a section where more information about the specific measure is available.

    6. The Application Checklist identifies which measures are required by this code and allows users to check-off which voluntary items have been selected to meet voluntary tier levels if desired or mandated by a city, county, or city and county.

What exactly becomes mandatory when a city adopts a voluntary tier?

When a city formally adopts an appendix tier by ordinance (adopt-by-reference), the measures listed in that tier (prerequisites and the elected electives required to meet the Tier threshold) become locally mandatory and are enforced by the local enforcing agency § 304.1.1 .

Can a jurisdiction adopt only part of an appendix or only some Tier measures?

Yes. The appendices and matrix guidance show options for adopting entire chapters or listed sections; jurisdictions commonly adopt whole appendices or selectively adopt sections, but any local amendment should follow the local amendment procedures referenced in § 101.7 and be clearly documented in the ordinance or resolution (sample language provided in the appendices) .

Who may grant exceptions if a project cannot meet a Tier threshold?

The local enforcing agency may grant a modification for an individual case after finding that strict compliance is impractical and that the modification aligns with the intent of the measure; the agency must record the details of any modification § 304.1.1 .

Are there verification checklists to help plan check staff and applicants?

Yes — Appendix A5 contains verification checklists (A5.602 series for nonresidential; A4 has similar checklists for residential). These checklists are intended to be used when a jurisdiction adopts tiers to standardize documentation and enforcement .

Do state agencies enforce the local adoption?

No — state enforcement does not automatically follow. When a local government adopts tiers, the local enforcing agency enforces the adopted measures locally. Some state agencies have their own adoption matrices or applicability; check the matrix tables and agency notes in the appendices for occupancy-specific adoption rules .
