Mixed occupancy buildings (Section 302)
Section 302 requires each portion of a mixed-occupancy building to comply with the green measures for that specific occupancy, with limited exceptions.

Overview
CALGreen Section 302 sets the scoping rule for mixed-occupancy buildings: each portion of a building must comply with the specific green building measures that apply to that occupancy (see §302.1) . That means residential portions follow the residential mandatory measures in Chapter 4, while nonresidential portions follow the nonresidential mandatory measures in Chapter 5 (and any applicable voluntary provisions and appendices) .
The section also lists targeted exceptions and related scoping rules — for example, accessory structures serving residential buildings and live/work units (those complying with CBC §508.5) are carved out to follow Chapter 4 and Appendix A4 as applicable, rather than being treated as mixed occupancies . For phased or shell projects, see the companion scoping in Section 303 on phased projects to determine which measures apply at the time of construction .

SECTION 302—MIXED OCCUPANCY BUILDINGS
302.1 Mixed occupancy buildings. In mixed occupancy buildings, each portion of a building shall comply with the specific green building measures applicable to each specific occupancy.
Exceptions:
- [HCD] Accessory structures and accessory occupancies serving residential buildings shall comply with Chapter 4 and Appendix A4, as applicable.
- [HCD] For the purposes of CALGreen, live/work units, complying with Section 508.5 of the California Building Code, shall not be considered mixed occupancies. Live/work units shall comply with Chapter 4 and Appendix A4, as applicable.
SECTION 303—PHASED PROJECTS
303.1 Phased projects. For shell buildings and others constructed for future tenant improvements, only those code measures relevant to the building components and systems considered to be new construction (or newly constructed) shall apply.
303.1.1 Initial tenant improvements. The provisions of this code shall apply only to the initial tenant improvements to a project. Subsequent tenant improvements shall comply with the scoping provisions in Section 301.3 nonresidential additions and alterations.
SECTION 304—VOLUNTARY TIERS
304.1 Purpose. Voluntary tiers are intended to further encourage building practices that improve public health, safety and general welfare by promoting the use of building concepts which minimize the building’s impact on the environment and promote a more sustainable design.
304.1.1 Tiers. The provisions of Divisions A4.6 and A5.6 outline means, in the form of voluntary tiers, for achieving enhanced construction levels by incorporating additional measures for residential and nonresidential new construction. Voluntary tiers may be adopted by local governments and, when adopted, enforced by local enforcing agencies. Buildings complying with tiers specified for each occupancy contain additional prerequisite and elective green building measures necessary to meet the threshold of each tier. See Section 101.7 of this code for procedures and requirements related to local amendments, additions or deletions, including changes to energy standards.
[BSC & HCD] Where there are practical difficulties involved in complying with the threshold levels of a tier, the enforcing agency may grant modifications for individual cases. The enforcing agency shall first find that a special individual reason makes the strict letter of the tier impractical and that modification is in conformance with the intent and purpose of the measure. The details of any action granting modification shall be recorded and entered in the files of the enforcing agency.
SECTION 305 [OSHPD 1]— CALGreen TIER 1 AND CALGreen TIER 2
305.1 CALGreen Tier 1 and CALGreen Tier 2 buildings contain voluntary green building measures necessary to meet the threshold of each level.

301.3.2 Waste diversion. The requirements of Section 5.408 shall be required for additions and alterations whenever a permit is required for work.
301.4 Mandatory measures for public schools and community colleges. [DSA-SS] New building construction and site work on a new or existing site shall comply with Section 301.4.
301.4.1 Building and site construction on a new site shall comply with Chapter 5 as adopted by DSA-SS.
301.4.2 Work on an existing site shall comply with Section 301.4.2.
301.4.2.1 Newly constructed site work shall comply with Chapter 5 as adopted by DSA-SS.

SECTION 302 A —GENERAL PROVISIONS
302 A .1 Dangerous conditions. The code official shall have the authority to require the elimination of conditions deemed dangerous.
302 A .2 Additional codes. Alterations, repairs, additions and changes of occupancy to, or relocation of, existing buildings and struc- tures shall comply with the provisions for alterations, repairs, additions and changes of occupancy or relocation, respectively, in the California Fire Code, California Mechanical Code, California Plumbing Code and California Electrical Code. Where provisions of the other codes conflict with provisions of this chapter, the provisions of this chapter shall take precedence.
302 A .2.1 Additional codes in health care. In existing Group I-2 occupancies, ambulatory health care facilities, outpatient clinics and hyperbaric facilities, alterations, repairs, additions and changes of occupancy to, or relocation of, existing buildings and structures shall also comply with NFPA 99.
302 A .3 Existing materials and equipment. Materials and equipment already in use in a building in compliance with requirements or approvals in effect at the time of their erection or installation shall be permitted to remain in use unless determined by the code official to be unsafe in accordance with California Building Code Section 116.

PROVISIONS FOR ALL COMPLIANCE METHODS
302A.3.1 Existing seismic force-resisting systems. Where the existing seismic force-resisting system is a type that can be designated ordinary or is a welded steel moment frame constructed under a permit issued prior to October 25, 1994, values of R, W0 and Cd for the existing seismic force-resisting system shall be those specified by the California Building Code for an ordinary system unless it is demonstrated that the existing system will provide performance equivalent to that of a detailed, intermediate or special system.
302 A .4 New and replacement materials. Except as otherwise required or permitted by this code, materials and equipment permitted by the applicable code for new construction shall be used. Like materials shall be permitted for repairs and alterations, provided no hazard to life, health or property is c reated. Hazardous materials shall not be used where the code for new construction would not permit their use in buildings of similar occupancy, purpose and location.
302 A .4.1 New structural members and connections. New structural members and connections shall comply with the detailing provisions of the California Building Code for new buildings of similar structure, purpose and location.
Exception: Where alternative design criteria are specifically permitted.
302 A .5 Occupancy and use. Where determining the appropriate application of the referenced sections of this code, the occupancy and use of a building shall be determined in accordance with Chapter 3 of the California Building Code .
CALGreen § 1.5.3 Medium relevance — show source text
Where approved by the building official, the classification of buildings and other structures as Risk Category III or IV based on their quantities of toxic, highly toxic or explosive
materials is permitted to be reduced to Risk Category II, provided that it can be demonstrated by a hazard assessment in accordance with Section 1.5.3 of ASCE 7 that a
release of the toxic, highly toxic or explosive materials is not sufficient to pose a threat to the public.|a. For purposes of occupant load calculation, occupancies required by Table 1004.5 to use gross floor area calculations shall be permitted to use net floor areas to determine the
total occupant load. The floor area for vehicular drive aisles shall be permitted to be excluded in the determination of net floor area in parking garages.
b. Where approved by the building official, the classification of buildings and other structures as Risk Category III or IV based on their quantities of toxic, highly toxic or explosive

STRUCTURAL DESIGN
1604 A .5.1 Multiple occupancies. Where a building or structure is occupied by two or more occupancies not included in the same risk category, it shall be assigned the classification of the highest risk category corresponding to the various occupancies. Where buildings or structures have two or more portions that are structurally separated, each portion shall be separately classified. Where a separated portion of a building or structure provides required access to, required egress from or shares life safety systems, designated seismic systems, emergency power systems, or emergency and egress lighting systems with another portion having a higher risk category, or provides required electrical, communications, mechanical, plumbing or conveying support to another portion assigned to Risk Category IV, both portions shall be assigned to the higher risk category. Exception: Where a storm shelter designed and constructed in accordance with ICC 500 is provided in a building, structure or portion thereof normally occupied for other purposes, the risk category for the normal occupancy of the building shall apply unless the storm shelter is a designated emergency shelter in accordance with Table 1604 A .5. 1604 A .5.2 Photovoltaic (PV) panel systems. Photovoltaic (PV) panel systems and elevated PV support structures shall be assigned a risk category as follows:
- Ground-mounted PV panel systems serving only Group R-3 buildings shall be assigned to Risk Category I.
- Ground-mounted PV panel systems other than those described in Items 1 and 5 shall be assigned to Risk Category II.
- Elevated PV support structures other than those described in Items 4, 5 and 6 shall be assigned to Risk Category II.
[DSA-SS] The risk category shall not be less than the risk category that corresponds to the usable space underneath in accordance with the risk category and nature of occupancy descriptions in Table 1604A.5. 4. Rooftop-mounted PV panel systems and elevated PV support structures installed on top of buildings shall be assigned to the same risk category as the risk category of the building on which they are mounted. 5.

Chapter 5A Prescriptive Compliance Method.
Chapter 5A provides details for the prescriptive compliance method for alteration, addition and change of occupancy of existing build- ings and structures regulated by the Department of Health Care Access and Information/Office of Statewide Hospital Planning and Development, which include hospitals and correctional treatment centers (applications listed in Sections 1.10.1 (OSHPD 1).
Chapter 6 Classification of Work.
Chapter 6 provides an overview of the Work Area Method and defines the different classifications of work including alterations, change of occupancy, additions and historic buildings. Detailed requirements for all of these are given in subsequent Chapters 7 through 11.
Chapter 7 Alterations—Level 1.
Chapter 7 provides the technical requirements for those existing buildings that undergo Level 1 alterations as described in Section 602, which includes replacement or covering of existing materials, elements, equipment or fixtures using new materials for the same purpose. This chapter is distinguished from Chapters 8 and 9 by only involving replacement of building components with new components with no reconfiguration of space.
Chapter 8 Alterations—Level 2.
A Level 2 alteration is an alteration involving space reconfiguration that could be up to and including 50 percent of the area of the building or addition of a new building system. Level 2 alterations also include the extension or addition of any system or equipment. The purpose of Chapter 8 is to provide detailed requirements and provisions to identify the required improvements in the existing building elements, means of egress, fire protection, structural systems, energy efficiency, and other building systems include electrical, mechanical and plumbing when a building is being altered.
Chapter 9 Alterations—Level 3.
Chapter 9 provides the technical requirements for those existing buildings that undergo Level 3 alterations. Level 3 alterations are those involving alterations that cover 50 percent of the aggregate area of the building. Under certain situations, this chapter also intends to improve the safety of certain building features beyond the work area and in other parts of the building where no alteration work might be taking place.
Chapter 10 Change of Occupancy.
The purpose of Chapter 10 is to address existing buildings that are subject to a change of occupancy. This chapter is an assembly of requirements to upgrade safety without having to comply fully as a new building. A change of occupancy classification is considered a change of occupancy, however, it will involve a higher level of regulation since the use of the building has made a more significant change.

Chapter 11 Additions.
Chapter 11 provides the requirements for additions, which are considered new construction. The requirements focus on safely integrating the addition with the existing building. This includes issues such as limiting the overall height and area of the building where the addition is not separated by a fire wall.
Chapter 12 Historic Buildings —Reserved
Chapter 12 is not adopted by the State of California. Historic buildings and structures shall comply with Part 8, Title 24, California Code of Regulations.
Chapter 13 Performance Compliance Methods.
Chapter 13 allows for existing buildings to be evaluated to show that alterations or a change of occupancy, while not meeting new construction requirements, will provide a level of safety to demonstrate compliance. Provisions are based on a numerical scoring system involving 21 safety parameters where, when evaluated, such buildings must meet a minimum overall safety score.
CALGreen § 150.2 Medium relevance — show source text
For alterations that change the occupancy classification of the building, the requirements specified in Section 150.2 apply to the occupancy after the alterations. C. Multifamily buildings. Section 180.0 applies to new construction in existing multifamily buildings. New construction in existing buildings includes additions, alterations and repairs. Section 180.0 specifies requirements that uniquely apply to additions, alterations or repairs to existing buildings, and specifies which requirements in other sections also apply. For alterations that change the occupancy classification of the building, the requirements specified in Section 180.0 apply to the occupancy after the alterations. 4. Installation of insulation in existing buildings. Section 110.8(d) applies to buildings in which insulation is being installed in existing attics, or on existing water heaters or existing space conditioning ducts. 5. Outdoor lighting. Sections 110.9, 130.0, 130.2, 130.4, 140.7, and 150.0 apply to newly constructed outdoor lighting systems, and Section 141.0 applies to outdoor lighting that is either added or altered. 6. Signs. Sections 130.0, 130.3 and 140.8 apply to newly constructed signs located either indoors or outdoors, and Section 141.0 applies to sign alterations located either indoors or outdoors.

ALL OCCUPANCIES—GENERAL PROVISIONS
(f) Mixed occupancy. When a building is designed and constructed for more than one type of occupancy (residential and nonresidential), the space for each occupancy shall meet the provisions of Part 6 applicable to that occupancy.
Exception 1 to Section 100.0(f): If one occupancy constitutes at least 80 percent of the conditioned floor area of the building, the entire building envelope, HVAC and water heating may be designed to comply with the provisions of Part 6 applicable to that occupancy, provided that the applicable lighting requirements in Sections 140.6 through 140.8, 150.0(k), or 160.5 and 170.2(e) are met for each occupancy and space, and mandatory measures in Sections 110.0 through 130.5, 150.0, and 160.0 through 160.9 are met for each occupancy and space.
Exception 2 to Section 100.0(f): If one occupancy constitutes at least 90 percent of the combined conditioned plus unconditioned floor area of the building, the entire building indoor lighting may be designed to comply with only the lighting provisions of Part 6 applicable to that occupancy.
(g) Administrative requirements. Administrative requirements relating to permit requirements, enforcement by the Commission, locally adopted energy standards, interpretations, claims of exemption, approved calculation methods, rights of appeal, and certification and labeling requirements of fenestration products and roofing products are specified in California Code of Regulations, Title 24, Part 1, Sections 10-101 to 10-114.
(h) Certification requirements for manufactured equipment, products and devices. Part 6 limits the installation of manufactured equipment, products and devices to those that have been certified as specified by Sections 110.0 and 110.1. Requirements for manufactured equipment, products, and devices, when not specified in Title 24 Part 6, are specified in California Code of Regulations, Title 20, Sections 1601–1609.

406.2.2 Clear height. The clear height of each floor level in vehicle and pedestrian traffic areas shall be not less than 7 feet (2134 mm). Canopies under which fuels are dispensed shall have a clear height in accordance with Section 406.7.2. [DSA-AC, HCD 1-AC] The clear height of vehicle and pedestrian areas required to be accessible shall comply with Chapter 11A or 11B, as applicable.
Exception: A lower clear height is permitted for a parking tier in mechanical-access open parking garages where approved by the building official.
[BE] 406.2.3 Accessible parking spaces. Where parking is provided, accessible parking spaces, access aisles and vehicular routes serving accessible parking shall be provided in accordance with Chapter 11A or Chapter 11B, as applicable.
406.2.4 Floor surfaces. Floor surfaces shall be of concrete or similar approved noncombustible and nonabsorbent materials. The area of floor used for the parking of automobiles or other vehicles shall be sloped to facilitate the movement of liquids to a drain or toward the main vehicle entry doorway. The surface of vehicle fueling pads in motor fuel-dispensing facilities shall be in accordance with Section 406.7.1.
Exceptions:
- Asphalt parking surfaces shall be permitted at ground level for public parking garages and private carports.
- Slip-resistant, nonabsorbent, interior floor finishes having a critical radiant flux not more than 0.45 W/cm [2], as determined by ASTM E648 or NFPA 253, shall be permitted in repair garages.
406.2.5 Sleeping rooms. Openings between a motor vehicle-related occupancy and a room used for sleeping purposes shall not be permitted.
406.2.6 Fuel dispensing. The dispensing of fuel shall only be permitted in motor fuel-dispensing facilities in accordance with Section 406.7.
406.2.7 Electric vehicle charging stations and systems. Where provided, electric vehicle charging systems shall be installed in accordance with the California Electrical Code and the California Green Building Standards Code . Electric vehicle charging system equipment shall be listed and labeled in accordance with UL 2202. Electric vehicle supply equipment shall be listed and labeled in accordance with UL 2594. Accessibility to electric vehicle charging stations shall be provided in accordance with Chapters 11A and/or 11B.
406.2.8 Mixed occupancies and uses. Mixed uses shall be allowed in the same building as public parking garages and repair garages in accordance with Section 508.1. Mixed uses in the same building as an open parking garage are subject to Sections 402.4.2.3, 406.5.11, 508.1, 510.3, 510.4 and 510.7.
406.2.9 Equipment and appliances. Equipment and appliances shall be installed in accordance with Sections 406.2.9.1 through 406.2.9.3 and the California Mechanical Code, California Plumbing Code and California Electrical Code.

Frequently asked questions
Which parts of CALGreen apply to each space in a mixed-occupancy building?
Each distinct occupancy portion must meet the green building measures for that occupancy — residential spaces follow Chapter 4 requirements, nonresidential spaces follow Chapter 5, and applicable appendices apply as noted in the chapters and matrices . This is the baseline rule established by §302.1 .
Are live/work units treated as mixed occupancies?
No. CALGreen expressly excludes live/work units that comply with CBC §508.5 from being treated as mixed occupancies; those units are to comply with Chapter 4 and Appendix A4 as applicable .
What if the building is a shell or will have future tenant improvements?
For shell buildings and phased projects, only the measures relevant to the new construction components being built now apply — see Section 303 for phased-project scoping and initial tenant-improvement guidance .
