How does CALGreen treat construction/demolition or land-clearing debris for phased projects?
If your project clears land, CALGreen (§ 5.408.3) requires that **all** trees, stumps, rocks, vegetation and soils be reused or recycled — and if your project is phased you can temporarily stockpile that material on site until a storage or reuse area is ready. For contaminated material (pests/disease) follow the County Agricultural Commissioner’s guidance.

What the code requires — 2–4 sentences
CALGreen requires 100 percent reuse or recycling of trees, stumps, rocks and associated vegetation and soils resulting primarily from land clearing — and, for a phased project, that material may be stockpiled on site until the storage site is developed. This requirement is set out in § 5.408.3 . Phased-project scoping (what pieces of the code apply to an initial shell or staged build) is explained in § 303.1 .
For land-clearing waste, CALGreen’s single most important rule is: reuse or recycle everything (trees, stumps, rocks, vegetation and soils) — and if the project is phased you may stockpile that material on-site until you have a developed storage or reuse location. § 5.408.3

How this fits with phased-project scoping
- Phased projects: only those code measures relevant to the building components/systems considered “new construction” apply to shell buildings and future tenant improvements — see § 303.1. That scoping allows § 5.408.3’s stockpiling allowance to be used in phased work when land clearing happens before later phases are developed. § 303.1 .
Verification & documentation
- Although § 5.408.3 establishes the reuse/recycle and stockpiling allowance, CALGreen’s general C&D requirements require documentation and a waste management plan where applicable; see § 5.408.1.4 (documentation) and the construction waste management plan requirements in § 5.408.1.1. Use those provisions when documenting how land-clearing material is being handled or stored. § 5.408.1.1 and § 5.408.1.4 .
Exceptions & special cases
- Contamination exception: Vegetation or soil contaminated by disease or pest infestation is excepted from the reuse/recycle requirement. The code explicitly allows reuse (on- or off-site) to be excluded for contaminated material. § 5.408.3 (Exception) .
- Regulatory coordination: if infestation is suspected you must contact the County Agricultural Commissioner and follow their direction for recycling or disposal; the code provides this as guidance in notes. § 5.408.3 (Notes) .
- Local ordinances and practical limits: if a local C&D ordinance is stricter, or if local markets/facilities don’t exist, other CALGreen exceptions (and local rules) may control — CALGreen’s broader C&D sections list excavated soil and land-clearing debris as an exception to some diversion calculations and allow alternative approaches where facilities don’t exist. § 5.408.1 (exceptions) .

Common mistakes
- Treating land‑clearing debris as subject to the same 65% (or other percent) C&D diversion calculation without recognizing the explicit CALGreen treatment and stockpile allowance. The code both requires 100% reuse/recycle for land clearing and lists excavated soil/land-clearing debris as exceptions in other C&D diversion rules — read both § 5.408.3 and the exceptions in § 5.408.1. § 5.408.3 § 5.408.1
- Failing to document stockpiling plans or the plan for ultimate reuse: even when stockpiling is used, the project should include that approach in the construction waste management plan or project documentation per § 5.408.1.1 and § 5.408.1.4. § 5.408.1.1 and § 5.408.1.4
- Stockpiling without pest/disease checks: storing contaminated material can spread pests/disease; when contamination is suspected the code points to the County Agricultural Commissioner for direction — don’t assume you can reuse contaminated soil/vegetation. § 5.408.3 (Exception & Notes)
- Assuming stockpiled material removes the need to plan for final reuse/recycling locations or transport — the stockpile is a temporary allowance, not a final disposition solution; include locations, timing and destination in your plan as required elsewhere in Chapter 5. § 5.408.1.1 and § 5.408.1.4
Worked example — site with phased development
Scenario: A developer clears a 10‑acre lot as Phase 1 for a project that will build the site infrastructure in Phase 2 (six months later) and buildings in Phase 3 (year 2). Clearing yields:
- 1,200 cubic yards of tree stumps/large woody debris,
- 3,800 cubic yards of topsoil and associated vegetation, and
- 200 cubic yards of clean rock.
How CALGreen applies:
- The trees, stumps, vegetation, soils and rocks from the clearing are subject to the 100 percent reuse/recycle requirement in § 5.408.3. You must plan to reuse (e.g., grind woody material for mulch/erosion control, reuse topsoil on-site for landscaping or storage until later use, move rock for perimeter berms) or recycle/offload to a re‑use facility. § 5.408.3
- Because this is a phased project, you may stockpile on site until Phase 2/3 storage or re‑use locations are developed; include the stockpile location, erosion control, and timeline in your construction documents and waste plan. § 5.408.3 and § 303.1
- If any soil/vegetation shows signs of disease or pest infestation during clearing, do NOT plan reuse — contact the County Agricultural Commissioner and follow their direction; contaminated material is excepted from reuse. § 5.408.3 (Exception & Notes)
- Document your plan and the eventual fate of the stockpiled material (on‑site reuse, off‑site recycling facility receipts, or Ag Commissioner disposition) so the enforcing agency can verify compliance under the broader C&D documentation rules. § 5.408.1.4 and § 5.408.1.1

A5.408.3.1 Enhanced construction waste reduction – Tier 1. Divert to recycle or salvage at least 65 percent of nonhazardous construction and demolition waste generated at the site. Any mixed recyclables that are sent to mixed-waste recycling facilities shall include a qualified third party verified facility average diversion rate. Verification of diversion rates shall meet minimum certification eligibility guidelines, acceptable to the local enforcing agency.
A5.408.3.1.1 Enhanced construction waste reduction – Tier 2. Divert to recycle or salvage at least 80 percent of nonhazardous construction and demolition waste generated at the site.
A5.408.3.1.2 Verification of compliance. A copy of the completed waste management report or documentation of certification of the waste management company utilized shall be provided.

SECTION A6.401—GENERAL
A6.401.1 Scope. The provisions of this chapter shall outline means of achieving material conservation and resource efficiency through reuse of existing building stock and materials; use of recycled, regional, rapidly renewable and certified wood materials; and employment of techniques to reduce pollution through recycling of materials.
SECTION A6.407 [OSHPD 1, 2 & 4]—WATER RESISTANCE AND MOISTURE MANAGEMENT
A6.407.3 Weather protection. Provide a weather-resistant exterior wall and foundation envelope as required by California Building Code Section 1403.2 and California Energy Code Section 150, manufacturer’s installation instructions or local ordinance, whichever is more stringent.
A6.407.4 Moisture control. Employ moisture control measures by the following methods.
A6.407.4.1 Sprinklers. Design and maintain landscape irrigation systems to prevent spray on structures.
A6.407.4.2 Entries and openings. Design exterior entries and/or openings subject to foot traffic or wind-driven rain to prevent water intrusion into buildings.

A5.601.3.2 Energy performance. For the purposes of mandatory energy efficiency standards in this code, the California Energy Commission will continue to adopt mandatory standards.
A5.601.3.3 Tier 2. Comply with the energy efficiency requirements in Section A5.203.1.1 and Section A5.203.1.2.2.
A5.601.3.4 Voluntary measures for Tier 2. In addition to the provisions of Sections A5.601.3.1 and A5.601.3.3 above, compliance with the following voluntary measures from Appendix A5 is required for Tier 2:

CALGreen § 405.5.3.3 High relevance — show source text
A5.405.5.3.3 High strength concrete. Concrete elements designed to reduce their total size compared to standard 3,000 psi concrete, thereby reducing the total volume of cement, aggregate and water used on the project.
A5.405.5.3.4 Later ages of maturity. An increase in the age of maturity of testing for determining compressive strength for acceptance of concrete from the current 28 days to 42 or 56 days, in compliance with ASTM C31/C31M.
A5.405.5.3.5 Returned fresh concrete. The use of returned fresh concrete in compliance with ASTM C1798/C1798M or Caltrans Section 90-9.
SECTION A5.406—ENHANCED DURABILITY AND REDUCED MAINTENANCE
A5.406.1 Choice of materials. Compared to other products in a given product category, choose materials proven to be characterized by one or more of the following.
A5.406.1.1 Service life. Select materials for longevity and minimal deterioration under conditions of use.
A5.406.1.2 Reduced maintenance. Select materials that require little, if any, finishing. For those with surface protection, choose materials that do not require frequent applications of toxic or malodorous finishes.
A5.406.1.3 Recyclability. Select materials that can be reused or recycled at the end of their service life in the project.
SECTION A5.408—CONSTRUCTION WASTE REDUCTION, DISPOSAL AND RECYCLING
A5.408.3.1 Enhanced construction waste reduction – Tier 1. Divert to recycle or salvage at least 65 percent of nonhazardous construction and demolition waste generated at the site. Any mixed recyclables that are sent to mixed-waste recycling facilities shall include a qualified third party verified facility average diversion rate. Verification of diversion rates shall meet minimum certification eligibility guidelines, acceptable to the local enforcing agency.
A5.408.3.1.1 Enhanced construction waste reduction – Tier 2. Divert to recycle or salvage at least 80 percent of nonhazardous construction and demolition waste generated at the site.
A5.408.3.1.2 Verification of compliance. A copy of the completed waste management report or documentation of certification of the waste management company utilized shall be provided.
Exceptions:

- Alternate waste reduction methods developed by working with local agencies if diversion or recycle facilities capable of compliance with this item do not exist.

A5.409.1 Scope. Projects with the area limits specified shall comply with Section A5.409.1 to achieve Tier 1 or Tier 2 compliance. Projects of any size shall comply with Section A5.409.5 to achieve Tier 2 compliance.

5.408.1 Construction waste management. Recycle and/or salvage for reuse a minimum of 65 percent of the nonhazardous construction and demolition waste in accordance with Section 5.408.1.1, 5.408.1.2 or 5.408.1.3; or meet a local construction and demolition waste management ordinance, whichever is more stringent.
5.408.1.1 Construction waste management plan. Where a local jurisdiction does not have a construction and demolition waste management ordinance that is more stringent, submit a construction waste management plan that:
Identifies the construction and demolition waste materials to be diverted from disposal by efficient usage, recycling, reuse on the project or salvage for future use or sale.
Determines if construction and demolition waste materials will be sorted on-site (source-separated) or bulk mixed (single stream).
Identifies diversion facilities where construction and demolition waste material collected will be taken.
Specifies that the amount of construction and demolition waste materials diverted shall be calculated by weight or volume, but not by both.
5.408.1.2 Waste management company. Utilize a waste management company that can provide verifiable documentation that the percentage of construction and demolition waste material diverted from the landfill complies with this section.
Note: The owner or contractor shall make the determination if the construction and demolition waste material will be diverted by a waste management company.
Exceptions to Sections 5.408.1.1 and 5.408.1.2:
- Excavated soil and land-clearing debris.
- Alternate waste reduction methods developed by working with local agencies if diversion or recycle facilities capable of compliance with this item do not exist.
- Demolition waste meeting local ordinance or calculated in consideration of local recycling facilities and markets.
5.408.1.3 Waste stream reduction alternative. The combined weight of new construction disposal that does not exceed two pounds per square foot of building area may be deemed to meet the 65 percent minimum requirement as approved by the enforcing agency.
5.408.1.4 Documentation. Documentation shall be provided to the enforcing agency which demonstrates compliance with Sections 5.408.1.1 through 5.408.1.3. The waste management plan shall be updated as necessary and shall be accessible during construction for examination by the enforcing agency.

Frequently asked questions
Can I burn cleared vegetation on-site instead of reusing or recycling it?
No. CALGreen’s requirement is reuse or recycling for trees, stumps, vegetation and soils (100%); burning is not an allowed substitution under § 5.408.3. If disease/pest infestation is present, follow the exception and the County Agricultural Commissioner’s instructions. § 5.408.3
Does the 100% requirement apply to excavation spoil from foundation work?
No — CALGreen distinguishes excavated soil and land‑clearing debris; § 5.408.3 addresses land clearing specifically. Note that excavated soil/land‑clearing material is treated specially in the exceptions to general C&D diversion rules, so read § 5.408.1 and related clauses for how excavation spoil is handled in diversion calculations. § 5.408.3 and § 5.408.1
How long can I keep a stockpile on site for a phased project?
CALGreen permits on‑site stockpiling for phased projects (“may be stockpiled on site until the storage site is developed”) but does not set a specific maximum time — you must document the plan and control erosion, pests and runoff while stockpiled and follow any local requirements. § 5.408.3 and § 5.408.1.4
Do I still need a construction waste management plan if I’m stockpiling land‑clearing debris?
Yes. CALGreen’s construction waste management plan and documentation requirements apply generally; include the land‑clearing handling/stockpile approach in that plan so the enforcing agency can verify compliance per § 5.408.1.1 and § 5.408.1.4. § 5.408.1.1 and § 5.408.1.4
Who enforces the exception when vegetation is suspected of infestation?
