2.01.010 - By-District Electoral System.

A. Pursuant to California Government Code sections 34886 and 34871(c), councilmembers shall be elected by districts in six single-member districts.

B. Except as provided in subsections (D) and (E) hereof, the councilmember elected to represent a district must live in that district and be a registered voter in that district, and any candidate for councilmember must live in, and be a registered voter in the district in which he or she seeks election at the time nomination papers are issued pursuant to California Government Code section 34882 and Elections Code section 10227.

C. The mayor shall be the only elective member elected by means of a city-wide election of eligible voters residing in Vallejo.

D. Any elective member in office at the time this ordinance takes effect shall continue in office until the expiration of the full term to which he or she was elected or appointed and until his or her successor is qualified. If vacancies in elective member offices elected at-large occur before expiration of the full term thereof, such vacancies may be filled according to law from the city at-large.

E. Upon expiration of the full term of each councilmember elected at-large, that councilmember's successor shall be elected on a by-district basis in the districts established in Section 2.01.030 and as provided in Section 2.01.040.

2.01.020 - Vacancies, Filling of.

Any vacancy in an elective office shall be filled in accordance with Section 303 of the Charter. If the previous incumbent was elected at large, Section 303 of the Charter governs. If the previous incumbent was elected by-district, the council shall appoint a qualified person in accordance with Section 303 of the Charter but in addition to all applicable requirements, that appointed person must reside in the district seat which is vacant.

2.01.030 - City Council District Boundaries.

Six city council districts are hereby established in the city of Vallejo. The boundaries and identifying number of each district shall be as described on the Council District Map attached hereto as Exhibit "A" and incorporated herein by this reference.

2.01.040 - Election of Six Councilmembers of the City Council By-District.

A. Following the effective date of the ordinance codified in this chapter and upon the commencement of "by-district" elections in the order established in Section 2.01.050 of this chapter, councilmembers shall be elected "by-district" as defined in California Government Code section 34871 or any successor statute. A person shall not be eligible to be elected to be a councilmember unless he or she is otherwise qualified as required by Charter Section 301 and any other applicable law, and both resides in the geographical area making up the district from which he or she is nominated to be elected and is a registered voter of the city of Vallejo at the time nomination papers are issued to the candidate as provided for in section 10227 of the California Elections Code. No term of any councilmember that commences on or prior to the effective date of the ordinance codified in this chapter shall be affected prior to its expiration date.

B. Registered voters signing nomination papers or voting for a councilmember shall be residents of the geographical area making up the district from which the councilmember is to be elected.

2.01.050 - Commencement of District Elections.

A. This chapter shall not affect any term of any elective office in existence or commencing on or before the effective date of the ordinance codified in this chapter.

B. Except in the case of a vacancy as set forth in Section 303 of the Charter of the city of Vallejo, commencing with the general municipal election in November 2020 and in each fourth year thereafter, the voters in Districts 1, 3, and 6 shall elect Councilmembers by district, and the mayor shall be elected at large for full four-year terms. Except in the case of a vacancy as set forth in Section 303 of the Charter of the city of Vallejo, commencing with the general municipal election in 2022 and each fourth year thereafter, the voters in Districts 2, 4, and 5 shall elect members of the city council by district for full four-year terms.

2.01.060 - Adjustment of Boundaries.

A. Pursuant to Elections Code sections 21620, et seq., as it may be amended, the city council shall adjust the boundaries of any or all of the districts following each decennial federal census. Using the census as a basis, the city council shall adjust the boundaries so that the districts shall be as nearly equal in population as practicable and in compliance with all applicable provisions of law. Prior to the public hearing approving the adjustment of the district boundaries, the city council shall hold a public hearing on the proposed district boundaries as required by Elections Code section 21621, as it may be amended.

B. At the time of any annexation of territory to the city, the city council shall designate, by resolution adopted by a vote of at least a majority of the city council, the contiguous district to which the annexed territory shall be a part and shall amend the district boundaries if necessary.

C. The term of office and district seat of any councilmember who has been elected and whose term of office has not expired shall not be affected by any subsequent adjustment in the boundaries of the district from which he or she was elected.

D. At the first election for council following any adjustment of the boundaries of the districts, a person meeting the requirements of Government Code section 34882 shall be elected to the city council for each district under the readjusted district plan that has the same district number as a district whose incumbent's term on the council is due to expire.

2.01.070 - Vacancies.

For purposes of Section 303 of the Charter of the city of Vallejo, a person is qualified to serve on the city council if he or she is otherwise qualified by law and resides in the geographical area making up the district from which he or she is appointed.
