Chapter 99 — PARKS AND PLAYGROUNDS

§ 99.01 SHORT TITLE. ¶
This chapter is hereby designated and shall be known as the Park Regulations. ('65 Code, § 10-2.01) (Ord. 700, passed - - ; Am. Ord. 420-C.S., passed - -94)
§ 99.02 DEFINITIONS. ¶
For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning. NUISANCE. Includes any use of parks and or playgrounds that interferes with the legal rights of others by causing damage, annoyance or inconvenience. PARKS AND PLAYGROUNDS. Includes all those areas within and outside the municipal boundaries of the city, which areas are set apart, designated or maintained by the city for the entertainment or recreational use of the public, together with all buildings, apparatus and equipment kept or maintained therein and thereon. § 99.03 PROHIBITED ACTS. ¶
It shall be unlawful for any person to commit any of the following acts within the limits of any public park or playground in the city;
(A) To lead or let loose any animal of any kind, except dogs which are restrained by a leash not over six feet in length;
- (B) To carry, bring in or be in possession of any firearms or fireworks;
(C) To make any fires in any other places than in stoves or pits provided by the Community Services Department, except that special permits may be issued by the Community Services Director for special events in specified locations;
(D) To remove, damage or destroy any real or personal property which is part of the park system;
(E) To loiter, trespass or remain in or upon any park or playground during the hours designating the areas closed to the public which hours may be established by the Council; (F) To drive or propel any vehicle upon or across any part of any park except those parts designated by properly posted signs;
(G) To consume or be in possession of any alcoholic beverage, narcotics or illegal drugs. Alcoholic beverages may be served in connection with an authorized use and in accordance with all imposed conditions at the San Gabriel Mission Playhouse, its grounds and parking lot, the Adult Center and Grapevine Park; (H) To sell, offer for sale or give away any goods, wares or merchandise without regular permits to do so;
(I) To throw, break or deposit any bottles, cans, garbage or other refuse except in receptacles provided therefor;
(J) To play or engage in any game or contest except at such places especially designated for such purpose;
(K) To hold, conduct or participate in any celebration, parade, service or exercise without advance, written permission obtained from the Community Services Director; (L) For any male person over eight years of age to enter or use any restroom designated “For Women” and for any female person over eight years of age to enter or use any restroom designated “For Men”; (M) To install or use any commercial play equipment, such as amusement rides, without the advance, written permission of the Community Services Director; (N) To attempt to enter in or upon or use any facility for which a fee is charged without first having paid the required fee; (O) To operate or leave any bicycle or wheeled toy upon the grounds of any city tennis court. Wheeled toys include roller skates, roller blades, skateboards, coasters, scooters and toy vehicles.
(P) To commit or permit to be committed any nuisance;
(Q) To play or practice golf in any portion of a city park;
(R) To disobey a sign or posted placard that has been posted to notify park patrons of a rule or regulation adopted by the City Council; and (S) To violate any rule or regulation which may be adopted by the Council by ordinance or resolution.

§ 99.04 HOURS WHEN CLOSED TO THE PUBLIC. ¶
(A) All parks and playgrounds under jurisdiction of the city, are hereby declared to be closed to the public between the hours of 10:00 p.m. and 6:00 a.m. with the exception of Marshall Park which is closed between the hours of 9:00 p.m. and 9:00 a.m. Special events, for which a permit is granted, may have a later closing time specified in the approved permit.
(B) In order to control noise and light impacts in the neighborhoods, the hours when specific park activities will be permitted in city parks, shall be set by resolution and approved by the City Council.

§ 99.05 EXCEPTION AND PERMITS. ¶
The Community Services Director, the City Manager or the Council, upon proper application therefor, may issue written permits for use by groups or organizations for special events in specified locations during the hours when such area is closed to the public.

COMMUNITY SERVICES DIRECTOR
§ 99.15 JURISDICTION. ¶
The Community Services Director shall be the head of the Community Services Department, and all public parks and playgrounds in the city are hereby placed under his administrative jurisdiction.

§ 99.16 ASSISTANTS. ¶

§ 99.17 POWERS AND DUTIES. ¶
It shall be the duty of the Community Services Director to maintain all parks, playgrounds and recreation facilities and to control the use thereof in such manner that the public will be best served with wholesome activities and well maintained facilities.
