§ 32.01 CREATION; APPOINTMENT OF DEPARTMENT HEAD.

  • (A) Creation. There is hereby established an Administration Department which shall have the powers and the duties as prescribed by the City Council.

  • (B) Appointment of department head. The department head of the Administration Department shall be the City Manager.

CITY CLERK DEPARTMENT

§ 32.05 CREATION.

Creation. There is hereby established a City Clerk Department which shall have the following powers and duties:

  • (A) Keep and maintain an accurate record of the proceedings and actions of the City Council;

  • (B) Serve as the custodian of the city seal, city ordinances, resolutions, contracts and official records of the city;

  • (C) Conduct the municipal elections as prescribed by law;

  • (D) Serve as the filing officer for the Fair Political Practices Commission;

  • (E) Ensure all legal notices are published and/or distributed as required by law;

(F) Serve as the custodian of records for the city; and

  • (G) Serve as the records manager for citywide records.

§ 32.06 CITY CLERK.

(A) The City Clerk is an elected position for a four-year term.

(B) Responsibilities.

(1) Certify the approval of the minutes, adoption of ordinances and resolutions and ensure the vote of the Council has been accurately recorded.

(2) Administer oaths of office for all elected officials and appointed commissioners. Administer formal oaths of office to all public safety employees. Upon commencement of a new term of office of the City Clerk, the Chief City Clerk shall administer the oath of office.

  • (3) Certify the results of the general municipal election.

  • (4) Work collaboratively with the Chief City Clerk in developing general policy direction.

  • (5) Serve as a liaison between the electorate and city government.

§ 32.07 CHIEF CITY CLERK.

(A) The position of Chief City Clerk is established as a department head of the City Clerk Department and shall be appointed by the City Manager.

(B) Responsibilities. The administration of the City Clerk Department shall be the full and direct responsibility of the Chief City Clerk including but not limited to contract management, records management, public records requests, FPPC filings, commission/advisory board appointment process administration and additional duties which may be assigned by the City Manager and/or City Council.

  • (C) In addition, the Chief City Clerk shall:

  • (1) Serve as the election's official for the purposes of conducting all municipal elections;

  • (2) Serve as the San Gabriel filing officer for Fair Political Practices Commission filings;

  • (3) Administer the oath of office to the City Clerk upon commencement of a new term of office; and

(4) Shall work collaboratively with the City Clerk in the development of general policy.

COMMUNITY DEVELOPMENT DEPARTMENT

§ 32.10 CREATION; APPOINTMENT OF COMMUNITY DEVELOPMENT DIRECTOR.

(A) Creation. There is hereby established a Community Development Department which shall have the powers and the duties as prescribed by the City Council.

(B) Appointment of Community Development Director. The Community Development Director shall be appointed by the City Manager. (Am. Ord. 647 C.S., passed 9-18-18)

FINANCE DEPARTMENT

§ 32.20 CREATED.

In order to establish a central area for the uniform processing and development of all fiscal and budgetary functions, there is hereby established a Finance Department. ('65 Code, § 3-3.101) (Ord. 728, passed - - )

§ 32.21 POWERS AND DUTIES.

The Finance Department shall be vested and charged with the following powers and duties:

(A) To maintain and operate the general accounting system of the city and of each of the respective divisions and services thereof;

(B) To perform such accounting functions and duties in accordance with the latest and most modern accounting methods as the science of accounting progresses;

(C) To keep and maintain, or to prescribe and require the keeping and maintenance of, inventory records of municipal properties necessary in accordance with modern municipal accounting practices;

(D) To assume, maintain and perform all functions and duties relating to the administration of taxes and license and permit fees levied or charged by the city, and the collection thereof; (E) To assume and perform all municipal functions and duties relating to the preparation, auditing, presenting and disbursement of claims and demands against the city, including payrolls;

(F) To assist in the purchase of all supplies, goods, wares, merchandise, equipment and material which may be required by the city; and

(G) To assist in the preparation of the annual budget and in the administration thereof.

§ 32.22 DUTIES REQUIRED BY THE COUNCIL.

The Finance Department shall perform such additional duties and functions as may be prescribed or required by the Council. ('65 Code, § 3-3.103) (Ord. 728, passed - - )

§ 32.23 REPORTS.

The Finance Department shall prepare and present to the Council, in sufficient detail to show the exact financial condition of the city, the following reports:

(A) A quarterly, or more frequently as may be desired, statement of all receipts, disbursements and balances of the city;

(B) An annual statement of report of the financial condition of the city; and

(C) Such other financial reports as may be required.

§ 32.24 FINANCE DIRECTOR; APPOINTMENT; POWERS AND DUTIES.

(A) Appointment; deputies. The City Manager may appoint a Finance Director and one or more Deputy Directors of Finance, who, during the absence of the Finance Director, shall have all the powers, duties and responsibilities of the Finance Director. ('65 Code, § 3-3.201)

(B) Powers and duties. The Finance Director shall have the following powers and duties:

(1) To supervise the Finance Department; and

(2) To cooperate with the City Treasurer and other officials of the city in establishing and maintaining sufficient and satisfactory procedures and controls over municipal revenues and expenditures in all departments, divisions and services of the city in accordance with modern municipal accounting practices. (C) Financial and accounting duties. In accordance with the provisions of Cal. Gov't Code §§ 40805.5 and 37209, the financial and accounting duties imposed upon the City Clerk pursuant to the provisions of Cal. Gov't Code §§ 40802 through 40805 are hereby transferred to the Finance Director. ('65 Code, § (Ord. 728, passed - - )

FIRE DEPARTMENT

§ 32.30 CREATION; APPOINTMENT OF FIRE CHIEF.

(A) Creation. There is hereby established a Fire Department which shall have the powers and the duties as prescribed by the City Council.

(B) Appointment of Fire Chief. The Fire Chief shall be appointed by the City Manager.

COMMUNITY SERVICES DEPARTMENT

§ 32.40 CREATION; APPOINTMENT OF DEPARTMENT HEAD.

(A) Creation. There is hereby established a Community Services Department which shall have the powers and the duties as prescribed by the City Council.

(B) Appointment of department head. The department head shall be appointed by the City Manager.

POLICE DEPARTMENT

§ 32.50 POLICE RESERVE ORGANIZATION.

(A) Created.

(1) A Police Reserve Organization for the city is hereby created which shall be a voluntary organization and which is hereby specifically excluded from the civil service or the personnel system of the city.

(2) The organization shall be known as the San Gabriel Police Reserve Organization. ('65 Code, § 2-6.01)

(B) Members; compensation. The compensation, if any, for members of the Police Reserve Organization shall be fixed by the Council by resolution. ('65 Code, § 2-6.02)

(C) Members; appointment, registration and qualifications.

(1) The members of the Police Reserve Organization shall be appointed by the Police Chief.

(2) No person shall be deemed a member of the Police Reserve Organization until that member has been registered as such in a roster to be kept by the Police Chief, and until that person has taken his oath that he will observe and obey the Constitution of the United States of America, the Constitution of the State, and the laws of the United States, the state, and the city, and that he is not now nor at any time has been a member of any organization that advocates the overthrow of the government of the United States by force or violence, and that he will carry out the duties of a member of the Police Reserve Organization to the best of his ability. (D) Duties of Police Chief. The Police Chief shall have complete authority, control and command, subject to the provisions of this chapter and subject to the approval of the City Manager and the Council, over the Police Reserve Organization. He shall provide for the training of candidates for membership and for the further training of members. ('65

(E) Duties of members. The duties of the Police Reserve Organization shall be to assist the Police Chief and the regular members of the Police Department of the city in the enforcement of the law and maintenance of peace and order and to perform such other duties as may be provided by city ordinances or such duties as may be prescribed by the Police Chief at any time for the general welfare of the Police Department and the city. (F) Identification cards and insignia of members. An identification card and such other insignia or evidence of identity as may be prescribed by the rules and regulations or by city ordinance to govern the Police Reserve Organization shall be issued to each member, who shall carry the card and other identification at all times while on duty, and who shall surrender them upon the termination of his membership. (G) Termination of membership. The membership of any person may be terminated by the Police Chief at any time, and any member may resign from the Police Reserve Organization at any time, but it shall be his duty to notify the Police Chief of his resignation. Upon the termination of membership, whether voluntary or not, it shall be the duty of the member to return any and all equipment, paraphernalia, identification or badge. ('65 Code, § 2-6.07)

(H) Grounds for summary expulsion of members. In addition to the penalties provided by law, any violation of law under color of the performance of his duties as a member of the Police Reserve Organization or any breach of the rules and regulations established by the Police Chief shall subject any members to summary expulsion. (I) Wearing or carrying of insignia or cards by nonmembers

prohibited. No person shall wear, carry or display any Police Reserve Organization identification card or insignia, or otherwise represent himself to be connected with the Police Reserve Organization, unless he in fact is a member thereof. ('65 Code, § 2-6.09)

§ 32.51 TRAINING OF LAW ENFORCEMENT OFFICERS.

(A) Declaration of qualification. The city declares that it desires to qualify to receive aid from the state under the provisions of the Cal. Penal Code § 13522, Chapter 1, of Title 4, Part 4. ('65 Code, § 2-4.01) (Ord. 832, passed - - ; Am. Ord. 340-C.S., passed - - )

(B) Declaration of adherence to standards. Pursuant to Cal. Penal Code § 13510(c), Chapter 1, the city will adhere to standards for recruitment and training established by the California Commission on Peace Officer Standards and Training (POST). (C) Ascertainment of adherence to standards. Pursuant to the Cal. Penal Code § 13512, Chapter 1, the Commission and its representatives may make such inquiries as deemed appropriate by the Commission to ascertain that the city public safety and dispatcher personnel adhere to standards for selection and training established by the Commission on Peace Officer Standards and Training. § 32.52 DISPOSITION OF UNCLAIMED PROPERTY.

(A) Definition. For the purpose of this subchapter, UNCLAIMED PROPERTY shall mean any and all property in possession of the Police Department for which no claim or demand has been made and property for which no owner has been found. ('65 Code, § 2-5.01)

(B) Sale; notice. The Police Department is hereby authorized to sell at public auction to the highest bidder all unclaimed property which has been in the possession of the Police Department for a period of more than six months upon notice of such sale, given by the Police Chief at least five days before the time fixed therefor, by publication once in a newspaper of general circulation published in the county. (C) Destruction. Any unclaimed property which is not so sold, or which is in so dilapidated or deteriorated condition that it could not be so sold, after being so offered for sale may be summarily destroyed by the Police Department after the public auction sale. ('65 Code, § 2-5.03)

§ 32.53 USE OF MILITARY-STYLE EQUIPMENT.

(A) Police Department Lexipol Policy, Section 707, Military Equipment, Acquisition, Use, and Reporting, incorporated herein by reference, is hereby adopted as the official policy of the Police Department regarding the use of military-style equipment, pursuant to AB 481.

(B) This policy shall remain in effect until changed by ordinance or statute.

(C) This policy shall be reviewed annually to ensure all legal requirements are met.

HUMAN RESOURCES DEPARTMENT

§ 32.60 CREATION; APPOINTMENT OF DIRECTOR OF HUMAN RESOURCES/RISK MANAGEMENT.

(A) Creation. There is hereby established a Human Resources Department, which shall have the powers and the duties as prescribed by the City Council.

(B) Appointment of Director of Human Resources/Risk Management. The Director of Human Resources/Risk Management shall be appointed by the City Manager. (Ord. 627-C.S., passed 9-6-16; Am. Ord. 647 C.S., passed 9-18-18)

MISSION PLAYHOUSE DEPARTMENT

§ 32.70 CREATION; APPOINTMENT OF MISSION PLAYHOUSE DIRECTOR.

(A) Creation. There is hereby established a Mission Playhouse Department which shall have the powers and the duties as prescribed by the City Council.

(B) Appointment of Mission Playhouse Director. The Mission Playhouse Director shall be appointed by the City Manager.
