§ 115.01 DEFINITION. ¶
For the purpose of this chapter, PERSON shall include, in addition to the definition set forth in § 10.05 of this code, the United States of America, or any instrumentality thereof, the state, or any political subdivision or special district thereof, or any other municipal or public corporation. § 115.02 PERMIT REQUIRED. ¶
It shall be unlawful for any person to drill or prospect for water, oil, or any other substance within the city without first obtaining a permit therefor from the Council. ('65 Code, § 5-15.02) (Ord. 197, passed - - ; Am. Ord. 835, passed - - ) Penalty, see § 10.99
§ 115.03 CONDITIONS OF PERMIT; REVOCATION. ¶
The Council in granting any such permit may impose reasonable conditions as to the hours of drilling, the operation of machinery, the suppression of noise, and the elimination of dust, smoke, fumes, odors, or vibrations in order that the peace, health, safety, and welfare of the inhabitants of the city may be preserved and the value of surrounding or adjacent property maintained. Any violation of such conditions, or any of them, shall be cause for revocation of the permit. ('65 Code, § 5-15.03) (Ord. 197, passed - - ; Am. Ord. 835, passed - - )
§ 115.04 BOND. ¶
The Council, in its discretion, may require the posting of a bond to assure the performance of the conditions referred to in § 115.03 of this chapter. ('65 Code, § 5-15.04) (Ord. 197, passed - - ; Am. Ord. 835, passed - - )
