Chapter 120 — HORSE RACING HANDICAPPERS

§ 120.01 PERMIT REQUIRED.

It shall be unlawful for any person, whether as principal, officer, clerk, agent, or employee, either for himself or for any other person, to engage in, conduct, carry on, or maintain the business, trade, occupation, or calling of a horse racing handicapper in the city without first having procured a permit from the Council so to do. § 120.02 PERMIT APPLICATIONS.

Any person desiring to procure a permit to engage in, conduct, carry on, or maintain the business, trade, occupation, or calling of a horse racing handicapper shall make an application therefor in writing to the Council. Such application shall set forth the name of such person or, if the applicant shall be an association, the names of the members thereof, or, if the applicant shall be a corporation, the names of the officers thereof, and the location where it is proposed to conduct such business. Such application shall contain such additional information as may be prescribed by the City Manager, including, but not limited to, the names of all persons who shall be employed in such business, their addresses, past employment record, record of any arrests or convictions for other than minor traffic violations, and any other information of a similar nature which shall be necessary in order to ascertain the moral character of such persons.

§ 120.03 CONSIDERATION OF APPLICATION; ISSUANCE.

Such application for a permit shall be considered by the Council as soon as convenient after the application shall have been received and an application fee in an amount established by Council has been paid. Such application fee shall defray the costs of the investigation of the application and shall be non-refundable. The determination of the Council upon such application, when so made, shall be conclusive, unless reconsidered by the Council in the same manner other acts of the Council are reconsidered. Upon such permit being granted by the Council, the Council shall direct the Finance Director to issue such permit upon the payment of the license fee set forth in this chapter. The permit, if granted, shall remain in effect until revoked or until the permittee allows his license to expire without timely renewal. ('65 Code, § 5-26.03) (Ord. 167-C.S., passed - - ; Am. § 120.04 FORM OF PERMIT.

The permit shall contain the name of the person, firm, corporation, or association to whom the permit is issued, the date of its expiration, the amount paid therefor, the date of the granting of the permit by the Council, and the location for which the permit shall have been granted. Such permit shall be issued by the Finance Director. ('65 Code, § 5-26.04) (Ord. 167-C.S., passed - - )

§ 120.05 LICENSE FEE.

The business license fee for the occupation of horse racing handicapper shall be as set forth in § 110.63 of this code.

§ 120.06 SUSPENSION OR REVOCATION.

Any license or permit granted or issued pursuant to the provisions of this chapter may be suspended or revoked by the Finance Director at any time:

(A) For a material false statement contained in the application;

(B) For failure to comply with any regulatory provision contained in the statutes of the state or the laws of the city regulating such business;

(C) For failure to operate such business in an orderly and businesslike manner in compliance with such orders, rules, and regulations as may be applicable thereto pursuant to the provisions of this code or statutes of the state; or

(D) For conducting such business in an illegal, improper, or disorderly manner or in a manner which endangers the public welfare. ('65 Code, § 5-26.06) (Ord. 167-C.S., passed - - )

§ 120.07 APPEALS.

Any decision of the Finance Director shall be subject to an appeal to the Council as otherwise provided in this code. ('65 Code, § 5-26.07) (Ord. 167-C.S., passed - - )
