§ 111.01 HANDBILL DEFINED.

For the purpose of this chapter, the following definition shall apply unless the context clearly indicates or requires a different meaning.

HANDBILL. Any printed or written matter, sample or device, circular, leaflet, pamphlet, paper, booklet or any other printed or otherwise reproduced original or copies of any matter or literature regardless of content or subject matter.

§ 111.02 HANDBILLS ON INHABITED PREMISES.

It shall be unlawful for any person to distribute, deposit, throw, place, scatter or cast any handbill in or upon any premises which are inhabited without first ensuring that each handbill is so placed or deposited as to be secure or prevented from being blown or drifting thus becoming litter (provided however that mailboxes may not be used for such purpose so long as prohibited by Federal postal laws or regulations).

§ 111.03 DISTRIBUTION OF HANDBILLS ON POSTED PREMISES.

It shall be unlawful for any person, whether permitted under this chapter or not, to distribute, deposit, place, throw, scatter or cast any handbill in or upon any premises which has posted a sign in a place providing reasonable notice by bearing the words “no handbills,” or words of similar import. § 111.04 DISTRIBUTION OF HANDBILLS IN PUBLIC PLACES.

It shall be unlawful for any person to deposit, place, throw, scatter or cast any handbill in or upon any public place in the city. It shall not be unlawful for any person to hand out or distribute any handbill in any public place to any person willing to accept it.

§ 111.05 HANDBILLS ON VEHICLES.

It shall be unlawful for any person to distribute, deposit, place, throw, scatter or cast any handbill in or upon any vehicle.

§ 111.06 HANDBILLS ON VACANT OR UNINHABITED PREMISES.

It shall be unlawful for any person to distribute, deposit, place, throw, scatter or cast any handbill in or upon any premises which are temporarily or continuously uninhabited or vacant including but not limited to fences, lights and light posts, and utility structures.

§ 111.07 CAUSING OR PERMITTING DISTRIBUTION OF HANDBILLS.

It shall be unlawful for any individual, person, partnership, corporation or other business to cause or to allow, any handbill to be distributed in violation of this chapter. (Ord. 616-C.S., passed 3-17-15) Penalty, see § 10.99

§ 111.08 ENFORCEMENT.

Violation of any provision of this chapter shall be punishable as a misdemeanor. Provided, however, that any violation of this chapter may be charged as an infraction at the discretion of the City Prosecutor.
