§ 2.52.010 ESTABLISHMENT—COMPOSITION—APPOINTMENT.

There is hereby created and established a city Planning Commission to be known as the “Planning Commission of the City of Monrovia,” none of whom shall be officers or employees of the city; one member of the City Council to be selected by the Mayor with the approval of the City Council, and the City Attorney shall serve the Planning Commission in an advisory capacity and shall attend all meetings of the Planning Commission. The members of the Planning Commission shall be appointed by the Mayor with the approval of the City Council. All members of the Planning Commission shall be residents of the City of Monrovia.

§ 2.52.020 TERM OF OFFICE.

(A) Members of the Planning Commission shall be appointed by the Mayor and with the approval of the City Council.

(1) Commissioners shall serve at the pleasure of the City Council.

(2) The term of office for each Commissioner shall be three years, commencing on July 1st of the year of appointment and terminating June 30th three years thereafter.

(3) If a vacancy occurs, other than by expiration of the term, the Mayor shall fill the vacancy pursuant to the selection process established in § 2.46.040.

(B) (1) At the end of any Commissioner's term, the Commissioner may apply for appointment to the Planning Commission pursuant to the selection process established in § 2.46.040.

(2) Members who apply for re-appointment shall follow the same selection process as new applicants.

(C) (1) The terms of the Commissioners shall be staggered.

(2) The terms of not more than three members of the Planning Commission shall expire in any one year.

(D) Members of the Planning Commission shall serve without compensation.

§ 2.52.030 OFFICERS.

The Planning Commission shall elect its Chairperson from among the appointed members for a term of one year, and subject to other provisions of law may create and fill such other offices as it may determine.

§ 2.52.040 MEETINGS—QUORUM.

(A) The Planning Commission shall hold at least one regular meeting in each month. Until such time as otherwise fixed by resolution of the Planning Commission, the place of meeting of the Commission shall be the Council Chamber of the City Hall, and the time of such meetings shall be the Wednesday following the second Tuesday of each month at the hour of 7:30 p.m.

(B) Special meetings may be called at any time by the Chairperson or three members of the Planning Commission by a written notice served upon each member of the Commission not less than three hours before the time specified for the proposed special meeting. Four members of the Commission shall constitute a quorum for the transaction of business.

§ 2.52.050 POWERS AND DUTIES.

(A) The Planning Commission shall function under and pursuant to the provisions of Cal. Gov't Code §§ 65000 et seq. and all amendments thereto, and powers and duties of the Commission shall be such as may be authorized by the provisions of state law and this code.

(B) The Planning Commission shall have those powers necessary to enable it to fulfill and carry out its planning function as provided in this code.

§ 2.52.060 APPEAL PROCEDURES—TIME LIMITATIONS—COSTS.

Any person may appeal the decision or action of officers of the administrative departments by filing, within ten days after such decision or determination, an application for a hearing by the Commission in the following manner:

(A) Applications shall be on forms provided by the city;

(B) The grounds for requesting a ruling by the Commission shall be specified on the application;

(C) The costs of handling and processing the appeal shall be paid for in advance by the applicant as per schedule established by the Commission.

§ 2.52.070 APPEALS TO THE CITY COUNCIL—PROCEDURES—TIME LIMITATIONS—COSTS.

Any person may appeal the decision of the Commission made with respect to any application for a variance or conditional use permit by filing, within ten days after such decision, an application for a hearing by the Council in the following manner:

(A) Applications shall be on forms provided by the city;

(B) The grounds for consideration and decision by the Council shall be specified in the application; the Council, upon receipt of the appeal, shall set the matter for public hearing in the same manner, as public hearings are set by the Commission; following the hearing the Council shall affirm, reverse or modify the decision of the Commission.

(C) A uniform fee set by Council resolution shall be paid to the city upon the filing of each appeal.

§ 2.52.080 RULES—REGULATIONS—RECORDS.

The Planning Commission shall adopt rules for the transaction of business and it shall keep a record of its resolutions, transactions, findings and determinations, which record shall be a public record.

§ 2.52.090 EMPLOYEES APPOINTED AS NECESSARY.

The Planning Commission may, with the approval of the City Council, appoint such officers, planning consultants and employees as it may deem necessary for its work.

§ 2.52.100 FUNDS AND EXPENDITURES.

The City Council shall provide the funds, equipment, and accommodations necessary for the work of the Planning Commission, and the expenditures of the Commission, exclusive of gifts to the Commission, shall be within the amounts appropriated for the respective purposes.
