§ 2.04.010 CREATION OF OFFICE.¶
The office of City Manager is hereby created.

§ 2.04.020 APPOINTMENT—TERM—SUPERVISION—TENURE.¶
The City Manager shall be appointed by majority vote of the City Council for an indefinite term. The City Manager shall be chosen by the Council solely on the basis of executive and administrative qualifications, with special reference to actual experience in or knowledge of accepted practice with respect to the duties of the office as set forth in this chapter. The City Manager shall serve directly under the supervision and control of the City Council, and shall hold office at and during the pleasure of the City Council.

§ 2.04.030 APPOINTMENT—RESIDENCY.¶
Residence in the city at the time of appointment of a City Manager shall not be required as a condition of the appointment. However, residency is strongly encouraged within 180 days after appointment, unless the City Council finds residence outside the city is appropriate.

§ 2.04.040 APPOINTMENT—COUNCILMEMBERS—ELIGIBILITY REQUIREMENTS.¶
No member of the City Council shall be eligible for appointment as City Manager until one year has elapsed after the general election next following the date such Councilmember ceases to be a member of the City Council.

§ 2.04.050 ADMINISTRATIVE HEAD OF CITY GOVERNMENT— POWERS AND DUTIES.¶
The City Manager, under the direction and control of the City Council, shall be the administrative head of the city government. The City Manager shall be responsible for the efficient administration of all the affairs of the city which are under the control of the office of the City Manager. The powers and duties of the City Manager shall include but not be limited to those set forth as follows:
(A) Execute administrative supervision and control over all city departments, divisions, programs and personnel, as well as over such other affairs of the city which may be placed under the control of the office of the City Manager;
(B) Appoint and, when necessary for the good of the service, suspend or remove Department Directors (Department Directors serve in an “at will” employment status) and all other officers and employees of the city, except as otherwise provided by city ordinance or law.
(C) Recommend to the City Council a standard schedule of salary for each appointive office and position in the city service, including minimum and maximum rates; to administer the compensation plan once adopted;
(D) Recommend to the City Council, from time to time, adoption of such measures as deemed necessary or expedient for the health, safety, or welfare of the community or for the improvement of administrative services;
(E) Prepare the operating and capital improvement budget annually and submit it to the Council together with a message describing the important features of the budget; to be responsible for the administration of the budget after its final adoption and to keep the City Council informed with respect thereto;
(F) Keep the Council advised of the financial condition and future needs of the city, and make such recommendations as may be deemed desirable;
(G) Consolidate, combine or reorganize any and all offices, positions, departments, and units under the jurisdiction of the office of the City Manager;
(H) Adopt and enforce such administrative and personnel policies, practices, rules and regulations as deemed necessary for the efficient operation of the city or any individual department or division of the city;
(I) Analyze the functions, duties and activities of the various departments, divisions and services of the city government and of all employees thereof and to make such recommendations to the City Council with reference thereto as deemed in the highest degree of efficiency in the overall operation of the city government;
(J) To exercise general supervision over all public buildings, public parks, public streets and other public property which is under the control and jurisdiction of the City Council;
(K) Attend all meetings of the City Council unless excused there from and take part in the discussion of all matters coming before the Council;
(L) Provide for the enforcement of all laws and ordinances;
(M) To serve as public relations officer of the city government and to follow through and endeavor to adjust all just complaints filed against any employee, department, division or service thereof;
(N) Devote his entire time to the discharge of his official duties;
(O) Perform such other duties as may be required by the Council, not inconsistent with the laws or city ordinances.

§ 2.04.060 REMOVAL FROM OFFICE—PROCEDURES.¶
Subject to the limits of this chapter and applicable state law, if any, the City Council may remove the City Manager with or without cause by majority vote of its members.

§ 2.04.070 REMOVAL FROM OFFICE—LIMITATIONS.¶
Notwithstanding the provisions of § 2.04.060, the City Manager shall not be removed from office, other than for misconduct in office, during or within a period of 120 days following any general municipal election held in the city at which election a member of the City Council is elected or when a new City Councilmember is appointed. The purpose of this provision is to allow any newly elected or appointed member of the City Council or a reorganized City Council to observe the actions and ability of the City Manager in the performance of the powers and duties of the office. After the expiration of said 120-day period, the provisions of § 2.04.060 as to the removal of the City Manager shall apply.

§ 2.04.080 ACTING CITY MANAGER.¶
The City Manager shall appoint one of the other officers or department managers of the city to serve as Acting City Manager during any temporary absence or disability of the City Manager. In the event of failure to make such appointment, the Assistant City Manager shall automatically serve as Acting City Manager.

§ 2.04.090 RESERVED.¶
§ 2.04.100 COMPENSATION.¶
The City Manager shall receive such compensation as the Council shall fix from time to time by contract approved by majority vote of its members in an open and public meeting of the City Council.

§ 2.04.110 EXPENSES.¶
The City Manager shall be reimbursed for all actual and necessary expenses incurred in the performance of official duties, or incurred when traveling on business pertaining to the city.

§ 2.04.120 RELATIONS WITH CITY COUNCIL.¶
(A) Except for the purpose of inquiry, the City Council and the individual members thereof shall deal with the officers and employees of the city solely through the City Manager, and neither the City Council nor any member thereof shall give orders to any of the subordinates of the City Manager.
(B) The City Manager shall receive orders and instructions from the City Council only when sitting in a duly convened meeting of the City Council, and no individual Councilmember shall give any orders or instructions to the City Manager.
(C) Neither the Council nor any of its members shall direct or request the appointment of any person to, or removal from, any office by the City Manager or by any of the City Manager's subordinates.

§ 2.04.130 RELATIONS WITH BOARDS, COMMITTEES AND COMMISSIONS.¶
The City Manager may attend any and all meetings of any and all commissions, boards or committees created by the City Council. The City Manager may attend such meeting with or without the direction of the City Council. At such meetings which the City Manager attends, the City Manager shall be heard by such commissions, boards, or committees as to all matters upon which the City Manager wishes to address the members thereof, and the City Manager shall inform the members as to the status of any matter being considered by the City Council. The City Manager shall cooperate to the fullest extent with the members of all commissions, boards, or committees appointed by the City Council.

§ 2.04.140 DEPARTMENTAL COOPERATION.¶
It shall be the duty of all officers and employees of the city to assist the City Manager in administering the affairs of the city efficiently, economically and harmoniously.

§ 2.04.150 PROVISIONS NOT LIMITATION OF COUNCIL AUTHORITY.¶
Nothing in this chapter shall be construed as a limitation on the power or authority of the City Council to enter into any supplemental agreement with the City Manager delineating additional terms and conditions of employment.
