2.16.010 Designated

Pursuant to Probate Code sections 7600 et seq., the sheriff/coroner of the county is designated as the public administrator. Pursuant to California Probate Code sections 2900 et seq., the director of human services is designated as the public guardian and public conservator of the county.

The public guardian shall have all of the powers and duties set forth in Chapter 1 of Division 8 of the Welfare and Institution Code, commencing with section 8000, and such additional powers and duties as may be provided by law. Except as otherwise provided by law, the public guardian may act as guardian or conservator of the person or the estate, or of the person and estate of any person.

The public administrator shall have all the powers and duties set forth in Probate Code sections 7600 et seq.

The public conservator and public guardian shall post an official bond in the amount of five thousand dollars ($5,000), which bond shall inure to the joint benefit of all guardianship and conservatorship estates under the jurisdiction of the public guardian and to the county. The amount of bond required of the public guardian may be increased or lowered by resolution of the board of supervisors.

The public conservator and public guardian shall receive as total compensation for his/her services an annual salary as designated by resolution of the board of supervisors as director of human services of the county. The public administrator shall receive as total compensation for his/her services an annual salary as designated by resolution of the board of supervisors as sheriff/coroner of the county.
