10.08.010 Loading Zone

  1. There is established a loading zone on each side of Charles Street in the town of Mariposa, county of Mariposa, state of California, commencing at a point ninety (90) feet south of Sixth Street and extending thirty (30) feet southerly therefrom.

  2. During the hours between ten (10:00) a.m. and two (2:00) p.m. daily, except Sunday, parking in the zone described in subsection “A” of this section shall be limited for the purpose of loading and unloading vehicles.

10.08.020 Stopping, Parking, Or Standing Prohibited Where

No person shall stop, park, or leave standing any vehicle, whether attended or unattended, in any of the following places:

  1. Within fifteen (15) feet of the entrance to any theater;

  2. On Charles Street in the town of Mariposa, within fifteen (15) feet either side of a point one hundred thirty-five (135) feet southerly from the curbs at the corner of Sixth and Charles Streets, except for the purpose of loading or unloading freight. This limitation shall apply only between the hours of eight (8:00) a.m. and six (6:00) p.m. and does not apply on Sundays or holidays.

  3. On either side of Fifth Street west of Highway 140. This limitation shall apply twenty-four (24) hours a days, seven (7) days a week; except there is established a loading zone on the north side of Fifth Street commencing at a point twenty-five (25) feet west of Highway 140 and extending westerly therefrom. Parking shall be permitted in this zone for the purpose of loading and unloading vehicles only.

  4. Thirty-two (32) feet south from the curbline of Sixth Street on both sides of Charles Street; and twentyfour (24) feet north from the curbline of Fifth Street on both sides of Charles Street; and thirty-two (32) feet south of the curbline of Fifth Street on the west side of Charles Street.

  5. i) On Greeley Hill Road two hundred (200) feet on both sides of Greeley Hill Road in a westerly direction from the east end of the bridge crossing the North Fork of the Merced River. (Ord. 661 Sec. 1, 1986). ii) On Greeley Hill Road two hundred (200) feet on both sides of Greeley Hill Road in a westerly direction from the west end of the bridge crossing the North Fork of the Merced River.

  6. Commencing at the easterly line of Cemetery Street with the westerly line from Greeley Hill Road; thence northeasterly along the westerly line from Greeley Hill Road one hundred forty (140) feet to the point of beginning; thence continuing along said westerly line, ninety-one (91) feet.

  7. On Jones Street commencing at the projected north-westerly line of Seventh Street and the northwesterly line of Jones Street; thence northwesterly along the northeasterly line of Jones Street, two hundred seventy (270) feet.

  8. Beginning at the intersection of the easterly line of Jones Street and the northerly line of Thirteenth Street; thence easterly along the northerly line of Thirteenth Street for a distance of two hundred (200) feet.

  9. The westerly side of Old Highway from the intersection of the westerly line of Old Highway with the southerly line of Ninth Street; thence, southerly along the westerly line Old Highway to the most eastern corner of Block 36.

  10. On Fairgrounds Road, beginning at the intersection of the easterly line of State Highway 49 with the southerly line of Fairgrounds Road; thence easterly, along the southerly line of Fairgrounds Road, a distance of three hundred and sixty (360) feet.

  11. On Fairgrounds Road, beginning at the intersection of the easterly line of State Highway 49 with the northerly line of Fairgrounds Road; thence easterly, along the northerly line of Fairgrounds Road, a distance of one thousand and seventy-five (1075) feet to the end of the county maintained portion of the road.

  12. On Bullion Street, commencing at a point on the southwesterly line of Bullion Street one hundred and nineteen feet (119) southeasterly from the southeasterly line of Tenth Street; thence southeasterly along said southwesterly line of Bullion Street forty (40) feet.

  13. On Merced Street, beginning at the intersection of the northwesterly line of Water Street with the northerly line of Merced Street; thence westerly along the northerly line of Merced Street, a distance of one hundred (100) feet.

  14. The no parking zone will commence at the beginning of Whitmore Drive. The sign is to be placed at point 43 feet southerly of the southwest corner of State Highway 49 South and Whitmore Drive.

  15. The no parking zone will commence at the beginning of Hidalgo Street at the corner of Banderilla Drive. The signs are to be placed at points 400 feet from the corner of Banderilla Drive on the south side of Hidalgo Street.

  16. On the northwest side of Eight Street between Bullion Street and Highway 140.

  17. On both sides of Trabucco Street from its intersection with Mariposa Street and extending 200 feet northwesterly.

  18. On both sides of Lazo Way from Zarzo Way in both directions to Coronado Drive.

  19. On either side of the road on Forest Drive from the intersection of Summit Road to Summit Road from November 1 through May 1 annually.

  20. On either side of the road on Railroad Avenue from the intersection of Laurel to the end of Railroad Avenue from November 1 through May 1 annually.

  21. On either side of the road on Laurel Way from the intersection of Railroad Avenue to the end of Laurel Way from November through May 1 annually.

  22. On either side of the road on Fish Camp Lane from the intersection of Highway 41 to the end of Fish Camp Lane from November 1 through May 1 annually.

  23. On either side of the road on the entire length of Silvertip Lane from November 1 through May 1 annually.

  24. On the east and west sides of State Highway 41 within the State Highway right-of-way in the community of Fish Camp from Jackson Road to the Big Creek Crossing from November 1st to April 1st.

The following motor vehicle parking regulations and restrictions shall apply to the following streets and roads in the town of Mariposa:

  1. On Fifth Street between Charles street and Bullion Street, parallel parking shall be permitted on the north side, and there shall be no parking on the south side.

  2. On Sixth Street between Charles Street and the Mariposa Creek Bridge, right angle parking shall be permitted on the south side, and no parking shall be permitted on the north side.

  3. On Sixth Street between Charles Street and Bullion Street, diagonal parking shall be permitted on the north side except that motor vehicles may be parked primarily on privately owned property on the north side, provided no part of any parked vehicle shall extend onto or across or into the portion of Sixth Street normally used for motor vehicular travel.

  4. On Seventh Street between Charles and Bullion Streets, diagonal motor vehicle parking shall be permitted on the north side immediately adjacent to the Sierra Stationers property only.

  5. On Sixth Street from the intersection of Mariposa Street and Sixth Street extending from said intersection one hundred twenty-five (125) feet southwest, no parking shall be allowed on the northwest side of Sixth Street.

  6. There shall be no parking on the southwest side of Seventh Street from the curbline of Charles Street for a distance of one hundred fifty-five (155) feet towards Bullion Street.

  7. On the southwest side of Charles Street a distance of thirty-two (32) feet from the curbline of Sixth Street for a distance of twenty-two (22) feet there shall be a bus loading zone for the use of the Mariposa county senior citizens bus.

  8. On Mariposa Street from the intersection with Sixth Street extending southeasterly to the intersection of the easement road known as Trabucco Street, no parking shall be allowed on the northeast side of Mariposa Street.

  9. There shall be no parking on the southeasterly side of Eighth Street; beginning at the intersection of Jones Street and Eighth Street, and extending northeasterly approximately three hundred (300) feet to the westerly edge of the Mariposa county high school parking area.

  10. Angle parking shall be allowed in the following locations in the county:

  11. Beginning at the intersection of the easterly line of Bullion Street with the northerly line of Tenth Street; thence along said northerly line of Tenth Street easterly, one hundred (100) feet.

    1. Beginning at the intersection of the northerly line of Ninth Street with the westerly line of Bullion Street, northerly to the southerly line of Tenth Street.

    2. Beginning at the intersection of the northerly line of Twelfth Street with the westerly line of Jessie Street; thence along said westerly line of Jessie Street, northerly, one hundred forth-five (145) feet.

  12. Beginning at the intersection of the southerly line of Ninth Street with the easterly line of Bullion Street; thence along said easterly line of Bullion Street, southerly, seventy-five (75) feet.

  13. Beginning at the intersection of the southerly line of Sixth Street with the westerly line of Bullion Street; thence along said westerly line of Bullion Street, southerly, eighty-five (85) feet.

  14. Commencing at the intersection of the easterly line of Jones Street with the northerly line of Sixth Street; thence along said northerly line of Sixth Street, easterly, forty-two (42) feet to the point of beginning; thence continuing along said northerly line, three hundred ninety-five (395) feet.

  15. Beginning at the intersection of the easterly line of State Highway 140 with the northerly line of Fourth Street; thence along said northerly line of Fourth Street, easterly, forty-five (45) feet.

  16. Beginning at the intersection of the easterly line of Charles Street with the northerly line of Eleventh Street; thence along said northerly line of Eleventh Street, easterly, one hundred four (104) feet.

  17. The entire northeasterly side of Charles Street between Eleventh Street and Twelfth Street in the township of Mariposa.

  18. Beginning at the intersection of the easterly line of Bullion Street with the southerly line of Eleventh Street; thence along said southerly line of Eleventh Street, easterly 70 feet.

  19. On Bullion Street, commencing at a point on the southwesterly line of Bullion Street thirty-eight (38) feet southeasterly from the southeasterly line of Tenth Street; thence southeasterly along said southwesterly line of Bullion Street eighty-one (81) feet: angle parking permitted.

No person shall stop, park, stand or leave standing any vehicle whether attended or unattended, except when necessary to avoid conflict with other traffic or in compliance with the directions of a peace officer or official traffic control device between the hours of 10:00 p.m. and 6:00 a.m. on State Highway 140 on the north side from a point .33 miles east of Caltrans mile marker 51 to a point 760 feet west of the Yosemite National Park monument, or on the south side from a point .33 miles east of Caltrans mile marker 51 to the Yosemite National Park monument, and the director of public works and transportation of the county of Mariposa is directed to place and maintain appropriate signs of this regulation.

On Sixth Street between Charles Street and the Mariposa Creek Bridge parking on the north side thereof is prohibited; parallel parking only is permitted on the south side thereof between Mariposa Creek Bridge and a line parallel with the situated sixty-nine (69) feet west of the westerly line of Charles Street (State Route 140 sign); a loading zone, to be used by commercial vehicles only while loading or unloading merchandise and while parked parallel with the southerly line of Sixth Street as close thereto as reasonably possible, is established on the south side of Sixth Street between the westerly line of Charles Street (State Route 140 sign) and a line sixty-nine (69) feet west of and parallel with said westerly line of Charles Street. Parallel parking permitted only in designated spaces beginning at the intersection of the northerly line of Twelfth Street with the easterly line of Jessie Street; thence along said easterly line of Jessie Street, northerly, ninety-four (94) feet.

  1. On Eighth Street between Jones and Bullion Streets diagonal parking shall be permitted on the north side of privately owned property for not over five (5) motor vehicles at any one (1) time, between a point thirty (30) feet east of the southwest block corner of Block 35 of the town of Mariposa and a point one hundred six and five-tenths (106.5) feet east of said southwest block corner, except for six (6) feet at the sidewalk entrance to the front of the post office building, provided that no part of any vehicle so parked shall extend onto or across or into the portion of Eighth Street normally used for vehicular traffic. No parking shall be permitted at any time between a point one hundred six and five-tenths (106.5) feet east of said southwest block corner and the intersection of Eighth and Jones Streets on the north side of Eighth Street, and no parking shall be permitted at any time on the south side of Eighth Street between Jones and Bullion Street.

  2. On Bullion Street between the southwest block corner of Block 35 of the town of Mariposa and a point one hundred twenty-six (126) feet north of said block corner, no parking shall be permitted on either side of the easterly half of Bullion Street presently used for vehicular travel.

The following public parking areas are designated as handicapped parking, for the exclusive use of persons bearing an authorized handicapped sign, license plate, or sticker on their vehicle:

  1. On the southwest side of Jones Street between Ninth Street and Tenth Street, the parking space on each side of the walkway entering the courthouse from Jones Street and immediately adjacent thereto--two (2) spaces.

  2. Designated handicapped parking spaces within parking district no. 1 as described in section 10.16.030.

  3. On Sixth Street at the intersection of Highway 140, the first stall on the southeast side in each direction from the intersection, being two (2) stalls, one (1) northeast of the intersection and one (1) southwest of the intersection.

  4. On the west side of Highway 140 approximately one hundred twenty-five (125) feet north of the intersection of Highway 140 and Coakley Circle--one (1) space.

The following regulations shall govern parking adjacent to the Mariposa county courthouse:

  1. On the southeast side of Tenth Street between Bullion Street and Jones Street, public parking shall be permitted in diagonal stalls only.

  2. On the southwest side of Jones Street between Ninth Street and Tenth Street, parking is prohibited within fifteen (15) feet of the fire hydrant located near the Jones Street entrance to the courthouse.

  3. On the southwest side of Jones Street between Ninth Street and Tenth Street, parking is prohibited in the two (2) stalls reserved for police parking only, one (1) located as the second stall northwest of the walkway entering the courthouse from Jones Street, and the other as the first stall southeast of the fire hydrant zone.

10.08.053 Parking In The Yosemite West Maintenance District

It is unlawful to park any vehicle on the streets and roadways of the Yosemite West Maintenance District in such a manner as to interfere with, obstruct or delay snow-plow operations.

It is unlawful for any firm, person, or corporation to park or stop a vehicle or cause the same to be parked or stopped, for a period in excess of two (2) hours between the hours of nine (9:00) a.m. and five (5:00) p.m., Sundays and holidays excepted, on Fifth, Sixth, or Seventh Streets between the east curbline of State Route 140 and the west curbline of Bullion Street in the town of Mariposa.

  1. On Incline Road parking in the turnout areas thereof is prohibited. The Mariposa County road commissioner is authorized to post in conspicuous places along said road signs which will adequately notify the public of the no parking regulations imposed thereon under this section.

  2. The Mariposa County road commissioner is authorized and directed to post in conspicuous places along Incline Road in Yosemite West Maintenance District signs which will adequately notify the public of “NARROW ROAD - SLOW,” SCHOOL BUS STOP,” and “WATCH FOR RANGE ANIMALS.”

10.08.062 Parking Regulations In Coulterville

The following motor vehicle parking regulations and restrictions shall apply to the following streets, roads and property in the town of Coulterville:

  1. In the west side of Merced Street, from the intersection of Highway 49 and J20, southeasterly to the north corner of the county bridge crossing Maxwell Creek in the town of Coulterville, no parking shall be permitted at any time.

  2. On county property fronting on the north side of Maxwell Creek between the Water Street Bridge and the Caltrans Bridge on Highway 49, parking shall be permitted only between the hours of eight (8:00) a.m. and eight (8:00) p.m. and no overnight camping shall be permitted.

  3. No person shall park or leave standing any commercial vehicle with a gross vehicle weight rating of more than three quarter (3/4) ton, whether attended or unattended on Park Lane, formerly known as Centre Street.

  1. There is established a bus loading zone on the north side of Tenth Street in the town of Mariposa, county of Mariposa, state of California, commencing twenty (20) feet from the intersection of Highway 140 and Tenth Street running westerly for sixty (60) feet to Jessie Street.

  2. There is an established bus loading zone on the easterly side of Charles Street in the town of Mariposa, county of Mariposa, state of California, commencing at the intersection of the easterly line of Charles Street with the northerly line of Seventh Street, thence northerly along said easterly line of Charles Street fifty (50) feet.

  3. There is an established bus loading zone on the easterly side of Charles Street in the town of Mariposa, county of Mariposa, state of California, commencing at the intersection of the westerly line of Charles Street with the northerly line of Seventh Street, thence northerly along said westerly line of Charles Street one hundred and three (103) feet.

  4. The zones described in subsections “A”, “B”, and “C” shall be for the loading and unloading of passengers only.

  1. There is hereby established a horse carriage parking zone located in the town of Mariposa, county of Mariposa, state of California, on Highway 140/49, commencing at a point on the westerly line of Charles Street 32 feet southerly from the southerly curb line of Sixth Street westerly line of Charles Street 46.5 feet.

  2. During the hours between 5:30 p.m. and 10:00 p.m. on Friday and Saturday through the months of April and May, and September and October of each year, parking in the zone described in subsection “A” of this section shall be limited for the purpose of horse carriage parking, loading and unloading only.

  3. During the hours between 5:30 p.m. and 10:00 p.m. daily commencing on Memorial Day and extending through Labor Day of each year parking in the zone described in subsection “A” of this section shall be limited for the purpose of horse carriage parking, loading and unloading only.

  4. The Mariposa public works department shall place appropriate signs indicating the restricted parking, loading and unloading, in order to appropriately notify the public of the parking restrictions.

It is unlawful for truck and trailer combinations or tractor and trailer combinations exceeding forty (40) feet in length to travel on the Mariposa county highway known as Boneyard Road.

The Mariposa County road commissioner is authorized and directed to immediately determine and mark on the road surface of the streets and roads mentioned in this chapter the number and positions of diagonal and right-angle parking spaces permitted under this chapter, and to post in conspicuous places along said streets and roads signs which will adequately notify the public of the parking regulations imposed thereon under this chapter.

Adopted by Ord. 457 Sec. 14 on 6/21/1977 10.08.100 Removal Of Vehicle Not Lawfully Parked

The Mariposa County road commissioner or any duly authorized peace officer may remove or cause to be removed any vehicle parked on the streets and road mentioned in this chapter in violation of the terms of this chapter and store the vehicle, or cause it to be stored at the expense of the owner or operator thereof, whenever the road commissioner or duly authorized peace officer finds that such vehicle so parked will constitute a serious traffic hazard. Towing and storage charges will be imposed by the firm or person who tows or stores such vehicle.

  1. The purpose of this section is to safeguard the public health, safety and general welfare by prohibiting parking of vehicles on public highways, roads and streets in certain areas of the county to permit effective and speedy removal of snow by the county road department and the department of transportation or other persons engaged, hired, contracted or otherwise authorized to remove snow from public highways.

  2. In the areas of the county above the elevation of twenty-five hundred (2500) feet, no person shall park any vehicle on a county-owned public road, highway, or right-of-way, which is posted with signs stating that no person shall stop, park or leave standing any vehicle within the areas marked by the signs, during the period for which the road commissioner has declared a “snow removal condition” exists.

    1. In addition to citations powers, any peace officer specified in section 22651 of the California Vehicle Code may remove or cause to be removed a vehicle in violation of this section at the expense of the registered owner.
  3. For purposes of this section, “park” or “parking” means the standing of a vehicle, whether occupied or not, otherwise than temporarily for the purpose of and while actually engaging in loading and unloading of merchandise or passengers.

  4. Whenever any officer, as defined in section 22651 of the California Vehicle Code, finds a vehicle standing upon a highway in violation of subsection B, of this section, the officer may move the vehicle or require the driver or other person in charge of the vehicle to move it, or may remove and store the vehicle at the expense of the registered owner.

  5. No person shall throw or deposit or cause to be thrown or deposited upon highway any snow or ice in an amount or manner likely to constitute a hazard to vehicular traffic.

  1. The entirety of Charles Street from Twelfth Street to Eleventh Street in the township of Mariposa shall be a one-way street with traffic allowed to travel in a southeasterly direction only.

  2. The portion of Twelfth Street from State Highway 140 to Jessie Street in the township of Mariposa shall be a one-way street with traffic allowed to travel in a southerly direction only.

  3. The northern end of upper Bullion Street from Ninth Street to Eighth Street in the township of Mariposa shall be a one-way street with traffic allowed to travel in a southerly direction only, excepting the most southerly sixty feet adjacent to Eighth Street which shall be two-way.

Long-term vehicle parking shall be allowed at the Mariposa/Yosemite airport in the area described as follows: A tract of land situated in projected section 7.T.5. S., R.18E., M.D.B.&M., Rancho Las Mariposas, county of Mariposa, state of California being described as follows: Commencing at California State Highway 49, running between Mariposa and Mount Bullion, station number 194 + 62.77; thence north 80º 15’ 25” west, 68.88 feet; thence south 53º 12’ 00” west, 413.29 feet; thence north 80º 15’ 25” west, 578.00 feet; thence north 9º 44’ 35” east, 148.00 feet; thence south 80º 15’ 25” east, 578.00 feet; thence south 9º 44’ 35” west, 148.00 feet to the point of beginning.

The parking fees for long-term vehicle parking shall be established from time to time by resolution of the board of supervisors. Individuals parking vehicles, other than those renting tie downs and/or hangars at the Mariposa/Yosemite airport, shall sign a written agreement with county and all sums due shall be paid, in advance, when the agreement is executed for the balance of that calendar month. A minimum purchase of 36 gallons per month would waive the parking fee for that calendar month. Additional months parking shall be paid on or before the fifth of each month thereafter in advance. Fees shall be set by resolution of the board of supervisors from time to time. Vehicles shall be towed if fees are not timely paid pursuant to the terms and conditions of this section.

  1. Every non-parking violation of the provisions of this chapter is an infraction punishable as provided in Vehicle Code Section 42001.

  2. Any person violating the parking provisions of this chapter shall be guilty of a civil offense and shall be subject to a civil parking penalty, and late penalties, as applicable, in those amounts set forth by resolution adopted by the board of supervisors. Each calendar day that a vehicle is left parked or standing in an area prohibited for parking by this chapter shall be considered a separate violation.

10.10.010 Title Purpose And Intent

This chapter shall be known as the “Unlawful Camping and Obstruction of Public Rights of Way” ordinance. Publicly accessible areas under the jurisdiction of the County of Mariposa should be readily available and usable for the safe, healthy, and peaceable enjoyment of the public at large. The use of public areas for camping purposes or storage of personal property interferes with the rights of others to use and access these areas in a safe, healthy, and peaceable manner within the purposes for which they are intended. Camping on private property without the consent of the owner, and where camping is not authorized and without proper sanitary measures adversely affects private property rights as well as the public health, safety, and welfare of the residents of Mariposa County. The purpose and intent of this chapter, pursuant to Penal Code section 372, is to establish standards and prohibitions for behaviors related to public camping, bathing or other offenses that are detrimental to the preservation of public property and the health, safety and welfare of the public accessing public property or traversing public rights of way; to ensure and maintain publicly accessible areas in a safe and sanitary manner, for the peaceable use and enjoyment of the public at large; and to maintain private property in a safe and sanitary condition to protect the health, safety and welfare of the community.

For the purposes of this chapter:

  1. "Camp(ing)” means to place, pitch, establish or occupy camp facilities or materials, including but not limited to, the laying down of bedding or the use of other camping materials for the purpose of temporarily, irregularly, or permanently sleeping, staying, living, or residing. An activity shall constitute camping or lodging when it reasonably appears, in light of all circumstances, that the individual(s), in conducting these activities, are in fact using the area as living accommodations regardless of the intent of the individual(s) or the nature of any other activity in which they may be engaging.

  2. "Camp Facilities or Materials” includes but is not limited to, tents, huts, tarpaulins, cardboard boxes, blankets, bedrolls, mattresses, cots, sleeping bags, hammocks, lawn and folding chairs, cooking equipment, warming fires, ice chests, and similar items, or vehicles operable or otherwise.

  3. “County Administrative Officer” shall refer to the County Administrative Officer or his or her designee.

  4. “Enforcement Officer” means any duly sworn peace officer with the power to arrest.

  5. “Personal Property” means personal effects or property consisting of the following items: identification or social security cards; medications; medical devices; eyeglasses; photographs/photo albums; tax or medical records; and reasonably usable, non-soiled, non-verminous items that are reasonably believed to have value, including tents, blankets, sleeping bags, clothes, and operational bicycles (i.e. complete bicycles, not standalone bicycle parts). The definition of Personal Property does not include contraband.

  6. “Public Property” means all public property, including but not limited to, public buildings, streets, sidewalks, trails, alleys, medians, greenways, easements, parks, waterways, canal banks, county highways (as defined in sections 25, 960.5 and 1480 of the California Streets and Highway Code, or as amended), and other rights of way dedicated for public use and lawfully accepted by the County, and other public amenities.

  7. “Private Property” means all private property, including but not limited to real property, yards, private alleyways, sidewalks, trails, private roads, agricultural land, and undeveloped lots.

  8. “Sheriff-Coroner-Public Administrator” shall refer to the Sheriff-Coroner-Public Administrator or his or her designee.

  9. “Store(ing)” means to put aside or accumulate to use when needed, to put for safekeeping, and/or to place or leave in a location.

10.10.030 Unpermitted Camping On Public Property Prohibited

  1. It is unlawful and a violation of this ordinance for any person(s) to camp, occupy camp facilities, or use camping materials on public property not specifically designated for day and/or overnight camping.

  2. This section shall not apply to public property specifically designated for camping or where camping is an authorized use by a responsible local, state, or federal agency. Persons desiring to camp on public property owned, controlled, or maintained by a department of the United States, the California Department of Parks and Recreation, or other local public agencies must comply with the applicable laws, regulations and permitting requirements of the responsible department of the United States, the California Department of Parks and Recreation, or other local public agencies.

  3. Nothing in this ordinance shall prohibit the possession or transportation of camping facilities or materials on public property, unless otherwise in violation of this ordinance.

  4. In the situation an unpermitted camp is erected, notification shall be provided prior to enforcement action, as provided in section 10.10.070.

10.10.040 Unpermitted Camping On Private Property Prohibitive

  1. Except as provided in this section, it is unlawful and a violation of this ordinance for any person(s) to camp, occupy camp facilities, or use camping materials on private property not appropriately zoned under the Mariposa County Code, or authorized by the necessary land use entitlements for camping and camping related recreational activities.

  2. Nothing in this ordinance shall prohibit camping on private property by the owner(s), lessee(s), or other persons with the written permission of the owner; provided that such consent is verified upon demand by County staff and peace officers; and provided that all provisions of the Mariposa County Code and State and County health and sanitation requirements are complied with.

  3. This section shall not apply to private property for camping and camping related activities provided, sponsored, and/or facilitated by youth organizations, religious organizations, or private associations on lands specifically designated for camping and camping related activities and such uses are approved pursuant to the Mariposa County Code and all State and County health, and sanitation requirements are complied with.

  4. This section does not apply to approved employee housing as defined and authorized in the Mariposa County Code.

  5. Nothing in this section shall prohibit camping on private property where camping and camping related activities are an approved use under the Mariposa County Code and all State and County health, and sanitation requirements are complied with.

  6. In the situation an unpermitted camp is erected, notification shall be provided prior to enforcement action, as provided in section 10.00.070.

10.10.050 Obstruction Of Public Access To Sidewalks, Trails, Public Facilities, And…

  1. No individual shall obstruct a street, sidewalk, alleyway, trail, county highway (as defined in sections 25, 960.5 and 1480 of the California Streets and Highway Code, or as amended), entrance to public facilities, or other public right of way (as defined by the Americans with Disabilities Act of 1990, or as amended) by sitting, lying, or sleeping, or using or storing personal property in, or upon any pubic road or other public right of way.

  2. No individual shall obstruct any street, sidewalk, alleyway, trail, county highway, or other public right of way within the following locations:

    1. Five hundred (500) feet of any public or private school, public park, playground, public or private childcare facility, and public library;

    2. One hundred (100) feet of any roadway overpass or underpass, tunnel, or bridge;

    3. Fifty (50) feet of a fire hydrant, fire plug, or other fire department or fire protection district connection, and any designated fire lanes; and

    4. Ten (10) feet of any operational or utilizable driveway or loading dock.

  3. Immediate Removal: Any violation of this section shall be subject to immediate removal by enforcement officers and peace officers.

  4. It is unlawful and a violation of this ordinance to bathe in public fountains or other public property not designated as a shower facility.

  5. It is unlawful and a violation of this ordinance to urinate or defecate upon public property not designated as a restroom facility.

10.10.060 Abatement Of Encampments And Camp Facilities And Materials

  1. Notwithstanding section 10.10.050.C., the County may abate or remove camp facilities and materials, or an encampment established in violation of this chapter after providing written notice of such abatement. Any camp facilities and materials, or encampments established in violation of this chapter may be subject to abatement without advanced written notice by the County, if the encampment poses an imminent and substantial threat to public health or safety, as determined by the Sheriff-CoronerPublic Administrator and upon consultation with the County Administrative Officer.

  2. Abatement pursuant to this section may include, but is not limited to, removal of camp facilities and materials, trash, debris, junk, hazardous waste, infectious waste, and vehicles.

  1. Pre-Removal Notice. Pre-removal notice shall be deemed provided if a written notice is provided to the person who is Storing or claims ownership of the Personal Property or is posted conspicuously on or near the Personal Property and the actual removal commences no less than 72 hours after the pre-removal notice is posted. The written notice shall contain the following:

    1. A general description of the Personal Property to be removed.

    2. The location from which the Personal Property will be removed.

    3. The date and time the notice was posted.

    4. A statement that the Personal Property has been Stored in violation of section 10.10.050.

    5. A statement that the Personal Property may be impounded if not removed from Public Property within 72 hours.

    6. A statement that moving Personal Property to another location in a Public Property will not be considered removal of Personal Property from Public Property.

    7. The address where the removed Personal Property will be located, including the telephone number and the internet website of the County through which a person may receive information as to the impounded Personal Property as well as information as to voluntary storage location(s).

    8. A statement that impounded Personal Property may be discarded if not claimed within 30 days of impoundment.

  2. Post-Removal Notice. Upon removal of impounded Personal Property, written notice shall be conspicuously posted in the area from which the Personal Property was removed. The written notice shall contain the following:

    1. A general description of the Personal Property removed.

    2. The date and approximate time the Personal Property was removed.

    3. A statement that the Personal Property has been Stored in violation of section 10.10.050.

  3. The address where the removed Personal Property will be located including a telephone number and internet website of the County through which a person may receive information as to impounded Personal Property.

  4. A statement that impounded Personal Property may be discarded if not claimed within 30 days after impoundment.

  1. Except as specified herein, the County shall move Personal Property to a place of storage.

  2. Except as specified herein, the County shall store impounded Personal Property for 30 days, after which time, if not claimed, it may be discarded. The County shall not be required to undertake any search for, or return, any impounded Personal Property stored for longer than 30 days.

  3. The County shall maintain a record of the date any impounded Personal Property was discarded.

  1. A violation of this chapter is declared to be a public nuisance and subject to the penalties stated herein.

  2. To camp or reside in a vehicle for a continuous period of more than forty-eight (48) hours within the areas of said district designated for public parking.

  3. To park in, or block with, an unoccupied vehicle the loading zones within the district located in the following locations:

    1. The loading ramp area located along the southwest boundary of the upper Sixth Street parking lot.

    2. The loading zone located on the northeast boundary of the Fifth Street parking lot immediately behind the Hull House.

  4. To park in handicapped parking areas within the district, which shall be signed and marked according to law, located as follows:

    1. In the Fifth Street parking lot, one stall on the northeast boundary at the north corner.

10.20.010 Use Of Coasters, Roller Skates, And Similar Devices Restricted

It shall be unlawful for any person upon roller skates or riding on or by means of a skateboard, coaster, or similar device to go upon any roadway or sidewalk situated in the Mariposa county roadside rest area located adjacent to the northwest corner of Jessie Street and Coakley Circle in the town of Mariposa. The county shall post and maintain conspicuous signs on the property above-described with lettering not less than one (1) inch in height which shall read as follows:

THE OPERATION OF ROLLER SKATES AND/OR SKATEBOARDS ON THE PREMISES, SIDEWALKS OR WITHIN THE PARKING LOT OF THIS MARIPOSA COUNTY ROADSIDE REST AREA IS FORBIDDEN BY LAW. VIOLATION IS AN INFRACTION. (COUNTY ORDINANCE §§ 1.20.020; 10.20).
