7.52.010 - Definitions.

As used in this chapter, the following terms shall have the following meanings:

(a) "Bus" is any motor vehicle, other than a motor truck or truck tractor, designed for carrying more than ten persons, including the driver, and used or maintained for the transportation of passengers.

(b) "Camper" means a structure designed to be mounted upon a motor vehicle to provide facilities for human habitation.

(c) "Car" means any automobile, station wagon, van, or any other motor vehicle as defined by Sections 415 and 670 of the California Vehicle Code or any former motor vehicle which is used for human habitation.

(d) "Housecar" is a motor vehicle originally designed or permanently altered and equipped for human habitation or to which a camper has been permanently attached.

(e) "Trailer" or "trailer coach" is a vehicle designated for human habitation or human occupancy.

(f) "Human habitation" is the utilization of any bus, camper, car, housecar, trailer or trailer coach which is used or occupied as living or sleeping quarters.

7.52.020 - Restrictions.

No person shall use, occupy or permit the use or occupancy of any bus, camper, car, housecar, trailer, or trailer coach for human habitation on any street, park, parkway, beach, or other public or private property except in areas zoned or designed for such purposes by the County.

7.52.030 - Authorized use.

Any bus, camper, housecar, trailer, or trailer coach which is used or occupied for human habitation in any area zoned or designated for such use or occupancy must be equipped and/or operating with either:

(a) A chemical toilet and holding tank; or

(b) An individual sewage disposal system which shall be capable of disposing of sewage into an accepted sewer system.

7.52.040 - Exclusions.

This chapter shall not apply to the following:

(a) Emergency vehicles authorized by an appropriate law enforcement or disaster relief agency;

(b) Any bus, camper, car, housecar, trailer, or trailer coach which is temporarily stopped in any area not zoned for human habitation of such vehicle for not longer than four hours;

(c) Any bus, camper, car, housecar, trailer or trailer coach properly connected to an approved water supply and sanitary sewer system or chemical toilet and holding tank; and constructed and located in compliance with all the requirements of the building, sewer, health and sanitation and zoning codes of the county of Marin; and not inhabited by a greater number of occupants than that for which it was designed;

(d) A private campground or mobile home park zoned as such by the county of Marin.

7.52.050 - Penalty for violation.

Any person who violates the provisions of this chapter is guilty of a misdemeanor. Except where other penalties are specified, each offense may be punished by a fine of not less than twenty-five dollars nor more than five hundred dollars, or by imprisonment in the county jail not to exceed sixty days, or by both such fine and imprisonment.
