7.02.010 - Prohibition designated.

A. It is unlawful for any person to steal, take, possess, or appropriate any recyclable materials, placed at a collection station, including curbside, for collection and recycling.

This prohibition shall not apply to:

  1. Authorized collectors;

  2. The Marin Recycling and Resource Recovery Agency;

  3. Corporations or firms engaged in recycling;

  4. Any public agency;

  5. Any nonprofit organization engaged in the collection of recyclable materials for fund-raising purposes.

B. All solid waste, upon being removed by the authorized collector from the premises where produced and accumulated, shall become and be the property of the county or authorized collector unless otherwise provided in a contract, license, or franchise agreement.
