7.20.010 - Night deliveries found detrimental to public peace and health.

It is hereby found as a fact that the practice of delivering milk designed for human consumption during the night hours and at all times except as hereinafter provided, in the more heavily populated districts known as San Rafael township and Sausalito township, is dangerous and injurious to human health and safety in the following particulars:

First, the practice of leaving and depositing bottled milk on doorsteps and other unprotected depositories during the night hours exposes such milk to contamination by animals, vermin and human beings;

Second, the practice of so leaving and depositing such milk encourages theft and the breach of the peace.

Third, men who perform the service of delivering milk during the night hours frequently sustain physical injury from the abnormal life required, the irregular eating hours required and exposure to colder and more severe weather found at night.

7.20.020 - Night deliveries prohibited—Exceptions.

It is unlawful for any person or corporation to transport over or upon any of the public streets or ways within San Rafael township and Sausalito township or make any deliveries within these townships of any milk, cream or any liquid milk products designed for human consumption between the hours of seven p.m. and seven a.m. where such transportation or delivery is made in the course of any retail business or herein involves processed or pasteurized milk or cream intended for delivery to dealers and merchants having retail places of business within San Rafael township and Sausalito township.

This section is not intended to prescribe the transportation of raw milk from producers to processors nor the disposition of surplus milk not intended for human consumption in liquid form, during any hours.

7.20.030 - Penalty for violation.

Any person, firm or corporation who shall violate or who shall procure, induce or cause the violation or any of the provisions of Section 7.20.020 shall be deemed guilty of a misdemeanor and upon conviction thereof shall be punished by imprisonment in the county jail for not to exceed six months or by a fine not to exceed five hundred dollars or by both such fine and imprisonment.
