Chapter 18.64 — O-S OPEN SPACE DISTRICT

§ 18.64.010. Intent.

  • (a) It is the intent of an O-S district:

    • (1) To provide for the long-range preservation of designated areas of public, quasi-public and private lands in open space for the health, safety and welfare of the public;

    • (2) To prohibit the construction, enlargement or encroachment of any existing or proposed structure, mobile home improvements, or developments of any kind that would, by their very construction, enlargement or establishment, diminish the existing natural open space values of such areas to the general public;

    • (3) To establish reasonable regulations and standards to assure maximum retention of natural amenities;

    • (4) For the long-range preservation for future generations of appropriate natural open space areas.

  • (b) The O-S, open space zone may be applied to various public, quasi-public and private lands deemed necessary to accomplish the purposes stated above.

§ 18.64.020. Uses permitted if under public ownership.

All uses permitted on lands and/or waters zoned O-S shall conform to the existing management policies of the governmental agency having primary jurisdiction over such open space zoned lands and/or waters.

§ 18.64.030. Uses permitted if under private ownership.

Uses permitted in an O-S district if under private ownership shall be as follows:

  • (1) Apiaries and open-field animal grazing limited to horses, cattle, sheep and goats, providing such grazing is not part of or conducted in con-junction with any dairy, commercial lot, or livestock sales yard, and; provided further, that no soil tillage, land clearing operation, or spoilation of forested areas is involved in connection with such uses;

  • (2) Equestrian, hiking, and bicycle trails, roads and other trails;

  • (3) The construction, installation, operation, and maintenance of public utility distribution and transmission lines, towers and poles, and underground lines or pipes for providing gas, water, electricity, or telephone and telegraph services by public utility companies under the jurisdiction of the Public Utilities Commission of the state of California, if environmentally acceptable, are declared to be compatible uses within the O-S, open space district; however, before any rightof-way for transmission lines or pipelines is acquired, the proposed route shall be submitted to the planning director for review and recommendation. It is not the intent of this section to allow the construction, installation, and maintenance of any type of energy generating facility, electric, gas or water distribution centers, service yards or equipment storage yard;

  • (4) Timber production and harvest;

  • (5) Wildlife refuge and game preserve;

  • (6) Scientific study sites for the systematic exploration and classification of archaeological, anthropological or historic artifacts or remains.

§ 18.64.040. Uses requiring use permit for private land.

Uses requiring a use permit for private land in an O-S district shall be as follows:

  • (1) Water collection, storage and distribution uses, including water wells, reservoirs, dams, gauging stations, pumping stations, settling basins, and ground water recharge areas;

  • (2) Road or trailside rest areas;

  • (3) Sewage treatment facilities. (Ord. 467 § 70, 1984)

§ 18.64.050. Area requirement.

Note: Ord. 2025-08, 11/18/2025 also repealed Ord. 467.

The O-S zone may be applied to any parcel, or portion thereof, however, no lot or parcel of land, and no contiguous lots or parcels of land, under one ownership at the effective date of the ordinance codified in this title, or which may come under one ownership within the O-S zone area any time after the effective date of the ordinance codified in this title, shall be divided, excepting in the case of

a conveyance or dedication of land to a governmental agency, public entity, or public utility for public purposes or public utility purposes. (Ord. 2025-08, 11/18/2025)
