2.85.010 - Creation—Members—Vote.

There is hereby created the environmental sustainability commission (commission) of the city of La Mesa. The commission shall consist of thirteen members. Six members shall be residents of the city of La Mesa with voting privileges, one member shall be a resident of the city of La Mesa or attend school in the city of La Mesa, and six members shall be advisory members from the business community without voting privileges. The six members that are residents of the city of La Mesa shall be comprised as follows: two members from the general populous; three members with professional experience related to environmental sustainability; one member representing the senior adult population (at the time of appointment shall be not less than fifty-five years of age); and one member representing the youth population (at the time of appointment or reappointment shall not be less than thirteen years nor more than twenty-one years of age and live or attend school in the city of La Mesa). Each of the seven members shall be entitled to one vote on matters before the commission. The six members from the business community shall be representatives from the city's water utility, franchise waste and recycling hauler, electricity and gas utility, San Diego Community Power, high school, and elementary/middle school district. These six members shall not be required to be residents of the city, but shall act as advisory members on the commission and shall not be entitled to vote. For purposes of this section, the phrase 'attending school' shall mean either public or private school, general or special education program (K-12 th grade), or college or university. It does not mean an independent special interest program (such as karate or ballet instruction).

2.85.020 - Appointment.

The mayor shall appoint the seven voting members of the commission with approval of the city council. The five advisory members from the business community shall be selected by their respective organizations.

2.85.030 - Terms of office.

The term of office for each appointed member shall be four years which shall commence on July 1 and terminate on June 30 four years thereafter. Members' terms shall be maintained so that not more than three terms expire in any given year; therefore, initially three members shall be appointed for a two-year term, three members shall be appointed for a three-year term, and one member shall be appointed for a four-year term.

2.85.040 - Filling vacancies.

Each vacancy on the commission shall be filled for the unexpired portion of the term vacated in the manner set forth in Section 2.85.020.

2.85.050 - Administrative services.

The city manager shall designate the department to provide clerical and administrative services as required.

2.85.060 - Resignation and removal of members.

Three consecutive absences shall constitute resignation of the member unless permission is secured before the third meeting or absence granted by the vote of not less than four members of the commission. Commission members shall serve at the pleasure of the city council and may be removed at the discretion of the city council by a majority vote.

2.85.070 - Mission, duties and functions.

The commission shall exercise the powers and duties as provided in this chapter. As directed by the city council, the commission shall advise the city council on how actions and policies of the city may preserve and enhance the quality of La Mesa's environment, address the effects of climate change and assist in the identification of measures that will improve environmental sustainability in La Mesa and the region.

2.85.080 - Meetings.

The commission shall meet at least once per month and shall adopt by majority vote such rules as it shall deem expedient for the conduct of business not contrary to other provisions and policies heretofore adopted by the city council. In October of each year the commission shall elect one of its members chairperson who shall hold office for one year.
