2.44.010 - Creation.¶
Pursuant to Government Code Section 65150, there is created a planning commission of the county.

2.44.020 - Members—Qualifications.¶
There shall be five members of the planning commission. The qualifications of the members shall be as follows: One member shall be registered to vote in supervisorial district 1; one member shall be registered to vote in supervisorial district 2; one member shall be registered to vote in supervisorial district 3; one member shall be registered to vote in supervisorial district 4; and one member shall be registered to vote in supervisorial district 5.

2.44.030 - Members—Ex officio.¶
The following are nonvoting ex officio members of the planning commission:
A. Planning director;
B. Public works director;
C. County health officer;
D. County counsel.

2.44.040 - Members—Selection—Term of office.¶
Members of the planning commission shall be appointed by majority vote of the board of supervisors. A member from each supervisorial district shall be appointed to serve for a term which shall expire on the last day of December in each even year.

2.44.050 - Members—Extension of terms.¶
By a majority vote, the board may extend the term of office of a member of the planning commission pending selection of his/her replacement. Such extension shall not exceed three months.

2.44.060 - Members—Removal.¶
Prior to the end of his/her term of office, a planning commission member may be removed from his/her seat upon majority vote of the board of supervisors.

2.44.080 - Officers.¶
A. During its first regular meeting in February of each year, the planning commission shall by majority vote select a chairman and vice-chairman to serve through the last meeting of the succeeding January. Should the office of chairman or vice-chairman become vacant, the planning commission may by majority vote appoint a new officer to serve for the balance of the term.
B. Prior to the end of his/her term of office, a planning commission officer may be removed by a majority vote of the members of the planning commission upon his/her conviction of a misdemeanor or felony, or his/her absence for three or more consecutive planning commission meetings.

2.44.090 - Duties.¶
The planning commission shall hold public hearings and meetings and make decisions and recommendations on land use matters to the board of supervisors as required by state law and local ordinance, including, but not limited to, decisions on zoning, general plan amendments, reclamation plans, conditional use permits, variances, divisions of land, and subdivisions.

2.44.100 - Decisions and recommendations.¶
A. Recommendations and decisions on zoning amendments, general plan amendments, reclamation plans, conditional use permits, variances, divisions of land and subdivisions shall be made by resolution. All other actions by the commission shall be by order of the commission.
B. All planning commission orders and resolutions shall be written and shall show how each member voted thereon.

2.44.110 - Actions—Requisite vote.¶
Planning commission resolutions must be passed by at least three members voting "aye" thereon. Failure to receive three "aye" votes constitutes a denial.

2.44.120 - Rules of procedure.¶
A. The planning commission may adopt rules of procedure to supplement the rules set forth in this chapter.
B. Any such rules shall be consistent with this chapter, Chapters 2.38 and 2.40 and with state law.

2.44.130 - Members—Compensation.¶
Compensation of planning commission members shall be set by resolution of the board of supervisors. Compensation may include reasonable traveling expenses to and from the place of meetings held by the commission.
