2.22.010 - Agency established.

This chapter establishes the Calaveras County environmental management agency, hereinafter referred to as "agency."

2.22.020 - Agency composition.

The "agency" shall include the departments of agriculture and weights and measures, air pollution control, environmental health and such other departments as may be deemed necessary by the board of supervisors.

2.22.025 - Authority of agency to issue citations.

The "agency" shall have the authority to issue citations for misdemeanor and infraction violations in connection with those programs under its jurisdiction where citation authority has not expressly been provided by statute.

2.22.030 - Agency responsibilities.

The "agency" shall provide administration and coordination with respect to the efforts, powers and duties of the component departments, as authorized by county code and state law.

2.22.040 - Agency head.

The head of the "agency" shall be a department head appointed by the county executive officer and shall direct and exercise general management, supervision, and policy authority over the component departments of the "agency." The "agency" head shall be known as the administrator of the Calaveras County Environmental Health Agency.

2.22.050 - Environmental health department—Designation—Delegation of powers and duties.

The environmental health department designation to be a component department of the "agency," a comprehensive environmental agency, as defined in the California Code of Regulations, Title 17, Section 1351. Such designation has been made pursuant to this chapter, with the concurrence of and with appropriate delegation of authority from the county health officer, as authorized by Health and Safety Code Section 101275, pursuant to the function of providing environmental health and sanitation services, under the general direction of the "agency." The functions so designated shall be maintained at levels of quality and efficiency equal to or higher than formerly provided. All personnel of the department charged with enforcement of orders, quarantines, rules, regulations and laws related to public health shall be qualified under and meet the minimum standards required by state law.

2.22.060 - Health officer defined—Delegation and retention of authority.

The term "health officer," as used in this chapter, refers to the health officer appointed by the health services agency direction. Through adoption of Resolution No. 94-433, the county health officer delegated to the director of environmental health such powers, duties, functions, and responsibilities as necessary to conduct and carry out environmental health and sanitation programs. Nothing in this chapter shall be deemed to limit or otherwise restrict the authority of the health officer during a state of emergency, and the health officer retains such authority as necessary to meet all state and local requirements and responsibilities relating to public health, as provided by state law. As used in this chapter, all provisions referring to "health officer" shall also be applicable to the director of environmental health.

2.22.070 - Director of environmental health—Qualifications.

The director of environmental health, hereinafter referred to as the "director," shall be appointed by and serve under the direction and authority of the agency head. Nothing in this chapter shall limit the director as serving as the agency head wherein the director shall be appointed by the county executive officer. The director shall possess the minimum qualifications specified in Title 17, Section 1355, Subchapter 2, Article 2 of the California Code of Regulations. The director shall have additional staff and managerial responsibilities, as directed and authorized by the board of supervisors, to assist in the performance of the duties of the department.
