2.10.010 - County executive officer.

There shall be a county executive officer (CEO), who shall be the head of the administrative branch of the county government and act as the county's administrative officer pursuant to Govt. Code Section 24000(t). Where the term "administrative coordinator," "county administrative officer," or "CAO" is used in any county ordinance, resolution, regulation, or other county enactment, it shall be deemed to mean "county executive officer."

2.10.020 - Purpose.

The purpose of this chapter is to establish the position of county executive officer and to define the nature, duties, responsibilities, and delegated authority of the position.

The CEO shall generally advise, assist, and act as agent for the board of supervisors, shall be responsible to the board for the proper and efficient administration of such affairs of the county that are placed in his or her charge by the board, and shall enforce ordinances, orders, and regulations as directed by the board.

2.10.030 - Appointment and removal.

The CEO shall be appointed by and serve at the pleasure of the board of supervisors. He or she will be appointed by a majority vote of the board of supervisors and shall enter into a contract with the board which shall include provisions addressing length of tenure, removal, and notice.

2.10.040 - Qualifications.

The CEO shall be chosen upon the basis of knowledge and skills in public administration, budgeting, personnel, and other relevant matters and shall have a combination of education and demonstrated experience to exhibit an ability to properly handle the breadth and depth of issues that face county government. These qualifications shall typically be met by a combination of educational training and management-level experience in public administration, fiscal management, and long-range planning.

2.10.050 - Salary and benefits.

The salary and other compensation of the CEO shall be established by the board of supervisors and shall be paid by the auditor-controller in the same manner as the salaries and benefits of other county employees.

2.10.060 - General powers and duties.

The CEO shall be the chief administrative officer of the county, may head one or more departments, and shall be responsible to the board of supervisors for the proper administration of all affairs of the county. To that end, the CEO shall have the power and shall be required to:

A. Supervise for the board of supervisors the administration of all county departments, offices, and institutions over which the board has responsibility and control. The CEO shall also act as the administrative officer for the board in administering all policies, procedures, departments, and institutions, including those departments in which the department head is an elected or appointed officer.

B. Attend all meetings of the board of supervisors, unless excused therefrom, prepare matters for the board's consideration and action, and make recommendations to the board on matters within his/her authority.

C. Coordinate development of the county's legislative platform and legislative advocacy efforts.

D. Perform other such duties as may be required by the board of supervisors, not inconsistent with state or federal law or county code, and delegate functions to appropriate staff.

E. Prepare and carry out administrative policies and procedures necessary to implement the directives, policies and goals established by the board relative to the operation of county government.

F. It shall be the duty of each department head, elected or appointed, to provide information relating to the administrative operation of his/her department, upon request of the CEO, and to follow the administrative policies and procedures of the county.

2.10.070 - Budget matters.

A. The CEO shall submit a proposed annual budget together with his/her recommendations to the board of supervisors for consideration and adoption. He/she shall supervise and direct preparation of the budget and review and evaluate all items including expenditures, revenues, and services.

B. The CEO shall work closely with the county auditor-controller in the preparation and execution of the county's budget.

C. After final adoption of the budget by the board of supervisors, the CEO shall administer the budget and exercise continuous expenditure control. He/she shall review all requests for appropriations and transfers and make recommendations to the board. He/she shall supervise expenditures of all county offices, departments, and institutions, including those departments in which the department head is an elected or appointed officer.

2.10.080 - Personnel administration.

The CEO is the county's personnel officer and may delegate related duties to one or more subordinates. He or she shall:

A. Supervise and evaluate the performance of all county departments, within the limitations established by state law or the board of supervisors, by establishing standards, goals, and objectives for departmental performance and measuring performance against these standards, goals, and objectives.

B. Assign projects to departments and review departmental expenditures to assure that they are necessary and proper.

C. Employ assistants and/or utilize or coordinate the personnel of other County officers and utilize the services of outside expert facilities and services where appropriate.

D. Appoint, transfer, discipline, and dismiss all non-elected department heads except as specifically required by law; such department heads shall serve at the pleasure of the CEO and the board of supervisors hereby delegates its authority to appoint, remove, and supervise such non-elected department heads to the CEO. For the positions for which the CEO is not the appointing authority under this chapter, unless otherwise stated in County Code, the CEO shall: (1) recommend to the board of supervisors the appointment of a qualified candidate to fill any vacancy occurring in that department head position and obtain the board's concurrence, and (2) recommend to the board of supervisors, for its consideration and determination, the transfer, discipline, or dismissal of such department head, when appropriate.

E. Evaluate the on-the-job performance of each department head, except for elected department heads, at least once annually and prepare a written record of his or her review.

2.10.090 - Purchasing.

The CEO is the county's purchasing agent, shall supervise and direct the administration of purchasing staff, and shall establish procedures for the efficient and cost-effective purchase of county supplies and goods, including fixed assets.

2.10.100 - Other duties, responsibilities, and powers.

A. The CEO shall perform such investigations, studies, or surveys as the board of supervisors may request or as he/she deems necessary for the efficient use of manpower, material, facilities, and services.

B. The CEO shall coordinate the planning, design and construction of physical facilities and assignment of space required for county services. He/she shall prepare, and keep current, a capital improvement plan, including recommended methods for financing, for adoption by the board of supervisors.

C. The CEO shall recommend to the board of supervisors such organizational and staffing plans and proposals as, in his/her judgment, are necessary and desirable in order to efficiently provide county services. Such recommendations may include transfers, reassignments or consolidation of functions and services.

D. The CEO shall represent the board of supervisors in matters relating to relationships with other governmental entities and enunciate and carry out the policies and views of the board.

E. The CEO shall supervise and direct all central administrative services (e.g., information technology, building and grounds operations, etc.) as may be placed under his/her supervision by the board of supervisors.

F. In cooperation with the county clerk, the CEO shall prepare the board agenda, evaluate departmental and other requests to determine if such requests should be submitted to the board, and make recommendations to the board on matters within his/her authority.

G. The CEO shall supervise the performance of county departments, within the limitations established by state law or the board of supervisors, by coordinating the establishment of mutually acceptable standards, goals, and objectives for quality and quantity of departmental performance.

H. The CEO shall have such additional powers and duties as established by resolution of the board of supervisors.

I. This chapter shall not delegate to the CEO any duty otherwise delegated or imposed on any other County office or department by any federal or state statute or regulation.

2.10.110 - Limitations of chapter.

The board of supervisors intends to delegate to the CEO, to the maximum extent authorized by law, the authority to manage and coordinate the operations of the County's various departments, offices, and agencies. However, no provision of this chapter is intended to vest in the CEO the exercise of any duty specifically conferred by law on another officer of the County.

2.10.120 - Severability.

If any section, sentence, clause, or phrase of the ordinance codified in this chapter is for any reason held to be unconstitutional or invalid, such decision shall not affect the validity of the remaining portion of this chapter. The board of supervisors declares that it would have passed this chapter and each section, subsection, sentence, clause, or phrase thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses, or phrases are declared unconstitutional or otherwise invalid.
