AB 1359 amends PRC Section 3715.5, which designates the Geologic Energy Management Division in the Department of Conservation as CEQA lead agency for all geothermal exploratory projects. Existing law authorizes the Geologic Energy Management Division to delegate lead agency authority to a county when that county has adopted a geothermal element in its general plan.
The bill would allow the applicant for such a project request that the Geologic Energy Management Division be the lead agency for that project in any county, including ones with a geothermal element. When the county is the lead agency it would be required to confer with the Geologic Energy Management Division regarding the Geologic Energy Management Division’s role as a responsible agency.
