2.44.010 - Payment of expenses incurred by city.

Whenever an application or petition is made to the city council for vacation of a street, alley or highway, or for the offering for sale of a franchise, or for the doing of any other act, other than street work, that is not mandatory for the city council to do, requiring the expenditure of money by the city for printing, posting, advertising and other incidental expenses connected therewith, the city clerk shall estimate the probable expense which the city will incur for such printing, posting, advertising and incidental expenses upon the granting of such application or petition, until the applicant has deposited with the city clerk the amount of such estimated expenses. Such deposit shall be either by cash or certified check payable to the city, and shall be applied in payment of the expense of printing, posting, advertising and other incidental expenses necessitated by the filing of the petition or application. Any overplus remaining after the payment of costs shall be refunded to the depositor thereof.
