What are the mandatory construction and demolition (C&D) waste diversion and documentation requirements?
Homeowners: California’s Green Code requires projects to recycle or salvage at least 65% of nonhazardous construction and demolition waste (unless local rules are stricter). You must either submit a construction waste plan, hire an approved waste company that can verify diversion, or meet an approved waste‑reduction alternative — and you must keep & submit documentation (weight/volume records, receipts, or company verification) to the enforcing agency.

What the code requires — 2–4 sentences
CALGreen requires that projects recycle and/or salvage for reuse a minimum of 65 percent of nonhazardous construction and demolition (C&D) waste unless a more stringent local ordinance applies — this is the core mandatory requirement § 4.408.1 . Compliance may be met by using a construction waste management plan, by contracting with an approved waste management company, or by meeting an approved waste stream reduction alternative; documentation proving compliance must be submitted to the enforcing agency under § 4.408.5 . The waste diversion amounts must be calculated by weight or by volume — but not both (requirement in the CWM plan) .
The single most important rule: recycle or salvage at least 65% of nonhazardous C&D waste (see § 4.408.1) and keep documentation proving you used one of the allowed compliance paths.
Requirements in detail
1) What must be achieved (the performance target)
- Target: Recycle and/or salvage for reuse a minimum of 65 percent of nonhazardous C&D waste unless a stricter local ordinance applies — § 4.408.1 .

3) Required documentation and availability
- You must provide documentation to the enforcing agency that demonstrates compliance with the selected compliance route — specifically compliance with § 4.408.2 Items 1–5 (if using a CWM plan), § 4.408.3 (if using a waste management company), or § 4.408.4 (if using the waste stream reduction alternative) — see § 4.408.5 .
- The CWM plan must be kept updated and available during construction for examination by the enforcing agency (see § 4.408.2) .

4) What the CWM plan must include (if you choose that route)
The CWM plan must, at minimum:
- Identify the C&D materials to be diverted (what types) — § 4.408.2 Item 1 .
- Specify whether materials are source-separated (on-site sorting) or bulk mixed (single-stream) — § 4.408.2 Item 2 .
- Identify the diversion facilities where materials will be delivered — § 4.408.2 Item 3 .
- Identify construction methods used to reduce C&D generation — § 4.408.2 Item 4 .
- Specify that diversion quantities will be calculated by weight or volume, but not both — § 4.408.2 Item 5 .
Exceptions & special cases
- Excavated soil and land‑clearing debris are excluded from the 65% requirement per the explicit exceptions in § 4.408.1 .
- The code allows alternate waste reduction methods where diversion or recycling facilities capable of compliance do not exist or are not reasonably close; the enforcing agency may make exceptions for isolated jobsites beyond the haul boundary of diversion facilities — see § 4.408.1 Exceptions .

Common mistakes
- Counting excavated soil toward the 65% target — the code excludes it; don’t include it in diversion calculations § 4.408.1 .
- Mixing weight and volume in the same calculation. The plan must declare and stick to either weight or volume, not both — § 4.408.2 Item 5 .

Worked example — concrete scenario using numbers
Scenario: A 10,000 sq ft residential new construction generates C&D debris (nonhazardous) during construction.
- Project chooses weight as the calculation method (per § 4.408.2 Item 5) .
- Total nonhazardous C&D waste generated (gross) = 60 tons. Excavated soil and land‑clearing debris are excluded from this total per § 4.408.1 Exceptions (assume those were accounted separately) .
- To meet the 65% diversion target (per § 4.408.1), the project must divert: 0.65 × 60 tons = 39.0 tons. Deliver receipts and weight tickets proving at least 39.0 tons were sent to recycling/salvage facilities or reused on-site .
- Documentation chain to provide under § 4.408.5: CWM plan onsite (identifying materials and calculation method), facility weight tickets for recyclables, and either a verification report from an approved waste management company or consolidated diversion reporting showing >=39 tons diverted .
- If the project used a waste management company, ensure that company is approved by the enforcing agency and can produce verifiable documentation linking facility receipts to the project as required by § 4.408.3 .

Projects that generate a total combined weight of construction and demolition waste disposed of in landfills, which do not exceed 3.4 pounds per square foot of the building area shall meet the minimum 65 percent construction waste reduction requirement in Section 4.408.1.

SECTION 5.408—CONSTRUCTION WASTE REDUCTION, DISPOSAL AND RECYCLING
5.408.1 Construction waste management. Recycle and/or salvage for reuse a minimum of 65 percent of the nonhazardous construction and demolition waste in accordance with Section 5.408.1.1, 5.408.1.2 or 5.408.1.3; or meet a local construction and demolition waste management ordinance, whichever is more stringent.
5.408.1.1 Construction waste management plan. Where a local jurisdiction does not have a construction and demolition waste management ordinance that is more stringent, submit a construction waste management plan that:
Identifies the construction and demolition waste materials to be diverted from disposal by efficient usage, recycling, reuse on the project or salvage for future use or sale.
Determines if construction and demolition waste materials will be sorted on-site (source-separated) or bulk mixed (single stream).
Identifies diversion facilities where construction and demolition waste material collected will be taken.
Specifies that the amount of construction and demolition waste materials diverted shall be calculated by weight or volume, but not by both.
5.408.1.2 Waste management company. Utilize a waste management company that can provide verifiable documentation that the percentage of construction and demolition waste material diverted from the landfill complies with this section.
Note: The owner or contractor shall make the determination if the construction and demolition waste material will be diverted by a waste management company.
Exceptions to Sections 5.408.1.1 and 5.408.1.2:

4.410.1 Operation and maintenance manual. At the time of final inspection, a manual, compact disc, web-based reference or other media acceptable to the enforcing agency which includes all of the following shall be placed in the building:
Directions to the owner or occupant that the manual shall remain with the building throughout the life cycle of the structure.
Operation and maintenance instructions for the following: a. Equipment and appliances, including water-saving devices and systems, HVAC systems, photovoltaic systems, electric vehicle chargers, water-heating systems and other major appliances and equipment. b. Roof and yard drainage, including gutters and downspouts. c. Space conditioning systems, including condensers and air filters. d. Landscape irrigation systems.
e. Water reuse systems. 3. Information from local utility, water and waste recovery providers on methods to further reduce resource consumption, including recycle programs and locations. 4. Public transportation and/or carpool options available in the area. 5. Educational material on the positive impacts of an interior relative humidity between 30–60 percent and what methods an occupant may use to maintain the relative humidity level in that range. 6. Information about water-conserving landscape and irrigation design and controllers which conserve water. 7. Instructions for maintaining gutters and downspouts and the importance of diverting water at least 5 feet away from the foundation.

SECTION A5.408—CONSTRUCTION WASTE REDUCTION, DISPOSAL AND RECYCLING
A5.408.3.1 Enhanced construction waste reduction – Tier 1. Divert to recycle or salvage at least 65 percent of nonhazardous construction and demolition waste generated at the site. Any mixed recyclables that are sent to mixed-waste recycling facilities shall include a qualified third party verified facility average diversion rate. Verification of diversion rates shall meet minimum certification eligibility guidelines, acceptable to the local enforcing agency.
A5.408.3.1.1 Enhanced construction waste reduction – Tier 2. Divert to recycle or salvage at least 80 percent of nonhazardous construction and demolition waste generated at the site.
A5.408.3.1.2 Verification of compliance. A copy of the completed waste management report or documentation of certification of the waste management company utilized shall be provided.

A5.409.1 Scope. Projects with the area limits specified shall comply with Section A5.409.1 to achieve Tier 1 or Tier 2 compliance. Projects of any size shall comply with Section A5.409.5 to achieve Tier 2 compliance.
Projects consisting of newly constructed building(s) with a combined floor area of 50,000 square feet or greater shall comply with either Section A5.409.2 or Section A5.409.3.
Alteration(s) to existing building(s) where the combined altered floor area is 50,000 square feet or greater shall comply with either Section A5.105.2, Section A5.409.2 or Section A5.409.3.
Addition(s) to existing building(s) where the total floor area combined with the existing building(s) is 50,000 square feet or greater shall comply with either Section A5.105.2, Section A5.409.2 or Section A5.409.3. Exception: Combined addition(s) to existing building(s) of two times the area or more of the existing building(s) is not eligible to meet compliance with Section A5.105.2.

5.408.2 Universal waste. [A] Additions and alterations to a building or tenant space that meet the scoping provisions in Section 301.3 for nonresidential additions and alterations, shall require verification that Universal Waste items such as fluorescent lamps and ballast and mercury containing thermostats as well as other California prohibited Universal Waste materials are disposed of properly and are diverted from landfills. A list of prohibited Universal Waste materials shall be included in the construction documents.

5.408.3 Excavated soil and land clearing debris. 100 percent of trees, stumps, rocks and associated vegetation and soils resulting primarily from land clearing shall be reused or recycled. For a phased project, such material may be stockpiled on site until the storage site is developed.
Exception: Reuse, either on-site or off-site, of vegetation or soil contaminated by disease or pest infestation.

Frequently asked questions
What counts as “nonhazardous construction and demolition waste”?
Nonhazardous C&D waste generally includes common construction materials (wood, metal, drywall, concrete, cardboard, etc.). Hazardous wastes and excluded items (for example, excavated contaminated soil) are not counted toward the 65% target; consult the enforcing agency for classification questions. § 4.408.1 notes the exclusion for excavated soil and land‑clearing debris.
Can I use a single hauler for mixed (commingled) waste?
Yes—projects may use bulk mixed (single‑stream) collection if identified in the CWM plan, but you must provide verifiable documentation of diversion rates from the processor or use source‑separation to control diversion accounting; the plan must state whether materials will be source‑separated or bulk mixed (§ 4.408.2 Item 2) .
Do I have to pick weight or volume in advance?
Yes — the CWM plan must specify whether diversion will be calculated by weight or by volume, and you must not mix the two for calculations (§ 4.408.2 Item 5) .
What documentation does the enforcing agency expect at final inspection?
Documentation demonstrating compliance with your selected path: an updated CWM plan (if used), facility receipts/weight tickets or waste company verification showing the diversion percentage, and any waste‑stream reduction calculations if using that alternative — see § 4.408.5.
What if local ordinance is stricter than CALGreen?
You must follow the more stringent local ordinance; CALGreen expressly defers to stricter local C&D waste management laws in § 4.408.1.
