What the code requires — 2-4 sentences
Only the green-building standards that are effective at the time an application for a building permit is submitted apply to that permit — this is the controlling effective‑date rule (§ 101.9) .

Practical checklist (use this before plan submittal)
- Confirm your permit application submission date and record it (effective‑date trigger). § 101.9
- Identify the type of occupancy and the state agency with jurisdiction (steps 1–3 in § 101.11) .

Exceptions & special cases
- Phased projects (shell + tenant improvements): only measures relevant to the building components considered new construction apply to that phase; initial tenant improvements are governed by the scoping rules in § 303.1 (phased projects) .
- State agencies may adopt only selected sections; the Matrix Adoption Tables indicate which sections each agency adopts as mandatory — this changes which measures are mandatory for that agency’s regulated buildings (see Chapter 4/5 Matrix tables) .
- Voluntary tiers and voluntary measures are intended to be adopted by local jurisdictions by ordinance if they want them enforced; absent local adoption, those measures remain elective (see Appendix A4 “model ordinance” and § 304 on voluntary tiers) .
- Where an agency (e.g., DSA‑SS) chooses not to adopt certain Chapter 5 mandatory measures, those items may be treated as recommended voluntary measures for that agency’s projects (see the notes in Chapter 3 and Appendix A5) .
Common mistakes
- Misreading the effective date: applying the code version based on permit issuance rather than permit application submission (the correct trigger is submission per § 101.9) .
- Assuming voluntary tiers (Tier 1/2) are automatically enforceable statewide — they must be adopted locally to become mandatory in that jurisdiction; otherwise they are optional for the project team (Appendix A4/A5 guidance) .
- Failing to check the Matrix Adoption Tables for agency‑specific mandatory adoptions and exceptions; the Matrix determines which Chapter sections are actually mandatory for a given state agency’s projects .
- Trying to claim Tier compliance without first meeting all Chapter mandatory measures — Appendix checklists make meeting mandatory requirements a prerequisite to Tier verification .
Worked example — concrete scenario
Scenario: A developer submits a building‑permit application for a 10,000 ft² office TI on September 15, 2025. A new mandatory water‑efficiency requirement is adopted and becomes effective October 1, 2025. The city adopted CALGreen Appendix A5 Tier 1 as a local ordinance on August 1, 2025.
How to apply the rules:
- Effective edition: Because the permit application was submitted on September 15, 2025, only standards effective on that date control the permit — the Oct 1 change does not apply to this permit (§ 101.9) .
- Mandatory vs voluntary: Consult the application checklist for nonresidential occupancies (appendix A5). The checklist will show which measures in Chapter 5 were mandatory as of Sept 15 and which were voluntary (§ 101.10) .
- Local Tier adoption: Because the city adopted Appendix A5 Tier 1 by ordinance on Aug 1, 2025, Tier 1 measures are mandatory in that city for projects subject to the ordinance — the project will need to satisfy Tier 1 if the local ordinance applies to this TI (appendix adoption model and § 304 guidance) .
- Verification: Follow the A5 Tier 1 checklist and ensure all Chapter 5 mandatory measures (as of Sept 15) are met first; then document Tier selections on the verification checklist for plan review .
Numbers: if Tier 1 requires, for example, 8 measures (prereqs + electives) and the checklist counts mandatory Chapter 5 items as separate Y/N entries, the project must show all required Ys and signatures on the checklist to demonstrate compliance with local Tier adoption (see Appendix verification format) .

ADMINISTRATION
101.9 Effective date of this code. Only those standards approved by the California Building Standards Commission that are effective at the time an application for a building permit is submitted shall apply to the plans and specifications for, and to the construction performed under, that permit. For the effective dates of the provisions contained in this code, see the appropriate application checklist and the History Note page of this code.
101.10 Mandatory requirements. This code contains both mandatory and voluntary green building measures. Mandatory and voluntary measures are identified in the appropriate application checklist contained in this code.
101.11 Effective use of this code. The following steps shall be used to establish which provisions of this code are applicable to a specific occupancy:
- Establish the type of occupancy.
- Verify which state agency has authority for the established occupancy by reviewing the authorities list in Sections 103 through 106.
- Once the appropriate agency has been identified, find the chapter which covers the established occupancy.
- The Matrix Adoption Tables at the beginning of Chapters 4 and 5 identify the mandatory green building measures necessary to meet the minimum requirements of this code for the established occupancy.
- Voluntary tier measures are contained in Appendix Chapters A4 and A5. A checklist containing each green building measure, both required and voluntary, is provided at the end of each appendix chapter. Each measure listed in the application checklist has a section number which correlates to a section where more information about the specific measure is available.
- The application checklist identifies which measures are required by this code and allows users to check off which voluntary items have been selected to meet voluntary tier levels if desired or mandated by a city, county, or city and county.
SECTION 102—CONSTRUCTION DOCUMENTS AND INSTALLATION VERIFICATION
102.1 Submittal documents. Construction documents and other data shall be submitted in one or more sets with each application for a permit. Where special conditions exist, the enforcing agency is authorized to require additional construction documents to be prepared by a licensed design professional and may be submitted separately.
Exception: The enforcing agency is authorized to waive the submission of construction documents and other data not required to be prepared by a licensed design professional.
102.2 Information on construction documents. Construction documents shall be of sufficient clarity to indicate the location, nature and scope of the proposed green building feature and show that it will conform to the provisions of this code, the California Building Standards Code and other relevant laws, ordinances, rules and regulations as determined by the enforcing agency.
102.3 Verification. Documentation of conformance for applicable green building measures shall be provided to the enforcing agency. Alternate methods of documentation shall be acceptable when the enforcing agency finds that the proposed alternate documentation is satisfactory to demonstrate substantial conformance with the intent of the proposed green building measure.

- The city, county, or city and county shall obtain California Energy Commission approval for any energy- related ordinances consistent with Public Resources Code Section 25402.1(h)(2) and Title 24, Part 1, Section 10-106. Local governmental agencies may adopt and enforce energy standards for newly constructed buildings, additions, alterations and repairs, provided the California Energy Commission finds that the standards will require buildings to be designed to consume no more energy than permitted by Part 6. Such local standards include, but are not limited to, adopting the requirements of Part 6 before their effective date, requiring additional energy conservation measures, or setting more stringent energy budgets.
101.8 Alternate materials, designs and methods of construction. The provisions of this code are not intended to prevent the use of any alternate material, appliance, installation, device, arrangement, method, design or method of construction not specifically prescribed by this code, provided that any such alternative has been approved. An alternate shall be approved on a case-by-case basis where the enforcing agency finds that the proposed alternate is satisfactory and complies with the intent of the provisions of this code and is at least the equivalent of that prescribed in this code in planning and design, energy, water, material conservation and resource efficiency, environmental air quality, performance, safety and the protection of life and health. Consideration and compliance provisions for occupancies regulated by adopting state agencies are found in the sections listed below.

A4.701.1 General. The voluntary measures of this code are designed and promulgated to be adopted by reference and made mandatory by local ordinance pursuant to Section 101.7. Jurisdictions wishing to adopt the voluntary provisions of this code as an enforceable regulation governing structures and premises should ensure that certain factual information is included in the adopting ordinance and that the measures are appropriate and achievable and are considered to be suitable as mandatory by the city, county, or city and county. The following sample adoption ordinance addresses several key elements of a code adoption ordinance, including the information required for insertion into the code text.
This code does not limit the authority of city, county, or city and county government to make necessary changes to the provisions contained in this code.

SECTION 306 [DSA-SS]—VOLUNTARY MEASURES
306.1 Purpose. For public schools and community colleges, voluntary measures further encourage building practices that improve public health, safety and general welfare by promoting the use of building concepts which minimize the building’s impact on the environment and promote a more sustainable design.
306.1.1 Appendix A5, Divisions A5.1 through A5.5, outline means of achieving enhanced sustainable design and construction by incorporating voluntary measures that exceed the mandatory measures.
306.1.2 Chapter 5 Nonresidential Mandatory Measures that are not adopted as mandatory measures by DSA-SS are voluntary measures recommended and encouraged for the design, construction, verification and maintenance of non-energy systems.

5 NONRESIDENTIAL MANDATORY MEASURES
DIVISION 5.1 – PLANNING AND DESIGN
SECTION 5.101—GENERAL
5.101.1 Scope. The provisions of this chapter outline planning, design and development methods that include environmentally responsible site selection, building design, building siting and development to protect, restore and enhance the environmental quality of the site and respect the integrity of adjacent properties.

5.105.1 Scope.
[BSC-CG] Effective July 1, 2024, alteration(s) to existing building(s) where the combined altered floor area is 100,000 square feet or greater shall comply with either Section 5.105.2, 5.409.2, or 5.409.3. Addition(s) to existing building(s) where the total floor area combined with the existing building(s) is 100,000 square feet or greater shall comply with either Section 5.105.2, Section 5.409.2, or Section 5.409.3. Effective January 1, 2026, the combined floor area shall be 50,000 square feet or greater.
[DSA-SS] Alteration(s) to existing building(s) where the combined altered floor area is 50,000 square feet or greater shall comply with either Section 5.105.2, 5.409.2, or 5.409.3. Addition(s) to existing building(s) where the total floor area combined with the existing building(s) is 50,000 square feet or greater shall comply with either Section 5.105.2, Section 5.409.2, or Section 5.409.3.
Exception [BSC-CG, DSA-SS]: Combined addition(s) to existing building(s) of two times the area or more of the existing building(s) is not eligible to meet compliance with Section 5.105.2.

CALGreen VERIFICATION GUIDELINES
TIER 1 CHECKLIST
Application: This checklist shall be used for nonresidential projects that meet the following: new construction, or building additions of 1,000 square feet or greater, or building alterations with a permit valuation of $200,000 or more pursuant to Section 301.3, AND are adopting Tier 1 voluntary measures.
Note: All applicable mandatory requirements in Chapter 5 shall be met prior to applying Tier 1 voluntary measures.
Instructions:
Comply with all Tier 1 prerequisite measures from the various categories shown on the table below.
Add a “ Y ” to all mandatory and Tier 1 prerequisite measures in the appropriate columns.
Select the required number of additional electives from those categories shown on the table below and add a “ Y ” on the selected elective and add an “ N ” on the rest.
Count the total number of Tier 1 prerequisite measures plus the additional electives and write down the total number at the end of the checklist. Determine if the required number of Tier 1 measures have been selected to achieve Tier 1 compliance.

SECTION 304—VOLUNTARY TIERS
304.1 Purpose. Voluntary tiers are intended to further encourage building practices that improve public health, safety and general welfare by promoting the use of building concepts which minimize the building’s impact on the environment and promote a more sustainable design.
304.1.1 Tiers. The provisions of Divisions A4.6 and A5.6 outline means, in the form of voluntary tiers, for achieving enhanced construction levels by incorporating additional measures for residential and nonresidential new construction. Voluntary tiers may be adopted by local governments and, when adopted, enforced by local enforcing agencies. Buildings complying with tiers specified for each occupancy contain additional prerequisite and elective green building measures necessary to meet the threshold of each tier. See Section 101.7 of this code for procedures and requirements related to local amendments, additions or deletions, including changes to energy standards.
[BSC & HCD] Where there are practical difficulties involved in complying with the threshold levels of a tier, the enforcing agency may grant modifications for individual cases. The enforcing agency shall first find that a special individual reason makes the strict letter of the tier impractical and that modification is in conformance with the intent and purpose of the measure. The details of any action granting modification shall be recorded and entered in the files of the enforcing agency.
SECTION 305 [OSHPD 1]— CALGreen TIER 1 AND CALGreen TIER 2
305.1 CALGreen Tier 1 and CALGreen Tier 2 buildings contain voluntary green building measures necessary to meet the threshold of each level.
305.1.1 CALGreen Tier 1. To achieve CALGreen Tier 1, buildings must comply with the latest edition of “Savings By Design, Healthcare Modeling Procedures” found online at http://www.energysoft.com/main/page_ downloads_ sbd_healthcare.html.
305.1.2 CALGreen Tier 2. To achieve CALGreen Tier 2, buildings must exceed the latest edition of “Savings By Design, Healthcare Modeling Procedures” by a minimum of 15 percent.
SECTION 306 [DSA-SS]—VOLUNTARY MEASURES
306.1 Purpose. For public schools and community colleges, voluntary measures further encourage building practices that improve public health, safety and general welfare by promoting the use of building concepts which minimize the building’s impact on the environment and promote a more sustainable design.
306.1.1 Appendix A5, Divisions A5.1 through A5.5, outline means of achieving enhanced sustainable design and construction by incorporating voluntary measures that exceed the mandatory measures.
306.1.2 Chapter 5 Nonresidential Mandatory Measures that are not adopted as mandatory measures by DSA-SS are voluntary measures recommended and encouraged for the design, construction, verification and maintenance of non-energy systems.
Note: The building commissioning requirements for energy efficiency specified in the California Energy Code are required.

Who decides whether a voluntary CALGreen measure becomes mandatory in my city?
A local government does — voluntary measures and tiers in Appendices A4/A5 are designed to be adopted by reference and made mandatory by local ordinance; see the model adoption guidance and § 304/Appendix A4/A5.
If I submit a permit application before a new CALGreen rule's effective date, do I ever have to comply with it?
No — only standards effective at the time your application for a building permit is submitted apply to that permit (the later‑effective rule does not apply to that permit) per § 101.9.
Where on the code do I look to tell whether a specific measure is mandatory?
Check the application checklist for your occupancy and the Matrix Adoption Tables (Ch. 4 & 5); mandatory vs voluntary is explicitly identified on the application checklist as described in § 101.10 and § 101.11.
Can a state agency treat a Chapter 5 “mandatory” measure as voluntary for its projects?
Yes — the Matrix Adoption Tables show agency adoptions; some agencies may not adopt every Chapter 5 section, and the code notes which sections are not adopted by certain agencies (see Matrix Adoption Tables).
Must I satisfy Chapter mandatory measures before claiming Tier compliance?
Yes — the Appendix Tier verification checklists require that applicable mandatory measures be met prior to applying Tier voluntary measures (see Appendix A5 verification notes).
