13.36.010 - Elm leaf beetle declared nuisance.¶
On the basis of reports to the city council by the commissioner of agriculture of the county, the council finds and determines that elm trees throughout areas of the city are presently infested with an insect pest commonly referred to as the elm leaf beetle; that such infestation seriously endangers such trees and is declared to be a public nuisance and unless measures are taken to control and eliminate same, can result in the destruction of, or serious injury to, all elm trees in the city.

13.36.020 - Treatment of diseased trees.¶
The city manager in cooperation with the commissioner of agriculture of the county, and such other government agencies and officials as may be proper, is authorized and directed to cause measures to be taken to spray, apply insecticides or take other appropriate action as may be necessary to treat elm trees or other infected trees and plants in the city in order to exterminate and eradicate the infestation of elm leaf beetles. Where such infestation of trees exists on private property, written notice shall be given to the owner, or person in control of such property, and thereupon the city manager is authorized to cause such trees to be sprayed or otherwise treated for such infestation.
