13.120.010 - Open container prohibited on posted property.

No person shall have in his or her possession any bottle, can or other receptacle containing any alcoholic beverage which has been opened, or a seal broken or the contents of which have been partially removed, while on the posted premises of, including the posted parking lot immediately adjacent to, any retail off-sale alcoholic beverage licensee licensed pursuant to Division 9 (commencing with Section 23000) of the Business and Professions Code, or on any public sidewalk immediately adjacent to the licensed and posted premises.

13.120.020 - Consumption of alcohol prohibited.

Except as otherwise specifically permitted by the city, no person may consume in any public place not licensed for the consumption thereof, any alcoholic beverages, upon any street, sidewalk, public park, transit facility playground, city-owned facility, or in any public place, or in any place open to the patronage of the public, which premises are not licensed for the consumption of such alcoholic beverages on the premises. Any person violating any provision of this subsection shall be guilty of a misdemeanor or an infraction.

13.120.030 - Open container prohibited in public places.

Except as otherwise specifically permitted by the city, no person may possess in any public place not licensed for the possession thereof, any bottle, can or other receptacle containing any alcoholic beverage which has been opened, or a seal broken, or the contents of which have been partially removed, upon any street, sidewalk, public park, transit facility, playground, city-owned facility, or in any public place, or in any place open to the patronage of the public, which premises are not licensed for the possession of such alcoholic beverage on the premises. Any person violating any provision of this subsection shall be guilty of a misdemeanor or an infraction.

13.120.040 - Misdemeanor violations.

Any person violating the provisions, or failing to comply with any of the requirements, of this chapter shall be guilty of a misdemeanor as provided in chapter 1.04 of the Victorville Municipal Code.

13.120.050 - Administrative citation.

The city manager or his designee may issue an administrative citation and/or assess an administrative fine for the violation of any of the provisions of this Chapter as provided in chapter 1.05 of the Victorville Municipal Code.

13.120.060 - Continuing violations.

Each day a violation of this chapter is committed or permitted to continue shall constitute a separate offense.

13.120.070 - Remedies cumulative.

The remedies provided in this chapter are not to be construed as exclusive remedies and, in the event of violation, the city may pursue any proceedings or remedies otherwise provided by law.
