Article XV — Appeals

A. Any person aggrieved or dissatisfied with the action of the zoning administrator on a request for a variance, conditional use permit, or other action resulting from the administration of this chapter may appeal therefrom the planning and design commission within ten days after a decision has been made by the zoning administrator.

• B. The appeal shall be taken by filing a written notice of appeal with the zoning administrator and payment of a fee as established by the city fee and charge report.

C. Upon the filing of a notice of appeal, the zoning administrator shall, within ten days, transmit to the secretary of the planning and design commission all exhibits and other papers and documents on file with the zoning administrator. The planning and design commission shall hold a hearing on the appeal and may affirm, modify or reverse the action or decision of the zoning administrator. A. Any person aggrieved or dissatisfied with any action of the planning and design commission on a variance, conditional use permit or any other planning and design commission action or permit under this chapter, may appeal therefrom to the city council at any time within ten days after rendition of the decision of the planning and design commission; provided that, except as otherwise expressly allowed herein, no appeal of a planning and design commission decision on an appeal of a zoning administrator's decision shall be allowed.

B. The appeal shall be taken by filing a notice of appeal with the planning director. Upon the filing of a notice of appeal and payment of a filing fee as established by the city fee and charge report, the planning director shall, within ten days therefrom transmit to the city clerk all exhibits and other papers and documents on file with the planning and design commission, together with any findings of the commission.

• The city council shall hold a hearing on the appeal and may affirm, modify or reverse the action of the planning and design commission. (Ord. 2013-0021 § 81; Ord. 2012-004 § 50; prior code § 3.16.241)

Appeals from any decision of the construction codes advisory appeals board under this chapter shall be taken in the manner provided by Chapter 1.24 of this code. (Prior code § 3.16.242)

To the extent that the provisions of this chapter are not inconsistent therewith, the procedural requirements of Chapter 17.812 of this code govern any hearing required by this chapter. When deciding to affirm, modify, or reverse the action or decision appealed, the planning director, the planning and design commission, and the city council shall not consider the content or graphic design of messages other than to determine legality under federal or state law.
