2.56.010 - Applicability of California Code of Civil Procedures Section 1094.6.

Section 1094.6 of the California Code of Civil Procedure is applicable to the decisions of the city council, and of any department, board, commission, officer or agent of the city suspending, demoting or dismissing an officer or employee, revoking or denying an application for a permit, license or other entitlement or denying an application for any retirement benefit or allowance which is subject to the judicial review pursuant to Section 1094.5 of the California Code of Civil Procedure.

2.56.020 - Notice of time limit within which review can be sought—Required.

The city council, and any department, board, commission, officer or agent of the city which makes such a decision shall give notice to the affected party that the time in which to seek judicial review of such decision is governed by Section 1094.6 of the California Code of Civil Procedure. In the event that the decision is reviewable by the city council or another department, board, commission, officer or agent of the city, such notice shall in addition specify the time within which the affected party may seek such review.

2.56.030 - Notice—Form.

Such notice as is required by this chapter shall be in written form and given in accord with the provisions of Section 1.04.080. Notice shall be deemed, for all purposes, to have been given at the time of personal service or when deposited in the custody of the United States Postal Service.
