2.12.010 - Authority.

A. In accordance with Penal Code § 836.5, the employees of the city designated by the city manager as code enforcement officers of the city, are authorized to arrest without a warrant a person violating any provisions of this code whenever such a code enforcement officers have reasonable cause to believe that the person to be arrested has violated that provision in the officer's presence. The aforementioned power of arrest if further given to a code enforcement officer for all offenses classified as misdemeanors or infractions appearing anywhere in this code.

B. In any case in which a person is arrested pursuant to subsection A of this section and the person arrested does not demand to be taken before a magistrate, the public employee making the arrest shall prepare a written notice to appear and release the person on his or her promise to appear.
